Notice is hereby given that the City Council of the City of Omaha met on November 25, 2025 and passed and approved the following ordinances:

 

ORDINANCE NO. 44474

AN ORDINANCE approving the contract with Midwest Maritime Services, LLC for Sewer Maintenance On-Call Tree and Stump Removal at Various Locations, for a period of three (3) years beginning January 1, 2026 through December 31, 2028, with the exclusive option by the City to extend the contract for up to two (2) one-year terms; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

ORDINANCE NO. 44475

AN ORDINANCE to approve exercising both one-year options in an Agreement between City of Omaha to Mutual of Omaha to provide group long term disability insurance for full-time classified and unclassified employees of the AEC, Functional, CMPTEC, and Civilian Bargaining groups, Department Directors and elected officials involving the payment of money from appropriations in more than one (1) year in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended; to provide for payment to Mutual of Omaha to provide group long term disability insurance for two additional years at the same annual cost of $170,473.80; funds for this Agreement will be paid from the Human Resources Department, Fund No. 11111, Organization No. 118018; and to provide for an effective date hereof.

AN ORDINANCE to approve and execute an Agreement by and between the City of Omaha, a Municipal Corporation, and American Heritage Life Insurance Company, dba The Standard, to provide voluntary benefits for City employees for a period of thirty-six (36) months commencing on January 1, 2026, and ending on December 31, 2028 with two (2) additional one-year City options, in accordance with the lowest and best proposal submitted by said American Heritage Life Insurance Company, dba The Standard; and to provide the effective date thereof.

ORDINANCE NO. 44477

AN ORDINANCE (1) to approve a professional services agreement between the City of Omaha and Toni G. Jensen in the amount of eight thousand eight hundred eighty dollars ($8,880); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2023 Improving Criminal Justice Responses (ICJR) to Sexual Assault, Domestic Violence, Dating Violence, and Stalking Grant Program, Award # 15JOVW-23-GG-02593-ICJR, from the United States Department of Justice, Office on Violence Against Women; to Toni G. Jensen provide funding for the facilitation of a Community Safety Assessment that will produce specific recommendations to the Douglas County Community Response Team on improving current responses to sexual assault, domestic violence, dating violence, and stalking; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

ORDINANCE NO. 44478

AN ORDINANCE to amend a portion of Section 11-265 of the Omaha Municipal Code (entitled “Food Handler Permits and certified food protection managers; responsibilities of the food establishment permit holder.”) to correct a typographical error. Section 11-265 is newly adopted as of August 26, 2025; and sub-part (a) of this Section mistakenly utilizes the term “particles” instead of the intended term “practices”. If approved, this Ordinance will amend Section 11-256 to correct the typographical error in Section 11-265 and will provide the effective date thereof.

AN ORDINANCE to approve a Purchase and Sale Agreement between the City of Omaha and The Duo Apartments, LLC, a Nebraska limited liability company, for the transfer and sale of real property and a public parking facility generally located at 201 South 16th Street; the agreement authorizes the sale of the real property for $5,200,000 and the purchase of a 461-stall public parking facility with approximately 12,000 square feet of first floor retail for an amount not to exceed $32,940,199; and providing an effective date.

AN ORDINANCE approving an amendment to a redevelopment agreement between the City of Omaha, a Nebraska Municipal Corporation in Douglas County, Nebraska, and The Duo Apartments, LLC, a Nebraska limited liability company, which will acknowledge and authorize the Redevelopment Project to be completed in three phases, each subject to a separate Notice to Divide and to establish a timeline and description of each phase, and providing for an effective date.

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on December 9, 2025, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

 

An ordinance approving the contract with Alexander Lawn & Landscape, Inc. for Ground Maintenance at six (6) City of Omaha Maintenance Facilities, for a two (2) year term beginning April 1, 2026, concluding December 1, 2027, with the sole option by the City to extend the contract for up to two (2) additional separate one-year terms, for the 2028 and 2029 mowing seasons; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account.

 

An ordinance to approve a Major Amendment to a Mixed Use District Development Agreement for Elk Creek Pines, for the property located northeast of 168th Street and West Maple Road, to remove a proposed center identification sign on Lot 2 in order to replace it with an on-premise monument sign.

 

An ordinance approving an Amendment to Agreement for Actuarial Services – COERS between the City of Omaha, the City of Omaha Employees Retirement System, and Milliman, Inc. for the provision of actuarial services, including the performance of an annual actuarial valuation and certain additional actuarial consulting services by the City of Omaha Employees Retirement System, for the years 2026 through 2028, at the same cost of $33,469 as was charged for 2025 for each year of the Amendment; with such payments to come from the City of Omaha General Fund 11111, Organization 119014, Account 42268, Actuarial Studies.

An ordinance for approval of additional fuel storage at an existing Class “B” Flammable/Combustible Liquid Storage District, pursuant to Section 40-251 of the Omaha Municipal Code, a Class “B” Flammable Liquids Storage District known as District No. B-157 at 333 S 132nd Street as requested by Jewish Federation of Omaha.

 

An ordinance to approve a Purchase Agreement between the City of Omaha and Union Pacific Railroad Company, for the transfer and sale of City owned real property located at 1441 Capitol Avenue; the agreement authorizes the sale of the real property for $7,310,000.00.

 

An ordinance to approve a Purchase and Sale Agreement between the City of Omaha and Union Pacific Railroad Company, for the transfer and sale of real property generally located at 1101 Izard Street; the agreement authorizes the City to acquire the real property for approximately $18,698,130.00, provide for the conveyance of easements in favor of Union Pacific and certain other obligations of the parties.

 

An ordinance authorizing and providing for the issuance of Stadium Revenue Bonds in one or more taxable or tax-exempt series of not to exceed an aggregate principal amount of $25,000,000.00, for the purpose of (1) funding the acquisition, construction, public improvements, of an eligible sports arena facility and (2) paying the costs of issuance of such bonds; prescribing the form and certain details of such bonds; pledging certain revenues from such sports arena facility and the State of Nebraska’s Department of Revenue Award of state sales tax revenue to the payment of the principal of and interest on such bonds as the same become due; limiting payment of such bonds to the revenues specified herein; creating and establishing funds and accounts; delegating, authorizing and directing the finance director to exercise his independent discretion and judgment in determining and finalizing certain terms and provisions of such bonds not specified herein; taking other actions and making other covenants and agreements in connection with the foregoing; and related matters (Union Omaha).

 

An ordinance to amend Sections 23-177, 23-494, and 23-502 of the Omaha Municipal Code to reflect changes for employees in the Administrative and Executive Classifications (AEC) for the years 2026, 2027, 2028, and 2029; to provide for placement of employees in the new pay plan; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with this Ordinance shall not be applicable to those employees in AEC.

AIR QUALITY CONTROL

NOTICE TO PUBLIC

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Ready Mixed Concrete to renew the air emission operating permit for the concrete batch plant at 3602 “L” Street, Omaha. The potential emissions at this facility, in tons, will be: PM10 9.0 and PM2.5 9.0.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from December 3, 2025 to January 3, 2026. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
