RALSTON CITY COUNCIL MEETING
Tuesday, November 7, 2023

The Ralston City Council met in regular session on Tuesday, November 7, 2023 at 5:30 PM at Ralston City Hall. The Pledge of Allegiance was recited. Roll was called with the following present: Mayor Groesser, Council members Krause, Brousek, Kavanaugh, Preis, Kjar and Fideline. Absent: None.
The agenda was available at City Hall for public inspection and posted prior to the meeting. The legal notice for the meeting was published in the Daily Record. Claims listed are approved and part of these minutes.
Pastor Jim Haack, Beautiful Savior Lutheran Church gave the invocation. Councilman Krause gave an invocation recognizing Veteran’s Day. Mayor Groesser welcomed the press and guests. Groesser said the meeting is subject to the Nebraska Open Meetings Act. A copy of the Act is posted at the rear of the Council Chambers and is available to view on the City’s website at www.cityofralston.com.
The City Council reviewed the following items under the consent agenda. Approval of Council Minutes from October 17, 2023 Council Meeting; Approval of Claims; Liberty First Credit Union Arena Financial Statements for period ending September 30, 2023; Department Head and/or Commission Reports. Moved and seconded to approve the Consent Agenda and move action item number nine to number 2. On a roll call vote, the following votes were recorded on the electronic voting board. Aye: Krause, Preis, Kavanaugh, Brousek, Kjar and Fideline. Nay: None. Absent: None. Motion carried.
Freshman stated that he has finished code classes and will be reviewing through the city’s code for compliance. Dittmer distributed his monthly report. All parks are closed down for the year. Ninety eight percent of the sanitary sewers are verified and GIS mapped in. The team is forty percent done with the storm sewers. They are also getting mapped in to the system. Dittmer reported that the camera system is a great unit and has been and will continue to be a big asset moving forward. Dittmer informed council that they have completed three hundred fifty-eight locators during the month of October which is a record number for Ralston. Bohling reported that we are getting ready for the yearly audit. Leonardo gave the department’s traffic report. Peña reported that the library team is getting ready for Holiday Magic. Peña is happy to report that the Winter Village is being brought back to the library.
Krajewski reported on upcoming events scheduled at the Liberty First Credit Union Arena. Krajewski stated that his last day is November 17th. Roeder reported that the Halloween event at the library, Dr. Oxygen’s Halloween Show was a success. Engberg reported forty - five permits issued in October.
Leonardo provided a biography of Officer Peter McNally and background information on the hiring process. Ficenec administered the Oath of Office to newly appointed Police Officer, Peter McNally.

Ralston Declares November 17th, 2023 as “Brian Krajewski Day”
WHEREAS, Brian Krajewski has served as General Manager of the Liberty First Credit Union Arena from April 2019 until the present; AND
WHEREAS, Brian has attracted world renowned artists and acts to the LFCU Arena such as Cody Johnson, Gabriel “Fluffy” Iglesias, REO Speedwagon, Cole Swindell, Chicago, STYX, Papa Roach, Alice Cooper and Jo Koy during his tenure as General Manager; AND
WHEREAS, over 1.25 million attendees saw shows at the Arena under his unparalleled leadership; AND
WHEREAS, Brian managed the Arena to one of its best years ever during the height of the COVID pandemic while Arenas across the nation experienced record losses; AND
WHEREAS, the Arena generated $1.5 million in sales taxes for the City of Ralston during his term, providing revenue that has been critical in moving the City forward; AND
WHEREAS, Brian’s stewardship of the Arena created an economic boon for Ralston and set the stage for the continuing success of the Hinge Redevelopment Project; AND
WHEREAS, Brian’s outstanding leadership was recognized by his peers when he was presented with the 2022 Venues Now “Next Generation” award; AND
WHEREAS, the Ralston community is grateful to Brian for establishing the Liberty First Credit Union Arena as a premier venue in the Midwest, managing the facility through many difficult challenges while maintaining strong relationships with national promoters, Arena tenants, City leaders, and the Ralston community;
THEREFORE BE IT RESOLVED, that Mayor Don Groesser, City Council President Jerry Krause, and Council Members Ben Preis, Lee Fideline, Brian Kavanaugh, Tim Brousek, and Tom Kjar declare November 17th, 2023 as “Brian Krajewski Day” in the City of Ralston to honor Brian’s many triumphs as the General Manager of the Liberty First Credit Union Arena.

RESOLUTION DECLARING CERTAIN AREAS OF THE CITY AS BLIGHTED
AND SUBSTANDARD AND IN NEED
OF REDEVELOPMENT
WHEREAS, the City of Ralston commissioned Hanna:Keelan Associates, P.C. to conduct a study on whether certain areas of the city are substandard and blighted, a map of which is attached as Exhibit “A” to this resolution and incorporated by reference;
WHEREAS, Hanna Keelan Associates, P.C. prepared a Blight & Substandard Determination Study for Redevelopment Area #2, consisting of 63 pages, which found as follows:
1. Substandard: A strong presence of
substandard factors throughout the area due to age or obsolescence of buildings and inadequate provisions for ventilation, light, air, sanitation and open spaces, as well as a reasonable presence of substandard factors throughout the area due to dilapidated and deterioration of buildings, the combination of which is detrimental to public health, safety, morals or welfare.
2. Blighted: A strong presence of blighted
factors throughout the area due to: faulty lot layout in relation to size, adequacy, accessibility, or usefulness; insanitary or unsafe conditions; diversity of ownership; improper subdivision or obsolete platting; the existence of conditions which endanger life or property by fire or other causes; and an average age of residential and commercial units in excess of forty (40) years; as well as a reasonable presence of blighted factors throughout the area of: a substantial number of deteriorated or deteriorating structures; the existence of defective or inadequate street layout; deterioration of site or other improvements; the combination of which substantially impairs or arrests the sound growth of the community, retards the provision of housing accommodations, constitutes a economic or social liability, and is detrimental to the public health, safety, morals, or welfare in its present condition and use.
WHEREAS, the Blight & Substandard Determination Study for Redevelopment Area #2 was submitted to the Ralston Planning Commission for its review and recommendation on the question of whether the area is substandard and blighted, the Planning Commission held a public hearing on the question on Oct. 9th, 2023, and it has submitted its written recommendation to the City Council which is attached as Exhibit “B” to this resolution and incorporated by reference;
WHEREAS notice has been published as required by law, more specifically notice of the Planning Commission hearing was published in The Daily Record on September 18th and 25th, and mailed to Douglas County, the Ralston Public School District, the Metropolitan Community College, and the Papio-Missouri River Natural Resources District by certified mail, return receipt requested, on September 12th, and notice of the City Council meeting was published in the Daily Record on October 16th and 23rd, and mailed to Douglas County, the Ralston Pubic School District, the Metropolitan Community College, and the Papio-Missouri River Natural Resources District by certified mail, return receipt requested, on October 24th.
THEREFORE BE IT RESOLVED by the Ralston City Council that the real property incorporated within the area displayed in Exhibit “A” hereto is hereby declared blighted and substandard and in need of redevelopment, including:

Hoppe discussed the struggles with the former Fireside Village apartment complex. This was a site of many building and safety code violations and complaints. The city sent the Building and Safety Inspector to the complex with a team to try to get this up to code. Hoppe stated that while this did improve things it became immediately apparent that without new ownership and a private sector partner this complex was going to continue to go downhill impacting the people that live there as well as the residents of the community. Artisan Capital Group purchased the property. Ryan Cahalan, partner with Artisan Capital Group, discussed their plans for WILDEWOOD Commons and some of the challenges they are facing. Ficenec noted that when an area is blighted it is good for thirty years unless the city would unblight it earlier. Ficenec discussed the area and reasons why we chose to add the additional property as part of the blight. Tim Keelan, with Hanna Keelan Associates, P.C., who prepared the blight study went through their executive summary and discussed their findings to give council an understanding of their study and why this area meets the conditions.

Groesser opened Consideration of a Ralston Construction contract between City of Ralston, Nebraska and Earnest Construction Group, Inc. Dittmer noted that this is a contract with Earnest Construction on our panel replacement projects. Five year, one year renewable that will come back to council by October 31st each year.

Groesser opened Consideration for Solid Waste Services between City of Ralston, Nebraska and Waste connections of Nebraska, Inc. Matt Connell with Papillion Sanitation explained how their rates went up insignificantly. Connell explained how they will keep their partnerships with the Arena and continue to provide for the 4th of July. Krause asked Connell if they will change how they pick up. Connell responded that everything will stay the same to make it convenient for the residents.

Public Comment: Richard Shively spoke about some high grass and weeds on 72nd street. Shively also spoke about 84th street needing sidewalks. George congratulated the baseball team for getting Orval Smith. Clayton spoke about fiber coming to town. Richard Shively spoke about Allo and gave them praise.
There being no further business to come before the Council, the meeting adjourned at 6:54 PM.

Bohling reported that we are getting ready for the yearly audit. Leonardo reported that his department is looking into the fire matter that occurred at WILDEWOOD Commons. Peña reported they are getting ready for Holiday Magic. Schulz, acting General Manager of the arena, reported on upcoming events scheduled at the Liberty First Credit Union Arena including Lancer hockey games and concerts. Roeder reported on events for Holiday Magic.
Utterback gave the Fire Department Annual Report for Fire Chief Eischeid.
Leonardo explained the extensive process they go through to ensure finding the most qualified Sergeants. Leonardo noted that Christopher Jepsen began working for the Ralson Police Department in August of 2019. Jepsen is an extensive instructor including fire arms, patrol rifle, active shooter, high threat CQB and a field training officer. Ficenec administered the Oath of Office to newly promoted Sergeant Christopher Jepsen.
Leonardo noted that Andrew Kanngieser began working for the Ralson Police Department in November of 2017. Kanngieser is a Bennington volunteer fire department fire fighter and EMT.
Kanngieser is the School Resource Officer for the Ralston Police department and a training instructor. Ficenec administered the Oath of Office to newly promoted Sergeant Andrew Kanngieser.
Groesser opened consideration of appointment of Brad Utterback as Fire Chief. Moved and seconded approval of Brad Utterback as Fire Chief. Aye: Krause, Preis, Kavanaugh, Brousek, and Fideline. Nay: None. Absent: Kjar. Motion carried.

Krause introduced resolution 2023-18. Kelly read Resolution 2022-19 by title only: AUTHORIZE THE MAYOR TO SIGN THE YEAR-END CERTIFICATION OF CITY STREET SUPERINTENDENT FORM FOR 2023.
Krause moved and Brousek seconded to approve the following resolution.
RESOLUTION
SIGNING OF THE YEAR-END
CERTIFICATION OF CITY STREET SUPERINTENDENT FORM 2023
Resolution No. 2023-18
Whereas: State of Nebraska Statutes, sections 39-2302, and 39-2511 through 39-2515 details the requirements that must be met in order for a municipality to qualify for an annual Incentive Payment; and
Whereas: The State of Nebraska Department of Transportation (NDOT) requires that each incorporated municipality must annually certify (by December 31st of each year) the appointment of the City Street Superintendent(s) to the NDOT using the Year-End Certification of City Street Superintendent; and
Whereas: The NDOT requires that such certification shall also include a copy of the documentation of the city street superintendent’s appointment, i.e., meeting minutes; showing the appointment of the City Street Superintendent by their name as it appears on the License (if applicable), their License Number and Class of License (if applicable), and type of appointment, i.e., employed, contract (consultant, or interlocal agreement with another incorporated municipality and/or county), and the beginning date of the appointment; and
Whereas: The NDOT also requires that such Year-End Certification of City Street Superintendent form shall be signed by the Mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body authorizing the signing of the Year-End Certification of City Street Superintendent by the Mayor of Village Board Chairperson.
Be it resolved that the Mayor of Ralston is hereby authorized to sign the Year-End Certification of City Street Superintendent certifying that Daniel C. Freshman, License Number S-1136, was the appointed Street Superintendent for 2023.
Kelly indicated this is required to be sent to the Department of Transportation so Ralston can receive their annual incentive payment. There being no further comments, Groesser called for the vote. On a roll call vote, the following votes were recorded on the electronic voting board. Aye: Brousek, Kavanaugh, Preis, Fideline and Krause. Nay: None Absent: Kjar. Motion carried.
Preis introduced Ordinance No. 1326. Kelly read Ordinance No. 1326 by title only: AN ORDINANCE TO AMEND THE MASTER FEE SCHEDULE FOR THE CITY OF RALSTON, NEBRASKA, ESTABLISHED BY ORDINANCE NO. 1271 AND AMENDED BY ORDINANCE NUMBER 1296; TO REPEAL ANY ORDINANCE IN CONFLICT HEREWITH; TO PROVIDE FOR AN EFFECTIVE DATE; AND TO AUTHORIZE THAT SAID ORDINANCE BE PUBLISHED IN PAMPHLET FORM.
Mayor Groesser opened the public hearing and first reading of Ordinance No. 1326 at 6:04 PM.
Hoppe talked Council through the Master Fee Schedule and the updates required.
There being no further discussion, Mayor Groesser closed the public hearing at 6:21 P.M.
Moved and seconded to remove Action Item Number eight from the table. On a roll call vote, the following votes were recorded on the electronic voting board. Aye: Brousek, Kavanaugh, Preis, Fideline and Krause. Nay: None Absent: Kjar. Motion carried.
Mayor Groesser opened consideration of an agreement for snow removal services at the Liberty First Credit Union Arena between City of Ralston and T 7, Inc. a Nebraska corporation doing business as Mausbach Grounds Maintenance. Moved and seconded approval of the agreement for snow removal services at the Liberty First Credit Union Arena between City of Ralston and T 7, Inc. a Nebraska corporation doing business as Mausbach Grounds Maintenance. On a roll call vote, the following votes were recorded on the electric voting board. Aye: Krause, Preis, Kavanaugh, Brousek, and Fideline. Nay: None. Absent: Kjar. Motion carried.
Public Comment: None Council Comment: Brousek congratulated the new police sergeants, new fire chief and assistant fire chief. Kavanaugh wished everyone a Happy Thanksgiving. Groesser wished everyone a Happy Thanksgiving and reminded everyone of Holiday Magic and the fire department chili feed.
There being no further business to come before the Council, the meeting adjourned at 6:40 PM.
