Call to Order - Roll Call – Open Meetings Act

Mayor Zac Johns called the regular monthly meeting to order at 6:00 p.m. on Tuesday, October 15, 2024.  In attendance were City Council Members Clint Adams and Kaye Bridgeford.  Council Members Josh Dowding and Shane Pekny were absent. Pursuant to Neb. Rev. Stat. 17-105 Mayor Johns constitutes a Member of the Council for the purposes of establishing a quorum.  City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.

Motion by Bridgeford, second by Adams to approve the Consent Agenda.  All voted in favor and the motion carried.

 

Consideration of Amendments to Zoning Regulations 7.01.01(E) and 7.02 regarding Off-Street Parking Requirements for Apartments in the C-3 Downtown Commercial Zoning District

City Engineer Julie Ogden spoke regarding off street parking regulations for apartments in the Downtown Commercial Zoning District.

 

Johns opened a public hearing and comments were made in regards to the cost of parking availability, walkable communities and making downtown opportunities “welcoming” by lowering the barrier of difficulty.

 

Motion by Johns, second by Bridgeford to approve the Zoning Regulation amendments  of deleting Subsection 7.0101(E), and adding to Section 7.02 “Apartment/Multi-Family Residential Facilities in the C-3 District – One space per unit for residents”, and not changing the parking requirements for downtown residential (apartments/condominiums) so that on-street parking can be counted for required on-site (off-street) parking.  All voted in favor and the motion carried.

 

Street Closure and Event Application

Sons of the American Legion Trunk and Treat Event, Saturday October 26 from 5-9 p.m. Closing South Second Street between Stark and Allen Streets.

 

Motion by Johns, second by Adams to approve the street closure.  All voted in favor and the motion carried.

 

Snow Removal Services Agreement

Motion by Johns, second by Bridgeford to award Drew Harsin the Snow Removal Service Agreement.  All voted in favor and the motion carried.

 

Resolution No. 2024-10 Directing the Sale of Public Works Truck – 2005 Chevy Silverado

Motion by Bridgeford, second by Adams to approve and direct the sale and the manner and terms of the sale of a surplus city vehicle.  All voted in favor and the motion carried.

 

Ordinance No. 533 Approving 2025 Sewer Rate Increases

City Engineer Julie Ogden reviewed the updated sewer revenues and expenses.

 

Motion by Adams, second by Bridgeford to introduce and approve the first reading of Ordinance No. 533 AN ORDINANCE AMENDING SECTION 6-202 OF THE CITY OF BENNINGTON’S MUNICIPAL CODE AS ENACTED IN CITY OF BENNINGTON ORDINANCE NO. 512 REGARDING SANITARY SEWER RATES AND COLLECTIONS.  All voted against and the motion did not carry.

 

Ordinance No. 534 Salary Update

City Administrator was added to the salary ordinance.

 

Motion by Adams, second by Bridgeford to introduce and waive three readings of Ordinance No. 534 AN ORDINANCE OF THE CITY OF BENNINGTON, DOUGLAS COUNTY, NEBRASKA RELATING TO AND AMENDING THE SALARIES AND INSURANCE BENEFITS OF THE EMPLOYEES OF THE CITY OF BENNINGTON, NEBRASKA.  All voted in favor and the motion carried.

 

Motion by Bridgeford, second by Adams to approve and adopt Ordinance No. 534.  All voted in favor and the motion carried.

 

Neumeyer Farm Park

Grass is growing on the soccer field.  Punch list items include landscaping and sprinklers.

 

Motion by Bridgeford, second by Adams to approve Blade Master’s Pay Application #7 totaling $32,705.52.  All voted in favor and the motion carried.

 

Phase II:  US HUD Community Project Funding Grant Update

 

Motion by Johns, second by Bridgeford to approve an Agreement for Wetland Delineation and Environmental Review with JEO Consulting for the Soccer Project totaling $6,700.  All voted in favor and the motion carried.

 

Bennington Public School District has tabled an Agreement for Design of the Tennis-Pickleball Court Project.

 

2024 Street Patching Project

One patch remains on 158th Street.

 

Amended Use Agreements and Addendums

B.  Bennington Soccer Club

 

Motion by Adams, second by Bridgeford to approve both amendments.  All voted in favor and the motion carried.

 

Ordinance No. 535 Amending the City of Bennington’s Zoning Regulations 7.01.01(E) and 7.02 Regarding Off-Street Parking for Apartments

Motion by Johns, second by Bridgeford to introduce and waive three readings of Ordinance No. 535 AN ORDINANCE AMENDING THE CITY OF BENNINGTON’S ZONING REGULATIONS SECTIONS 7.01.01(E) AND 7.02 REGARDING OFF-STREET PARKING REQUIREMENTS FOR APARTMENTS.  All voted in favor and the motion carried.

 

Motion by Bridgeford, second by Adams to approve and adopt Ordinance No. 535.  All voted in favor and the motion carried.

Mayor Zac Johns called the special monthly meeting to order at 6:00 p.m. on Monday, October 21, 2024.  In attendance were City Council Members Clint Adams and Kaye Bridgeford and Shane Pekny.  Council Member Josh Dowding was absent.  City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.

 

Approval of the Acquisition of a K9 Unit (male German Shorthaired Pointer dog named Ducky) via a Free/No Cost Donation/Grant by the Fur Missiles K9 Foundation and Associated Free/No Cost Donation/ Grant of City Officer/Handler and Dog Training

Police Chief Drew Hilscher asked that the City accept the acquisition and donation of a K9 trained to work with narcotics and tracking.

 

Motion by Bridgeford, second by Adams to approve the acquisition.  All voted in favor and the motion carried.
