Notice is hereby given that the City Council of the City of Omaha met on December 13, 2022 and passed and approved the following ordinances:
ORDINANCE NO. 43211
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northeast of 42nd and L Streets from GC - General Commercial District to CC - Community Commercial District.
Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1, Warren Place, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from GC - General Commercial District to CC - Community Commercial District.

ORDINANCE NO. 43212
AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located northeast of 42nd and L Streets; and to provide for an effective date.
Summary: In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Warren Place, a subdivision in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 4647, LLC, a Nebraska limited liability company, to implement the 48th & Dodge Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located southeast of 48th and Dodge Streets, which proposes the new construction of a five story apartment building and to rehabilitate the historic building at 4629 Dodge; the agreement authorizes the use of up to $10,750,000.00, plus capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

An Ordinance authorizing and approving one or more Lease Purchase Agreements (collectively, the “Agreements”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”), to provide funds: (1) for the lease-purchase of and the financing of the costs of acquiring and equipping streetcars for use in the City’s modern streetcar system, and (2) for the lease-purchase of and the financing of the costs of acquiring, constructing and equipping a building for the modern streetcar operations; authorizing and approving one or more Site Lease Agreements (collectively, the “Site Leases”) between the Corporation and the City for the leasing of the project site by the City to the Corporation; authorizing and approving one or more Bills of Sale (collectively, the “Bills of Sale”) by the City to the Corporation for the sale of certain equipment to the Corporation; approving one or more Indentures of Trust (collectively, the “Indentures”) between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds (the “Bonds”), as set forth in the Indentures and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final price, interest rates, principal amount, redemption provisions, and other terms and conditions thereof; and satisfying applicable federal income tax law requirements and approving the effective date hereof.

An Ordinance authorizing and providing for the issuance of Redevelopment Bonds (Omaha Streetcar Project) in one or more series in an aggregate principal amount not to exceed $360,000,000, for the purpose of (1) paying all or a portion of the costs of constructing, improving, installing, equipping and completing a modem streetcar system within the City of Omaha’s Urban Core Redevelopment Plan Area in accordance with the City’s Urban Core Housing and Mobility Redevelopment Plan, and (2) paying the costs of issuance of such bonds; prescribing the form and certain details of such bonds; pledging tax increment revenues to the payment of the principal of and interest on such bonds as the same become due; limiting payment of such bonds to the revenues specified herein; delegating, authorizing and directing the finance director to exercise his or her independent discretion and judgment in determining and finalizing certain terms and provisions of such bonds not specified herein; taking other actions and making other covenants and agreements in connection with the foregoing; and related matters.
