The meeting of the Board of the Village of Boys Town was held at 1:30 p.m. on Tuesday, February 2, 2021 in the Headquarters Building of Father Flanagan’s Boys’ Home in the Village of Boys Town, Nebraska.

Call to Order:

Chair Skartvedt called the meeting to order at 1:33 p.m.

Special Presentation/Proclamation:

 Hazakiah Williams, Mayor, attended via telephone, and Hailey Holm, Vice Mayor, attended in person, to officially proclaim February as Black History Month in the Village of Boys Town.

Treasurer’s Report, Report on Claims to Be Paid, Report on Prepaid Claims:

The Village Treasurer reviewed the December 2020 Financial Report with the Trustees. The balance of all funds as of December 31 collectively $665,007.13. Detailed reports of claims to be paid and prepaid claims are attached herewith and become part of the minutes. Chair Skartvedt solicited a motion for consideration of and to approve action on accounts of the Village Treasurer, to approve the Village General Fund allowance and payment of claims and to approve the retroactive approval of prepaid claims.

Report of Village Police Chief Bill Clark:

Chief Clark reported on his annual evaluations of his police officers’ performance in 2020. In 2020 there were 13 evaluations comprising of 3 sergeants and 10 patrol officers. Chief Clark conducted follow-up performance review meetings with each officer.

•  The sergeant evaluations were based on the areas of communication, supervision, administration, leadership, professionalism, interpersonal skills, and overall ratings, etc.

•  The patrol officer evaluations were based on the areas of physical fitness, safety, written communication, oral communication, personal appearance, maintenance and use of equipment, criminal investigations, punctuality, preparedness of duty, etc.

•  The rating categories were: Exceptional, Above Satisfactory, Satisfactory, Below Satisfactory and Fail.

•  Of the 13 evaluations, 2 officers were rated Exceptional, 2 officers were rated Above Satisfactory, and the remaining officers were rated Satisfactory.

Report of the Village Fire Chief:

Chief Kava reported the Fire Cadet Program is resuming, the second round of COVID vaccinations have been administered, EMT classes are currently being conducted in Kennard and Eagle Nebraska and the Premier Pyrotechnics Program Pay Options for 2021. The Board approved the 12% discount payment option.

Report of the Village Engineer &

Superintendent:

Joe Oetken, on behalf of Brett Wawers, indicated the l- and 6-year plan documents are being prepared. The full plan will be adopted in March. There will be minor reconstruction taking place within the Village to include repairing of potholes in the Spring.

Other Business:

Chief of Police 2021 Goals

The Board discussed its performance expectations of the Chief of Police in 2021.

•  The discussion centered around 3 areas of focus: increased Communication with key community stakeholders, fostering a Culture of community policing with the unique needs of Boys Town youth in mind, and creating additional opportunities for Collaboration with Boys Town youth and employees.

Upon MOTION duly made by Lindley and seconded by Haack, the motion to approve these proposed Goals for the Chief of Police for 2021 have been passed. The Village Clerk conducted roll call.

Revision of Police Standard

Operating Procedures

Village Attorney Washington discussed the Board’s important role in overseeing the Village Police Department and reviewed with the Board proposed revisions to the Police SOPs. The revised SOPs discussed included Chapter 5 Training, 7.3 Unbiased Policing and 7.13 Use of Force. Village Attorney Washington advised that the recommended SOPs incorporate all legal requirements and what is in the best interest of the Boys Town community.

Chair Skartvedt identified and discussed the need to repeal the Ordinances set forth below:

  •  Ordinance 224 Relating to the Operation of Bicycles

  •  Ordinance 326 Relating to Satellite Dishes Prohibited

Upon MOTION duly made by Haack and seconded by Lindley, the motion to approve Ordinance 345 repealing Ordinances 224 Relating to the Operation of Bicycles and Ordinance 326 Relating to Satellite Dishes Prohibited has been passed. The Village Clerk conducted roll call.

RESOLUTION 0321-1

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BOYS TOWN, NEBRASKA TO APPROVE THE ONE-YEAR AND SIX-YEAR PLAN FOR THE VILLAGE OF BOYS TOWN

 

WHEREAS, The State of Nebraska Requires all Villages to create and ratify a plan for all anticipated projects within one-year and six-year timeframes.

WHEREAS, The Village Engineer has created such One-year and Six-year Plan.

WHEREAS, it is in the best interest of the Village of Boys Town to approve the One-year and Six-year Plan for the Village of Boys Town; and

BE IT RESOLVED that the Board of Trustees of the Village of Boys Town, Boys Town, Nebraska, having held a public hearing thereon March 2, 2021, hereby approves the OneYear and Six-year Plan for the Village of Boys Town.

The Chair then put the motion for the adoption of such resolution to a roll call vote. The vote was as follows:

Nebraska Ordinance No. 346

AN ORDINANCE TO ESTABLISH THE

CRITERIA FOR HOLDING APPOINTED

OFFICES AND TO PROVIDE FOR AN

EFFECTIVE DATE.

Be it Ordained by the Chair and Board of Trustees of the Village of Boys Town, Nebraska, as follows:

Section 1. Findings.  The Chair and Board of Trustees of the Village of Boys Town find that the Village of Boys Town is a unique community, with distinctive needs and challenges, and, as such, needs to establish criteria for any individual to be appointed to and serve in certain appointed positions.

Section 2. Definitions.  Except as otherwise indicated, expressly or by the context, the following definitions apply for purposes of this ordinance:

(A)   Village Attorney means the licensed attorney appointed by the Board of Trustees to Represent the Village in all legal matters.

(B)   Village Clerk means the person appointed by the Board of Trustees to service as Village Clerk.

(C)   Chief of Police means the person appointed and hired to service as the leader and Chief of the Boys Town Police Department.

(D)   Fire Chief means the certified or provisionally certified person appointed by the Board of Trustees to serve as the leader and Chief of the Boys Town Fire Department.

(E)   Village Treasurer means that the person responsible for managing the Village financial affairs.

(F)   Primary Place of Employment means the business entity where the individual is employed on a full-time basis (at least 40 hours a week).

(G)   Primary/Principle Residence means the primary location that a person inhabits, on a day to day basis.

Section 3. Criteria.  To be appointed and serve as Village Attorney, Village Clerk, and Village Chief of Police, Village Fire Chief, and/or Village Treasurer, an individual must have his or her Primary/Principle Residence within the Village of Boys Town or his or her Primary Place of Employment must have its principal location within the Village of Boys Town.  Nothing in this section shall alter the fact that all appointed officials serve at the pleasure of the Board of Trustees and this creates no right or entitlement for any individual to serve in these capacities.

Section 4. Severability.  If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid for any reason, such invalidity shall not affect the validity of any remaining portion of this ordinance.  The Chair and Village Board of Trustees of the Village of Boys Town, Nebraska hereby declare that the Village would have enacted and adopted this ordinance and each section, subsection, sentence, clause and phrase hereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.

Section 5.  Effective Date.  This ordinance shall take effect from and after its passage, approval and publication as required by law, but not sooner than fifteen days after its passage.

2021 Focus Areas/Goals for Chief of Police

Communication – Enhance communications with all stakeholders within the Village of Boys Town

•   Attend FFBH Governance Meetings on a quarterly basis to share police department updates, solicit feedback and discuss ways the police department and FFBH can effectively partner to make the Village as safe as possible for residents, employees and visitors 

•   Participate in at least two Family Teacher Town Halls to share police department updates and solicit community feedback on how to increase and expand meaningful interactions between youth and officers

•   Meet monthly with the Boys Town Security Department to strategize and foster a team approach to serving Village residents, youth, and employees

Culture – Foster a supportive culture that helps officers gain a deep understanding and appreciation of the youth who reside in the Village of Boys Town

•   Conduct a listening tour in the family homes in which youth explain when and where they have encountered law enforcement in their daily lives before and during their time at Boys Town, how those interactions proceeded and what they would like to see changed or improved about them

•   After working with FFBH Youth Care leadership to identify the most appropriate courses, ensure each officer in the Boys Town Police Department has completed at least 5 hours of Pre-Service coursework

•   Promote informal and positive interactions with residents and employees by encouraging officers to create rapport and build trusting relationships with community members (i.e. encourage officers to get out of patrol cars from time to time to engage with community members, institute foot beats and/or bike patrols to increase the opportunity for informal interactions, train officers to waive at passing vehicles, etc.)

Collaboration – Further community policing efforts by creating additional opportunities for positive and meaningful interactions with all members of the Village of Boys Town, particularly youth and employees of FFBH 

•   In collaboration with FFBH Youth Care leadership, develop and implement a Police Cadet Program focused on responsible patriotic citizenship, inspiring youth to positively participate in the Village of Boys Town community, and promoting a practical understanding of policing among youth

•   Host one community event for youth (Ice Cream Social, Basketball Tournament, Pizza Party, etc.) and one community event for employees of FFBH (Coffee with a Cop, National Night Out, Home Safety/Emergency Preparedness Lunch and Learn, etc.)

•   Demonstrate a clear partnership with the Boys Town Security Department by evidencing to residents and employees a unified approach to maintaining safety and order within the Village of Boys Town.
