Bellevue City Council Proceedings

A meeting of the Mayor & Council of the City of Bellevue was called to order by Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m. on October 6, 2020. Present were Council Members Paul Cook, Pat Shannon, Don Preister, Thomas Burns, & Kathy Welch. Absent: Bob Stinson.
Notice of this meeting was given in advance thereof by publication in the Gretna Guide “Omaha Daily Record” & posted in two public places, the designated method for giving notice, & was given to the Mayor & all members of the City Council. All proceedings hereafter were taken while the convened meeting was open to the public. Mayor Hike announced that a copy of the Open Meetings Act is posted in the back of the City Council Chambers.
Mayor Hike led the Pledge of Allegiance. Pastor Walter Hooker, Bellevue Christian Center, 1400 Harvell Drive, Bellevue, gave the invocation.
The following items of business were considered:
1. Council approved the Agenda as amended.
2. After Councilman Shannon removed Items 16a, 16c, 16d, 16e, 16f, & 16i from the consent agenda, the consent agenda was approved which included: Approval of the September 15, 2020 City Council Minutes; Claims for September 30, 2020 Fiscal Year End & Claims for October 6, 2020; & Request approval of the applications for waiver of hunting applications.
3. Following public hearings, Council recommended approval of replacing application of Class C Liquor License No. 123928 for a Corp. Name Change to Unami Food Cuisine LLC., 1504 Galvin Road S., Bellevue & for Feng Zheng as Manager & to recommend approval of a Special Designated Liquor License for Paul R. Klabunde dba “Century Lounge” to sell beer, wine, & distilled spirits at a Halloween Party, to be held at Century Lounge, 2109 Franklin Street, Bellevue, on October 31, 2020 from 12:00 p.m. to 12:00 a.m. & November 1, 2020 from 12:01 a.m. to 2:00 a.m.
4. Following the third & final reading, Council approved Ord. No. 4006: An ordinance to allow for statutory changes & revisions to be incorporated into several sections of the City Code which have been affected by or generated by legislative changes & to add or change legislative citations to provide for an effective date.
5. The following ordinances were read for the second time & opened for public hearing: Ord. No. 4007- An ordinance to amend Section 6-117 of the Bellevue Municipal Code pertaining to the Regulation of Bees Violations- Revocations; Ord. No. 4008 - An ordinance to amend Sections 9-17 & 9-18 of the Bellevue Municipal Code pertaining to Elections; Ord. No. 4009 - An ordinance to amend Sections 15-194 of the Bellevue Municipal Code pertaining to Unlawful Acts - Sale or Rental; & Ord. No. 4010 - An ordinance to repeal Section 20-5 of the Bellevue Municipal Code Pertaining to Swearing, Cursing, Etc. No one spoke in favor or opposition to these ordinances. Third & final reading on these ordinances will be held Oct. 20th.
6. Council voted to waive the rule requiring three readings,hold a public hearing, & vote at this meeting. After the public hearing Council unanimously approved Ord. No. 4011: Request to rezone Lot 1 Riverview Heights Replat IV, being a replat of Lot 1 Riverview Heights Replat III, & Lot 6 Riverview Heights Replat, from RE & RS-120 to RE for the purpose of an existing single-family residence; & the small subdivision plat Lot 1 Riverview Heights Replat IV.
7. Ord. No. 4012 - Request to rezone Lots 1 & 2, Southroads Technology Park, from BG-PCO to BGH, for the purpose of further commercial development, was read for the second time & opened for public hearing. The third & final reading will be held on Oct. 20th.
8. The following ordinances were read for the first time: Ord. No. 4013 - Request to rezone Lots 122 through 124, Belle Lago South, being a platting of a tract of l& located in part of the Southwest ¼ of the Northwest ¼ of Section 8, T13N, R13E of the 6th P.M., Sarpy County, Nebraska from AG to RG-50-PS, for the purpose of single-family residential development. Applicant: HC Belle Lago, LLC. General Location: Looking Glass Dr. & South 45th St., Ord. No. 4014 - Request to rezone Lots 2 & 2A, Kennedy Town Center Replat Seven, being a replat of Lot 2, Kennedy Town Center Replat Four, from RG-20- PS to BG-PCO & RG-20-PS for the purpose of a commercial & multi-family residential development. Applicant: Carlson Consulting Engineers, Inc. General Location: 25th St. & West Chandler Rd., Ord. No. 4015 - Request to rezone Lot 1, South Woods Replat 4, being a replat of Lots 9 through 11, South Woods, from RG-8 & RG-8-PS to RG-8-PS for the purpose of multi-family residential development. Applicant: APOGEE Professional Services. General Location: Childs Rd. & Nebraska Dr., & Ord. No. 4016: An ordinance to amend Sections 18-106 to 18-112 of the Bellevue Municipal Code pertaining to reserved spaces for handicapped persons. Second readings & public hearings will be held on Oct. 20th.
9. Council voted to waive the rule requiring three readings, hold a public hearing, & vote at this meeting. After the public hearing Council unanimously approved to approve Ord. No. 4018: Authorizing & providing for issuance of General Obligation Refunding Bonds, Series 2020D, in an amount not to exceed $2,250,000.
10. Council approved Res. No. 2020-41: Authorizing & providing for issuance of Taxable Redevelopment Refunding Bonds, Series 2020, in an amount not to exceed $2,500,000.00, Res. No. 2020-39: Approve & authorize the Mayor to sign the Resolution & the participating Construction Engineering Services Agreement with Alfred Benesch & Company for the 2020 Bellevue Major Street Resurfacing Project, Project No. MAPA-5081(1), Control No. 22775, in an amount not to exceed $182,384.63, Res. No. 2020-40: Approve & authorize the Mayor to sign the Resolution & the Construction Engineering Services Agreement with Alfred Benesch & Company for the 2020 Bellevue Major Street Resurfacing Project, Project No. MAPA-5081(1), Control No. 22775, in an amount not to exceed $4,721.43.
11. Council approved the following items: Recommend approval of Traveler’s renewal proposal for the City’s FY 20-21 Property/Casualty Insurance in an amount not to exceed $593,023, Recommend moving to the Zoll Cloud Based Billing Software, to begin the migration in October 2020 & authorize the Mayor to sign in an amount not to exceed $39,780, Approve & authorize the Mayor to sign the CDBG-CV subrecipient agreement with Eastern Nebraska Community Action Partnership in the amount of $46,952, Approve & authorize the Mayor to sign the CDBG-CV subrecipient agreement with the Housing Foundation for Sarpy County in the amount of $121,150, Approve & authorize the Mayor to sign the CDBG-CV inter-departmental agreement with the City of Bellevue Human Services Department in the amount of $20,000, Approve & authorize the Mayor to sign a four-year service agreement with Stryker for LUCAS devices, in an amount not to exceed $26,254.80 or $6563.70 annually, Approve & accept low bid from Carroll Construction Supply’s for the Wacker RD-12 roller, in an amount not to exceed $14,597.20, Approve & authorize the Mayor to sign the Yearly Maintenance Proposal with Vertiv Corporation for main UPS that protects & provides backup for computer equipment in an amount not to exceed $2,354.28, Approve & authorize Mayor to sign the proposal from Heimes Corp, for the Fort Crook Road emergency CMP culvert replacement, in the amount of $55,957.00 plus a 10% contingency in the amount of $5,595.70, for a total project cost in the amount of $61,552.70.
12. Administrative Reports: The monthly report for September was attached & reviewed by the Council.
13. There being no further business to come before the Council at this time, on motion duly made & seconded, at 6:56 p.m. the meeting adjourned.
