NOTICE OF CREATION OF 

SANITARY AND STORM SEWER IMPROVEMENT DISTRICT NO. 2026-01 

NOTICE IS HEREBY GIVEN that at a meeting of the Mayor and City Council of the City of Ralston, Nebraska (the “City”), held on October 6, 2026, there was passed, approved and adopted, after three readings as required by law, Ordinance No. 1351 (the “Ordinance”) creating and establishing Sanitary and Storm Sewer Improvement District No. 2026-01 of the City (the “District”).

The outer boundaries of the District shall contain the following property:

A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 11 TOWNSHIP 14 NORTH, RANGE 12 EAST OF THE 6TH P.M., CITY OF RALSTON, DOUGLAS COUNTY, NEBRASKA BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: 

BEGINNING AT THE SOUTHEAST CORNER OF LOT 42, BLOCK 24, ORIGINAL PLAT CITY OF RALSTON; THENCE NORTHERLY ALONG THE WEST RIGHT OF WAY LINE OF 77TH STREET, A DISTANCE OF 300 FEET MORE OR LESS TO THE WESTERLY EXTENSION OF THE NORTH RIGHT OF WAY LINE OF MAIN STREET; THENCE EASTERLY ON NORTH RIGHT OF WAY LINE OF MAIN STREET, A DISTANCE OF 850 FEET MORE OR LESS; THENCE NORTHEASTERLY CONTINUING ON THE NORTH RIGHT OF WAY LINE OF MAIN STREET A DISTANCE OF 736 FEET MORE OR LESS; THENCE EASTERLY CONTINUING ON THE NORTH RIGHT OF WAY LINE OF MAIN STREET A DITANCE OF 755 FEET MORE OR LESS TO THE EAST RIGHT OF WAY LINE OF 72ND STREET; THENCE SOUTHERLY ON THE EAST RIGHT OF WAY LINE OF 72ND STREET A DISTANCE OF 1096 FEET MORE OR LESS TO THE NORTHERLY RAILROAD RIGHT OF WAY LINE OF BURLINGTON NORTHERN SANTA FE RAILWAY; THENCE WESTERLY ON THE NORTHERLY RAILROAD RIGHT OF WAY LINE, A DISTANCE OF 2322 FEET MORE OR LESS TO THE WEST RIGHT OF WAY LINE OF 77TH STREET; THENCE NORTHERLY ON THE WEST RIGHT OF WAY LINE OF 77TH STREET A DISTANCE OF 493 FEET MORE OR LESS TO THE SOUTHEAST CORNER OF SAID LOT 42 AND THE POINT OF BEGINNING.

Within the District, sanitary and storm sewers within the above-described outer boundaries shall be improved by construction of improvements therein consisting of one or more systems of sewerage, drainage, or water service, providing such sewerage, drainage, and water systems and regulating the construction, repair, and use of such systems, and compelling all proper connections therewith and branches from other streets, avenues, and alleys, and from private property (collectively, the “Improvements”). The Improvements are to be made in accordance with plans and specifications prepare by the Engineers of the City and approved by the City Council. The Improvements shall be made at public cost.

This notice and a copy of the Ordinance shall be mailed within twenty (20) calendar days of the passage of the Ordinance to the owners of the record title of any property abutting upon the streets, avenues, or alleys, or parts thereof, which are within the District.

This notice shall be published in a legal newspaper in or of general circulation in the City within twenty (20) calendar days of the passage of the Ordinance.  If within forty (40) days after the first publication of this notice, the owners of record title representing more than fifty percent (50%) of the front footage of the property abutting upon the streets, avenues, or alleys, or parts thereof which are within the District file with the City Council or the City Clerk written objections to the creation of the District and the construction of the Improvements therein, said work shall not be done in said District and the Ordinance creating said District shall be repealed. If sufficient objections are not filed against the District in the time and manner aforesaid, the City shall forthwith proceed to construct the Improvements in the District and shall contract therefore.
