Notice is hereby given that the City Council of the City of Omaha met on June 2, 2020 and passed and approved the following ordinances:
ORDINANCE NO. 42230
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located west of 127th Avenue and Grebe Street from AG-Agricultural District to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1 inclusive, located in the NW1/4 SEC 30, T16N, R12E, of the 6th P.M., Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to DR-Development Reserve District. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42231
AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located at 14445 West Center Road; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1 and 2, Crescent Oaks Plaza Replat 2, a subdivision in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. AN ORDINANCE to repeal the PUR-Planned Unit Redevelopment Overlay District in a NBD-Neighborhood Business District (property is also located within an ACl-1 (PL)-Area of Civic importance Overlay District) for property located at 3814 Leavenworth Street, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. ln accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, West Omaha Replat 6, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is removed from the boundaries of the PUR-Planned Unit Redevelopment Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. ORDINANCE NO. 42234
AN ORDINANCE to approve a PUR-Planned Unit Redevelopment Overlay District in a NBD- Neighborhood Business District (property is also located within an ACI-l(PL)-Area of Civic Importance Overlay District) located at 3814 Leavenworth Street, to approve the Development Plan, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County , Nebraska: Lot 1, West Omaha Replat 6, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska. Section 2. The proposed Development Plan has been reviewed and evaluated pursuant to, and meets each of the site plan criteria set forth in Section 55-885 of the Omaha Municipal Code. Section 3. ORDINANCE NO. 42235
AN ORDINANCE to accept the bid from All Seasons Turf & Tree, LLC for grounds maintenance of the right-of-ways identified as Area 1, from goth Street east to the Missouri River and from Cuming Street north to the City Limits and Area 3, from goth Street west to 168th Street and from Dodge Street north to the City Limits in the amount of $168,406.56 per year, for a two year period ending November 30, 2021; providing for the payments from appropriations of more than one year in accordance with Section o.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section ·1. That this Ordinance rescinds Ordinance 2020-42094 adopted January 7, 2020 awarding the original bid for $168,406.56, to Chopper’s Lawn Service as they were unable to secure bonding required by the contract, Douglas County Purchasing re-bid the project. Section 2. That the bid from All Seasons Turf & Tree, LLC for grounds maintenance of the right-of-ways identified as Area 1, from goth Street east to the Missouri River and from Cuming Street north to the City Limits and Area 3, from goth Street west to 168th Street and from Dodge Street north to the City Limits in the amount of $168,406.56 per year, for a two year period ending November 30, 2021 is hereby accepted. Section 3. That payments for these services shall be made from appropriations of more than one year in accord with Section 5.17 of the Home Rule Charter of the City of Omaha of 1956, as amended. The cost of these ground maintenance services from the Street and Highway Allocation Fund 12131, Street Right-of-way Cleaning Organization 116152. Section 4. That the City of Omaha Purchasing Agent is authorized to issue a purchase order for grounds maintenance of the right-of-ways identified as Area 1, from goth Street east to the Missouri River and from Cuming Street north to the City Limits and Area 3, from ·goth Street west to 1681h Street and from Dodge Street north to the City Limits. That this Ordinance, being administrative in nature, shall take effect and be in full force upon date of its passage.

AN ORDINANCE to accept the bid from MaConn Enterprises, LLC for mowing of the Missouri River Flood Levee in the amount of $27,610.00 per year, for a term from June 1, 2020 to December 1, 2021 with an option by the City of Omaha to extend for two (2) additional one (1) year periods; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid from MaConn Enterprises, LLC for mowing of the Missouri River Flood Levee in the amount of $27,610.00 per year, for a term ending December 1, 2021 is hereby accepted. Section 2. ORDINANCE NO. 42190
AN ORDINANCE establishing the North 24th Street Business Improvement District (BID No. 6879) under the authority of the Business Improvement District Act, Neb.Rev.Stat. § 19-4105, et seq. for the purpose of providing specified activities, work and improvements in the North 24th Street area (Meredith Avenue to the north, 25th Avenue to the west, Cuming Street to the south, and 23rd Street to 20th Street to the east) of Omaha, Nebraska; to create the North 24th Street Business Improvement District; to define the boundaries of such District; to identify that the properties benefited by the streetscape improvements will be subject to special assessments in accordance with the North 24th Street Business Improvement District Plan; to provide for special assessment in an approximate amount of up to $21,500 in year one for general maintenance and infrastructure improvement, lighting, beautification, promotion, parking and security; to be imposed upon such District based upon the benefits conferred; to provide for the assessment of property specially benefited within the District; to provide a method of assessment to be assessed upon properties specially benefited by the District; and to provide the effective date hereof. WHEREAS, there has been a request by the North 24th Street Business Improvement District Area Board that the City Council of the City of Omaha establish an Improvement District providing specified work and improvements as described herein and as shown on the attached Exhibit “A”; and, WHEREAS, in accordance with Neb.Rev.Stat. § 19-4015 to § 19-4038 (Reissue 2018 Cumm. Supp.), such improvements may be made as cited in the Business Improvement District Act; and,
WHEREAS, the City Council, following a public hearing may establish or reject the proposed business improvement district. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Public Hearing; project creation. That a public hearing on the request of the North 24th Street Business Improvement Area Board to establish a business improvement district to be known as the North 24th Street Business Improvement District (BID No. 6879) was held by the City Council of the City of Omaha on May 19, 2020; Section 2. Notice. That notice that the City Council held a public hearing on the request of the North 24th Street Business Improvement Area Board to create a North 24th Street Business Improvement District (BID No. 6879) was made by publication and by mailing a copy of said Ordinance to each owner of taxable property as shown on the latest tax rolls of the County Treasurer within the proposed district; that a public hearing was held by the City Council on May 19, 2020, during the regular City Council meeting, commencing at 2:00 p.m. in the Legislative Chambers of the Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska; Section 3. Public Hearing. That at such public hearing, the City Council heard all protests, received evidence for and against the creation of the proposed Business Improvement District; and the City Council has ruled upon all protest of the creation of such district which were received prior to the close of hearing and hereby finds that the protests were not made by record owners representing over 50% of the assessable units in the proposed district;
Section 4. Boundaries. That the District shall comprise all property located within the North 24th Street Business Improvement District boundaries as follows: Meredith Avenue to the north, 25th Avenue to the west, Cuming Street to the south, and 23rd Street to 20th Street to the east as shown on the attached map, to include all properties having frontage on the streets within such district. Section 5. Creation of North 24th Street Business Improvement District. The North 24th Street Business Improvement District (BID No. 6879) is hereby created. The North 24th Street Business Improvement District may implement those rules and regulations for its operation as permitted by the Nebraska statutes. The work to be performed and specific improvements to be made or maintained for such Business Improvement District may consist of the following:
North 24th Street Business Improvement District Proposed Work Plan First Year Budget: $21,500
A. General Maintenance and Infrastructure Improvements
Provides for general maintenance to improve the appearance of the area, including hiring of staff to address problem.
Examples: Snow removal, weed control, litter removal, graffiti abatement, or other general repairs.
B. Lighting
Provide for improvements for street lighting as well as for holiday lighting.
C. Beautification
Provides for general beautification in public spaces for residents, businesses, and visitors to the district. Examples: landscaping, streetscapes, and historic signage;
D. Promotion
Provides for promotion of the district, its businesses and residential living experience. Examples: Festivals, district banners, and other events.
E. Parking
Provide for acquisition, maintenance, and operation of parking facilities
F. Security
Hiring of security staff to supplement police protection within the boundaries of the BID.
Additional Activities that may be done in subsequent years or that may be done with money that is not generated by a special assessment under Neb.Rev.Stat. § 19-4018:
• Community development, including undertaking ongoing research and maintaining North 24th Street area market information, assisting property owners and brokers to recruit and retain tenants, supporting the growth of existing businesses.
• Consumer marketing to promote North 24th Street as a regional destination, including the creation of a North 24th Street map and directory and North 24th Street area information website.
• Parking coordination activities to improve the ease and affordability of parking for employees, visitors and other user groups.
• Cosmetic capital improvements, including gateways, wayfinding signage, banners, public art, streetscape, design plans, etc.
• The identification and securing of additional funds, including grants, sponsorships and earned income, to leverage and increase the impact of District resources.
• Program management costs, including salary, rent, annual audit, insurance, supplies, and other costs of operations.
• All other functions as permitted by law.
Section 6. Annual budget and limitations. The estimated total annual cost and expense for the work performed within the Business Improvement District is twenty-one thousand and five hundred dollars ($21,500.00) with such annual budget staying at this amount for the first three (3) years of the District and thereafter raising at a rate of 5 percent per year. The Business Improvement District may secure grants or other funding which may be used for other improvements. Section 7. Method of Assessment. The cost and expenses for the work to be performed within such Business Improvement District shall be raised through special assessments based upon the special benefits to the property as fairly and equitably assessed by the City Council. It is recommended that from and after the date of approval of the Ordinance creating the proposed Business Improvement District, the cost and expenses for the work proposed to be performed within such Business Improvement District up to the amount of $21,500 be levied as Special Assessments which amount may grow at a rate of five (5) % annually after the first three (3) years of the District. Such special assessments shall be levied based on linear footage on North 24th Street or for those properties not on North 24th Street, on their front footage of their parcel as shown on the attached map. The annual assessment shall be no more than one dollar ($1.00) per linear foot. All properties which are exempt from the payment of property taxes will not be assessed. All other commercial properties (including multifamily residential) shall be assessed at 100%. No other property shall be assessed. No individual or single entity, regardless of how it was organized, shall be responsible to pay more than $1,000 in any given budget year for the Business Improvement District. Section 8. Contributions. Based on the recommendation of the Business Improvement District Board, all owners of property exempt from property taxes used in the district shall be invited to contribute annually to the City of Omaha to support BID activities, promotions and improvements. Any contribution shall be allocated to reduce assessment rates in the district. Section 9. Commonly owned property. Commonly owned properties that are intersected by a boundary line established in the district shall be considered entirely in the district unless otherwise determined by the City Council when sitting as the Board of Equalization. Section 10. Termination. The period of existence of the District shall be until December 31, 2023 with each assessment year being the calendar year. The District shall terminate on December 31, 2023, unless the City Council affirmatively takes legislative action to continue the District in existence. Upon dissolution of the District for any reason and upon satisfaction of any outstanding invoices, any sums remaining in any account maintained by the District shall be returned to the City of Omaha.
Section 11. Special assessments. Special assessments provided herein shall be a lien on the property assessed superior and prior to all of the liens except general taxes and other special assessments which shall be of equal priority. Liens for special assessments may be foreclosed and are subject to interest at the statutory rate when payment of the assessment is delinquent provided by law. No special assessment made hereunder shall be void for any irregularity, defect, error, or informality in procedure, and levy or equalization thereof. Section 12. That this Ordinance shall be in full force and take effect fifteen days from and after its passage.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of the Omaha Airport Authority – Eppley Airfield for an historical construction permit for the municipal airport facility at 3501 Abbott Drive in Omaha, NE. The potential emissions, in tons, for this project are: TSP 0.12, PM10 0.12, PM2.5 0.12, SOx 0.00, NOx 3.96, VOC 0.27, CO 2.17, and CO2 equivalent 308.81.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from June 10, 2020 to July 10, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
