Notice is hereby given that the City Council of the City of Omaha met on June 9, 2020 and passed and approved the following ordinances:
ORDINANCE NO. 42240
AN ORDINANCE to amend Section 36-2 to include a definition of motorized scooter; to add 36-146 to create the offense of Motorized Scooter Operation Violation; and to provide an effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA Section 1. Due to the length of the affected ordinance, Omaha City Council Rule VII(B) requiring amending ordinances to recite the entire section is hereby waived solely for the purposes of this ordinance and only the underlined material to be added shall be recited herein. Section 2. Section 36-2 of the Omaha Municipal Code is hereby amended to include the following definition and read as follows:
Sec. 36-2. Definitions
Motorized Scooter. A device with an electric motor designed to transport only one person with at least two wheels in contact with the ground, propelled or with the capability to propel exclusively or in combination with the application of human power and which cannot attain a speed of more than fifteen (15) miles per hour on a paved level surface without the application of human power.
Section 3. Section 36-146 of the Omaha Municipal Code is hereby created to read as follows:
Sec. 36-146. Motorized Scooter Operation Violation
It shall be unlawful for any person to purposely or knowingly operate a motorized scooter, as defined in Sec. 36-2, in violation of one or more of the following manners:
(a) The operator of a motorized scooter shall obey all the traffic laws of the State of Nebraska and the City of Omaha:
(b) A motorized scooter shall not be operated on any sidewalk;
(c) A motorized scooter shall not, at any time, impede the free flow of pedestrian traffic:
(d) No one under the age of eighteen (18) shall operate a motorized scooter;
(e) Only one person may operate a motorized scooter;
(f) An operator of a motorized scooter shall have a valid driver’s license or state -issued identification;
(g) A motorized scooter shall not operate on any street or highway where the speed limit is greater than thirty-five miles per hour;
(h) Drivers are prohibited from operating a motorized scooter while consuming any alcoholic beverage and the results of a preliminary breath test (PBT) shall be sufficient evidence to presume consumption;
(i) Refusal to submit to a preliminary breath test (PBT) constitutes a separate offense; or
(j) A motorized scooter shall not be parked in a way that blocks:
(1) Railroad tracks;
(2) Handicapped or prohibited parking; or
(3) Vehicular driveways.
(k) Children under the age of 18 and wearing a helmet are exempt from the restrictions stated in subsections (b), (d), (f) and (j)(3).
(l) A person who violates any provision of this section shall be punished by a fine of one-hundred dollars ($100.00) for each offense.
Section 4. This ordinance, being legislative in character, and in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, shall be in full force and take effect fifteen (15) days following the date of its passage.

ORDINANCE NO. 42237
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 222nd and Q Streets from AG-Agricultural District to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-86 and Outlots A-L, Legend Trails, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to DR-Development Reserve District. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42238
AN ORDINANCE to amend the official records, logs, and plats of the City of Omaha by providing for the change in the street names for the following two streets in the Coventry Addition, a subdivision in Douglas County, Nebraska: A portion of Coventry Drive changed to R Street, and a portion of Coventry Drive changed to 2051h Street; and to provide for the effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, notwithstanding the provisions of Chapters 27 and 34 of the Omaha Municipal Code, the official records, logs, and plats of the City of Omaha, maintained pursuant to the Omaha Municipal Code, be amended to provide for the following changes in street names: a) Coventry Drive changes to R Street, from 207th Street East to the east line of Lot 79, Coventry Addition. b) Coventry Drive changes to 205th Street, from George B. Lake Pkwy. North to the north line of Lot 97, Coventry Addition. These changes are further illustrated on Exhibit “A” and made a part by this reference. Section 2. That this Ordinance shall be in full force and take effect on whichever dates occurs later: a) fifteen (15) days from and after the date of its passage, or b) upon the recording of Coventry North, Lot 1, a subdivision to be surveyed, platted and recorded in Douglas County, Nebraska.

ORDINANCE NO. 42239
AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Ames Industrial Park, LLC, a Nebraska limited liability company, to implement the Ames Industrial Park Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 4411 North 20th Street, which proposes the rehabilitation of a 12,400 square foot fire damaged building, and to construct a smaller new building with 5,000 square feet which will contain two 2,500 square foot rental bays; the agreement authorizes the use of up to $282,676.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Ames Industrial Park, LLC, a Nebraska limited liability company to authorize the use of up to $282,676.00, plus accrued interest, to offset TIF eligible costs such as such as acquisition, building rehabilitation construction costs, architectural and engineering fees, and public improvements as required, for a project with total estimated costs of $1,966,685.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 42241
AN ORDINANCE to add Section 20-13 to create the offense of Hate Intimidation; and to provide an effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA Section 1. That Section 20-13 of the Omaha Municipal Code is hereby created to read as follows:
Sec. 20-13. Hate Intimidation
A person who violates another section of this chapter with the intent to intimidate another person or persons in whole or in part because of the actual or perceived race, color, creed, religion, sex, marital status, sexual orientation, gender identity, national origin, age, or physical or mental disability of the other person or persons is guilty of the separate offense of hate intimidation and shall be punished as provided by section 1-10 and in accordance with subsection (a).
(a) The offense defined in this section shall be treated as a separate and distinct offense from the violation of another section of this chapter being committed and the sentence imposed shall be consecutive to any other sentence imposed.
Section 2. This ordinance, being legislative in character, and in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, shall be in full force and take effect fifteen (15) days following the date of its passage.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of AT&T Corp. to obtain an historical minor air emission construction permit for their telecommunications facility at 4015 S 1322nd Street, Omaha. The potential emissions from this project in tons will be: TSP 0.13, PM10 0.13, PM2.5 0.13, SOx 0.00, NOx 4.93, VOC 0.04, CO 3.89, and GHG 213.62.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from June 17, 2020 to July 17, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
