Notice is hereby given that the City Council of the City of Omaha met on September 17, 2024 and passed and approved the following ordinances:
ORDINANCE NO. 43957
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located north of 207th and Q Streets from AG - Agricultural District to DR- Development Reserve District.
Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Outlot D, Kensington Park, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG – Agricultural District to DR – Development Reserve District.

AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the Bensonvale Acres Street Improvement Phase 2, project identified as OPW 54705; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof.

PUBLIC HEARING NOTICES
NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on October 1, 2024, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:
An ordinance to amend Special Levy Ordinance No. 10367 levying a special tax and assessment on certain lots, part of lots and pieces of real estate in the City of Omaha to cover the cost of clearing snow and ice from sidewalks in the District No. SWSR 2024-01.
An ordinance approving an amendment to a grant award contract with the Nebraska Department of Natural Resources for the Combined Sewer Overflow (CSO) Program, involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to authorize the increase of grant funds received in the amount of $1,086,503.30, as outlined in the amendment; to provide for reimbursements to a specific account.
An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property located at 2307 N Street, for the construction of a city owned parking garage; providing that the City negotiate with the property owners for the purchase of above mentioned property, providing that if said parcel cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.
An ordinance approving an Agreement with StreetScan USA, Inc. for a total amount of $444,250.00, for the sole source purchase of StreetScan, 360 Imagery & StreetLogix software products to be utilized by the Capital Construction and Street Maintenance Division, to be effective for a term of three (3) years; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account.
An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for linear trail corridor purposes, specifically for the Beltline Trail Phase 3 from Decatur to Grant Streets, providing that the City negotiate with the property owners for land acquisition, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings to be undertaken and completed.
An ordinance approving an Inter-local Cooperation Act Agreement between the City of Omaha, the Papio-Missouri River Natural Resources District (NRD) and Alegent Health – Immanuel Medical Center for the Sorensen Trail, Girard Connection.
An ordinance (1) to approve an agreement between the City of Omaha and Nebraska State Probation District 4A (Adult) in the amount of $15,000.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2022 Project Safe Neighborhoods Grant Award #15PBJA-22-GG-00801, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies to prevent and interrupt gun and gang violence by adult probationers in the District of Nebraska Project Safe Neighborhoods (PSN) focus area; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account.
An ordinance to approve the acceptance of and authorize disbursement over more than one fiscal year from the Nebraska Crime Commission, FY 2025 Project Night Life Expansion (PNL) Grant, Award #402-25-40 in the amount of $110,000.00 during the project period of October 1, 2024 to September 30, 2025; to support educational presentations by the Omaha Police Department for the Project Night Life Expansion as detailed in the attached grant application; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter.
An ordinance to amend Omaha Municipal Code Chapter 3, Article I, entitled “In General,” by creating Sections 3-12 and 3-13 to require any person or business operating or housing a functioning crypto automated teller machine (ATM) or Bitcoin teller machine (BTM) on its premises to post a written warning providing users with notice of potential fraud risks; and to make it a crime to fail to post such written notice.
