NOTICE OF TERMINATION
OF NOTICE OF COMMENCEMENT
Pursuant to §52-146 of the Nebraska Construction Lien Act, the undersigned, as Contracting Owner, hereby gives notice as follows:
1. The Real Estate is described as follows:
Lot 2, Tregaron Towne Centre Replat 8, an Addition to the City of Bellevue, as surveyed, platted and recorded in Sarpy County, Nebraska (the “Real Estate”), which was previously a portion of Lot 7, Tregaron Towne Centre, an Addition to the City of Bellevue, as surveyed, platted and recorded in Sarpy County, Nebraska.
2. The name and address of the Contracting Owner, who is the fee simple title holder of the Real Estate described in paragraph 1 above, is:
Batis Dev – Capehart, LLC, 2933 SW Woodside Drive, Ste 200, Topeka, KS 66614.
3. The Notice of Commencement which is to be terminated as to the property described in paragraph 1 above was recorded on November 27, 2024, as Instrument No. 2024-23317, in the Records of Sarpy County, Nebraska (the “Notice of Commencement”).
4. A Termination of Notice of Commencement was duly recorded with the Register of Deeds of Sarpy County, Nebraska on May 23, 2025, as Instrument No. 2025-09982, in the Records of Sarpy County, Nebraska.
5. The Notice of Commencement is terminated as to the Real Estate as of June 23, 2025, which date is at least thirty (30) days after the filing of the Termination of Notice of Commencement with the Register of Deeds of Sarpy County, Nebraska.
6. All lien claims for which a Notice of Lien is not recorded against the Real Estate described in paragraph 1 above by June 23, 2025, may be defeated by a transfer of the Real Estate described in paragraph 1 above.
