PUBLIC HEARING NOTICES
NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on December 7, 2021, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:
An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing Cole Creek CSO 202 Phase II 70th Avenue and Spencer Street Sewer Separation Project, identified as OPW 53869; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements, providing that if said parcel cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.
An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the Signal Infrastructure Phase C2 Project, identified as OPW 53807; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.
An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the 2022 Various Signal Project, identified as OPW 54160; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.
An ordinance vacating the southern 100’ of South 89th Street, abutting West Pacific Hills Rep 3 Lot 2 on the west and lands Sec-Twn-Rge 27-15-12 vac 89 St adj & -ex 5 x 62 ft tract & irreg NE 41.49 x 126.32 ft for widening- 25 ac adj on W Longview Add NE 1/4 27-15-12 & vac alley & E 158 ft Lots 4 & 5 & E 152 ft Lot 6 & E 152 ft N 25 ft Lt 7 & E 162 S 75 ft Lot 7 & E 162 ft N 50 ft Lt 8 & E 152 S 50 ft Lot 8 & E 152 ft Lots 9 thru 11 Blk 1 on the east; providing for the reversion or transfer of the same.
An ordinance vacating the alley east of North 18th Street, between Corby Street and Ohio Street abutting Lots 1, 2, 4, 5, 6, 7, 8, 9, of Pruynes Subdivision of Lot 25 of Millard & Caldwell’s Addition, and abutting Lot 24 ½, Millard & Caldwell’s Addition, Douglas County, Nebraska; providing for the reversion or transfer of the same.
An ordinance vacating Madison Street from the easterly Right of Way line of 25th Street extended approximately 403 feet easterly to the east Lot line of Lot 6, Block 12, Albright’s Annex and to the east Lot line of Lot 21, Block 13, Albright’s Annex, abutted by Lots 6, 7, 8, 9, 10, 11, 12,13, 27, Block 12, Albright’s Annex, an Addition to the City of Omaha, Douglas County, Nebraska, and abutted by Lots 14, 15, 16, 17, 18, 19, 20, 21, and the east 18 feet of Lot 28, Block 13, Albright’s Annex, an Addition to the City of Omaha, Douglas County, Nebraska; providing for the reversion or transfer of the same.
An ordinance to accept the bid from Alexander Lawn & Landscape, Inc. for grounds maintenance at the Street Maintenance Facilities in the amount of $23,026.00 for a period of one year, with sole option by the City to extend the price agreement for up to three additional one-year periods; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order.
An ordinance to accept the bids from Alexander Lawn and Landscape, Inc., All Seasons Turf & Tree, LLC., and Choppers Lawn Service for grounds maintenance mowing of City rights-of-way based on bids received on October 6, 2021. Contractors were able to submit bids for individual areas and each area was considered separately. Street Maintenance is recommending award be made as detailed in the attached memo dated October 29, 2021. This price agreement will be in effect for a period of two years with the option of one (1) year with three (3), one (1) year extensions for a total of four (4) years if the City extends these contracts; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended.
An ordinance to accept the bid from Safety Guard, Inc. for guardrail and fence repair, to be paid according to actual usage, not to exceed $50,000.00, for a period of one (1) year, with sole option by the City to extend the price agreement for up to four (4) additional one-year periods; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order.
An ordinance to approve and execute a Cost Participation Agreement involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended between the Omaha-Douglas Public Building Commission, a body politic, and the City of Omaha, Nebraska, a Nebraska Municipal Corporation in an amount up to $800,000.00 for improvements in the right-of-way and on the property adjacent to the right-of-way constructed by the Commission as part of the Douglas County Justice Center Project; to authorize payment from 2018 Transportation Bond Fund 13185, Transportation Bonds Organization 117117 in the amount up to $634,000.00 and the Downtown TIF Fund 12117, Organization 124057 in the amount up to $166,000.00.
An ordinance approving an Interlocal Agreement between the City of Omaha and the Omaha-Council Bluffs Metropolitan Area Planning Agency (MAPA) involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for the terms and conditions under which Omaha and MAPA will participate in a project to obtain regional digital map products; to authorize the Finance Department to pay cost share to MAPA not to exceed $117,975.00 according to the disbursement terms contained within the Agreement.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Blackstone Real Estate, LLC, to implement the Blackstone Square Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3763 Farnam Street, which proposes the new construction of an 11,000 square foot two story commercial building with four tenant bays; the agreement authorizes the use of up to $515,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1701, LLC, to implement the Habitat for Humanity 9 NAAF Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located within the general boundaries of 24th to 29th Streets and Wirt to Pinkney Streets, which proposes the new construction of 26 single family residential homes; the agreement authorizes the use of up to $1,000,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance to approve a Master Health Services Agreement (MHSA) between the City of Omaha and Blue Cross Blue Shield of Nebraska (BCBSNE) for the provision of health claim administrative services for the City’s self-insured health program in accordance with the lowest and best proposal submitted, for a period of three years commencing on January 1, 2022 and ending on December 31, 2024, with an option for two one-year extensions; to authorize the execution of such Agreement; to authorize payments in accordance therewith from General Fund No. 11111, Healthcare Expense Account No. 41331, Organization Nos. 118014, 118015, and 118018.
An ordinance to approve an Addendum which makes the City of Omaha a participating group in an Amended and Restated Prescription Benefit Services Agreement between CaremarkPCS Health, LLC, and Employers Health Purchasing Corporation, to provide pharmacy benefit management services for the City’s self-insured health program in accordance with the lowest and best proposal submitted, for a period of three years commencing on January 1, 2022 and ending on December 31, 2024, with an option for two one-year extensions; to authorize the execution of such Agreement; to authorize payments in accordance therewith from General Fund No. 11111, Healthcare Expense Account No. 41331, Organization Nos. 118014, 118015, and 118018.
An ordinance to approve the First Amendment to the Douglas-Sarpy Mutual Aid Interlocal Cooperation Agreement to add the Village of Boys Town to the Agreement which currently includes the law enforcement agencies in Sarpy County and Douglas County including the City of Bellevue Police Department, the City of La Vista Police Department, the City of Omaha Police Department, the City of Papillion Police Department, the City of Ralston Police Department, the City of Valley Police Department, the City of Waterloo Police Department, the City of Bennington Police Department, the Sarpy County Sheriff’s Office, and the Douglas County Sheriff’s Office; to provide and allow for the exercise of extraterritorial law enforcement authority in certain specified situations.
An ordinance to authorize the disbursement from the FY 2021 State Homeland Security Grant (SHSG) Award #EMW-2021-SS-00084-S01, accepted by Resolution 2021-1163 on November 2, 2021, and budgeted in the amount of $456,726.00 from the Nebraska Emergency Management Agency (NEMA), during the award period of September 1, 2021 through August 31, 2024, to provide law enforcement and emergency response communities in Douglas, Sarpy, and Washington Counties with enhanced capabilities for detecting, deterring, disrupting, and preventing acts of terrorism; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.
An ordinance authorizing and providing for an issue of special tax revenue redevelopment and refunding bonds and an issue of taxable special tax revenue redevelopment refunding bonds in the aggregate principal amount of not to exceed $11,000,000.00 to be termed for identification purposes “Special Tax Revenue Redevelopment and Refunding Bonds, Series 2022A,” and “Special Tax Revenue Redevelopment Refunding Bonds, Taxable Series 2022B,” respectively; prescribing the form and detail of said bonds; ratifying and confirming the creation of a community development agency; providing for the annual certification of the amount of community redevelopment tax to be levied for each succeeding fiscal year; pledging the special tax revenues to the payment of the principal of and interest on said bonds as the same fall due and to carry out all other covenants of this Ordinance; limiting the payment of said bonds solely to said special tax revenues; authorizing the sale of said bonds by negotiation; designating for defeasance and redemption certain bonded indebtedness of the City of Omaha; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said bonds; appointing a Paying Agent and Registrar; approving the selection of an underwriter and an escrow verification agent; directing that said bonds shall initially be issued and registered in book entry form; providing for continuing disclosure; delegating authority to the Finance Director to determine the final prices, interest rates, principal amounts and redemption provisions for said bonds.
An ordinance Supplemental to Ordinance No. 35840, as supplemented by Ordinance No. 38029 and as supplemented by Ordinance 39227, authorizing and providing for an issue of special obligation refunding bonds in the aggregate principal amount of not to exceed $30,000,000.00 to be termed for identification purposes “Special Obligation Refunding Bonds (Riverfront Redevelopment Project), Series 2022C” of the City of Omaha, Nebraska (the “City”) for the purpose of paying all or part of the cost of refunding certain bonded indebtedness of the City; prescribing the form and detail of said refunding bonds; ratifying and confirming the creation of a community development agency; providing for the annual certification of the amount of City funds encumbered for use in the same calendar year in connection with a sewer separation project; tax allocation revenues, sewer revenues, land revenues and sales tax revenues to the payment of the principal of, premium, if any, and interest on said refunding bonds as the same fall due and to carry out all other covenants of this Supplemental Ordinance; limiting the obligation to pay said refunding bonds solely to said pledged revenues; authorizing the sale of said refunding bonds by negotiation; designating for defeasance and redemption certain bonded indebtedness of the City; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said refunding bonds; appointing an Escrow Agent and a Paying Agent and Registrar; approving the selection of an underwriter and an escrow verification agent; directing that said refunding bonds shall initially be issued and registered in book entry form; providing for continuing disclosure; delegating authority to the Finance Director to determine the final prices, interest rates, principal amounts and redemption provisions for said refunding bonds.

The City Council of the City of Omaha will have a Pre-Council Meeting at 10:30 A.M. in the Roskens Room, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business; and a regular Council Meeting at 2:00 P.M. on Tuesday, December 7, 2021, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska. This meeting will have video conference capability. Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened. The video conference details and an agenda for the meeting is posted on the City of Omaha website at www.cityofomaha.org.
