Notice is hereby given that the City Council of the City of Omaha met on February 11, 2020 and passed and approved the following ordinance:
ORDINANCE NO. 42145
AN ORDINANCE to provide that the City Council of the City of Omaha be authorized to issue and sell, from time to time, but no later than December 31, 2028 without further vote of the electorate, General Obligation Bonds of the City of Omaha in an amount not to exceed Two Hundred Million and No/100 Dollars ($200,000,000) for the purpose of providing funds for the payment of the cost of constructing, reconstructing, widening, improving, extending and equipping streets, boulevards, roads, and bridges, portions of and connections to expressway, freeway, and Interstate Highway interchanges, or combinations thereof, including necessary plans and specifications, and acquiring land and rights-of-way and easements as may be required but excluding the cost of the City construction equipment and payment of salaries to City employees; to provide for the submission of this proposal to the qualified electors of the City of Omaha for their approval or rejection at the Special City Election to be held on May 12, 2020; to provide for submission of an increase in the property tax level rate of up to $0.035 per $100 of assessed value to the qualified electors of the City of Omaha for their approval or rejection at the Special City Election to be held on May 12, 2020; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That there be, and hereby is, called a Special City Election to be held in the City of Omaha, Douglas County, Nebraska, on May 12, 2020 for the purpose of submitting to the qualified electors at said Special City Election, for their approval or rejection proposals to authorize the City Council of the City of Omaha, without further vote of the electorate, to issue and sell General Obligation Bonds of the City of Omaha in an amount not to exceed Two Hundred Million and No/100 Dollars ($200,000,000) from time to time, but not later than December 31 , 2028, for the purpose of providing funds for the payment of the cost of constructing, reconstructing, widening, improving, extending and equipping streets, boulevards, roads, and bridges, portions of and connections to expressway, freeway, and Interstate Highway interchanges, or combinations thereof, including necessary plans and specifications, and acquiring land and rights-of-way and easements as may be required but excluding the cost of the City construction equipment and payment of salaries to City employees. Such bonds shall be payable from taxes upon all taxable property in said City, subject to taxation by said City, in amount required to be levied by Section 5.07 of the Home Rule Charter of the City of Omaha, 1956, as amended, for the payment of the indebtedness of said City. No other election shall be required to authorize the issuance of such bonds. Bonds issued pursuant to this authority shall be required to authorize the issuance of such bonds. Bonds issued pursuant to this authority shall mature in such amounts and at such times as the City Council shall determine but not more than twenty (20) years from the date thereof. The approximate cost to the taxpayers of the City that will be incurred if this proposal is approved and the City Council authorizes, issues and delivers all the bonds for the purpose herein provided is Two Hundred Million and No/100 Dollars ($200,000,000) plus interest to be payable on such bonds and the approval of this Bond issue will result in an increase in the Property Tax Levy Rate of the City of Omaha in the amount of up to $0.035 per $100 of assessed value. Section 2. That said propositions shall be submitted to the qualified electors of the City of Omaha in substantially the following form:

Section 3. Under said question and proposition on the ballot shall be printed the word “Yes” and the word “No”. All ballots of qualified electors cast at the aforesaid election with an “X” or other clear or intelligible mark placed before the word “Yes” shall be understood to be, and shall be counted, in favor of the proposition set forth in said question, and all ballots of qualified electors cast at the aforesaid election with an “X” or other clear or intelligible mark placed before the word “No” shall be understood to be, and shall be counted, against the proposition set forth in said question. Section 4. That said ballots shall be white in color and printed in black ink or other color designated in conformance with Section 32-806 of the Revised Statutes of Nebraska, 1943, as amended. Section 5. The officer having charge of General and Special Elections of the City of Omaha shall conduct the election on the question herein provided in all respects the same as other City elections and in the manner provided by law. Section 6. The City Clerk is hereby directed to transmit a certified copy of this Ordinance to the Election Commissioner of Douglas County, Nebraska, and to give public notice to the electors, as provided by law. Section 7. This Ordinance is declared to be administrative and not legislative in character and, therefore, under the provisions of Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended, and Rule 7 of the Rules adopted by the City Council of the City of Omaha, it shall become effective from and after its adoption.

SPECIAL ORDINANCE NO. 10272
AN ORDINANCE levying a special tax assessment for the removal and/or trimming of trees, bushes, shrubs, hedges and any other vegetation in accordance with Sections 37-1 through 37-95 of the Omaha Municipal Code on certain lots in the City of Omaha. WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereafter referred to, have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of removal and/or trimming of trees, bushes, shrubs, hedges and any other vegetation thereon, by the City of Omaha. THEREFORE, for the purpose of paying the incurred cost of tree, bush, shrub, hedge and any other vegetation removal/ trimming work BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE levying a special tax assessment for cutting and clearing weeds, grass and worthless vegetation in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha. WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereafter referred to, have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of cutting and clearing weeds, grass and worthless vegetation thereon, by the City of Omaha. THEREFORE, for the purpose of paying the incurred cost of weed, grass and worthless vegetation cutting work. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. ORDINANCE NO. 42120
AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Benson Apartment Fund I, LLC, a Nebraska limited liability company, to implement the Benson Apartments Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 6152 Military Avenue, which proposes for the new construction of a five-story residential apartment building on a vacant site of about 0.69 acres; the agreement authorizes the use of up to $2,067,135.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, with the applicant contributing $10,000.00 of the TIF loan proceeds toward the development of a Benson Business District sign, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Benson Apartment Fund I, LLC, a Nebraska limited liability company, to authorize the use of up to $2,067,135.00, plus accrued interest, to offset TIF eligible costs such as acquisition, site work, construction of engineered foundations, architectural and engineering costs, utility line undergrounding and relocations, technical studies, and public improvements as required, for a project with total estimated costs of $14,357,626.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing ce1tain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northeast of 7th and Cedar Streets from GC-General Commercial District to R7-Medium Density Multiple-Family Residential District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Street Improvement District No. 2019-06 is hereby created in the City of Omaha for the improvement of: Walnut Street, from South 761h Avenue to South 781h Street. This improvement, as petitioned by the residents, includes grading, curbing, storm sewerage and paving, and is to be completed in portland cement concrete. Section 2. AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the West Papio Storm Sewer Repairs - 132nd to Harry Andersen, project identified as OPW 53429; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of the West Papio Storm Sewer Repairs - 132nd to Harry Andersen, project identified as OPW 53429; Said property and lands necessary for such purposes are described as follows: See the attached Exhibit “A” plat drawing of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. AN ORDINANCE to accept the bid of Miller & Sons Golf Cars in the total amount of $142,416.00 for the lease, through PNC Equipment Finance, of seventy-two (72) gas-powered golf cars for the Golf Division of the Parks, Recreation and Public Property Department; for four (4) years with the lease commencing in January 2020, through January 2023, with the option to extend to an additional one (1) to two (2) years, with an option at the end of the lease to purchase cars at fair market value, to authorize annual payments as specified therein in the amount of $35,604.00 per year, for a total amount of $142,416.00. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE authorizing and approving a Lease Purchase Agreement (the “Agreement”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”) a copy of which Agreement is attached as Exhibit A and incorporated herein by this reference, to provide funds to refund on a current refunding basis all or a portion of the Corporation’s Lease Revenue Bonds (Omaha Baseball Stadium Project), Series 2010 (the “Refunded Bonds”); authorizing and approving an Amended and Restated Site Lease Agreement (the “Site Lease”) between the Corporation and the City for the leasing of the project site by the City to the Corporation, copies of which Site Lease are attached hereto as Exhibit B and incorporated herein by this reference; approving an Indenture of Trust (the “Indenture”) between the Corporation and First National Bank of Omaha, as Trustee and Paying Agent, a copy of which Indenture is attached hereto as Exhibit C and incorporated herein by this reference; approving the terms and conditions of the Corporation’s approximately $25,000,000 aggregate principal amount Lease Revenue Refunding Bonds (the “Bonds”), to be issued in one series as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City’s Finance Director to determine the final price, interest rates, principal amount and redemption provisions for the Bonds; authorizing and directing the Corporation to defease (if applicable) and redeem the Refunded Bonds; and satisfying applicable federal income tax law requirements and approving the effective date hereof.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of the Ready Mixed Concrete for a renewal to their air emission operating permit for the concrete batch plant at 1230 Ohio Street, Omaha. The potential emissions, in tons, for this project will be: TSP 20.3, PM10 13.9 and PM2.5 13.9.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from February 19, 2020 to March 19, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
