Notice is hereby given that the City Council of the City of Omaha met on September 24, 2019 and passed and approved the ordinances entitled:
ORDINANCE NO. 41983
AN ORDINANCE to approve a PUR-Planned Unit Redevelopment Overlay District in a R7-Medium-Density Multiple-Family Residential District located at 1301 South 12th Street, to approve the Development Plan, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County, Nebraska: Lots 1-6 and Outlot A, South Hill Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska. Section 2. The proposed Development Plan has been reviewed and evaluated pursuant to, and meets each of, the site plan criteria set forth in Section 55-885 of the Omaha Municipal Code. Section 3. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 180th Street and West Maple Road from AG-Agricultural District and R4-Single Family Residential District (High Density) to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Outlots A-E, Antler View East, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District and R4-Single Family Residential District (High Density) to DR-Development Reserve District. ORDINANCE NO. 41987
AN ORDINANCE to approve a Mixed Use District Development Agreement for property located southwest of 180th Street and West Maple Road between the City of Omaha and 180 Maple LLC, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located southwest of 180th Street and West Maple Road is developed in accordance with the provisions of the Mixed Use District Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Mixed Use District Development Agreement is hereby approved. Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 41966
AN ORDINANCE to approve a five (5)-year agreement between Omaha Public Library and the City of Omaha, to forgive patron fines in exchange of non-expired canned goods and other non-perishable foods; and, to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, a five (5)-year agreement between Omaha Public Library and the City of Omaha, to forgive patron fines in exchange of non-expired canned goods and other non-perishable foods, covering the period January 1, 2019 through December 31, 2023, is hereby approved. Section 2. That, Library staff will develop all procedures needed to implement the agreement. Section 3. That, the agreement allows for either party to terminate the agreement with at least 180 days written notice. Section 4. That, this Ordinance, not being of legislative character, shall be in full force and take effect immediately upon its date of passage.

AN ORDINANCE to approve the acceptance of the City of Omaha and Douglas County joint application to the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA), FY 2019 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Application #2019-H4362-NE-DJ, in the amount of three hundred seventy-four thousand seven hundred thirty-seven dollars ($374,737) for law enforcement programs, prevention and education programs, prosecution and court programs, corrections and community corrections programs, and planning, evaluation and technology improvement programs during the period of October 1, 2018 to September 30, 2022; to provide the Council an opportunity for review and public comment for such application; and upon award of such grant to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, the City of Omaha and Douglas County filed a joint application for the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, FY 2019 Edward Byrne Memorial Justice Assistance Grant Program, Application #2019-H4362-NE-DJ in the amount of three hundred seventy-four thousand seven hundred thirty-seven dollars ($374,737) for law enforcement programs, prevention and education programs, prosecution and court programs, corrections and community corrections programs, and planning, evaluation and technology improvement programs during the period of October 1, 2018 to September 30, 2022. Section 2. That the City of Omaha will retain $9,038 to provide fiscal administration of the grant and the remaining balance of $365,699 will be divided between the Omaha Police Department ($182,831) and Douglas County ($182,868). That the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, FY 2019 Edward Byrne Memorial Justice Assistance Grant Program requires the grant application to be available for review by the governing body of the unit of local government and requires an opportunity for public comment. Section 4. That, there is no match required with this grant. Section 5. That, in conformity with Section 5.17 of the Home Rule Charter, expenditures as outlined in the attached budget, from such grant funds and involving appropriations of more than one year, are hereby authorized and the Finance Director is authorized to make payment in accordance therewith. Section 6. That this ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

AN ORDINANCE authorizing the issuance of a purchase order to Todco Barricade for barricading services to be provided at various locations throughout the city; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from specific accounts; and to provide an effective date hereof. WHEREAS, bids were received on July 17, 2019 by Metropolitan Utilities District for joint barricading services with the City of Omaha for a three year period, at various locations throughout the city; and, WHEREAS, Todco Barricade submitted a bid total of $3,484,950.00 with the City of Omaha’s portion of this cost estimated to be $1,742,475.00, being the lowest and best bid received for this work in response to the bid specifications, a copy of which is attached and by this reference made part hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That a purchase order be issued to Todco Barricade for barricading services for a three-year period based on the firm’s bid submitted July 17, 2019, with placements to be made at various locations throughout the city on an as-needed basis. Section 2. That payments for barricading services to be provided under this purchase order, involving appropriations of more than one year, are authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the City of Omaha’s portion of the cost for this three-year contract is estimated to be $1,742,475.00 which is to be paid from the Street And Highway Allocation Fund 12131, Barricades Organization 116181, according to actual usage. ORDINANCE NO. 41977
AN ORDINANCE to amend Chapter 32 of the Omaha Municipal Code: to amend Section 32-211 to clarify the intent of collection of Watershed Management Fees; amend Section 32-212 to change the criteria for collection of Watershed Management Fees; amend Section 32-213 to update watershed management fees for fiscal year 2020 to 2024; to repeal sections 32-211, 32-212, and 32-213 of the Omaha Municipal Code as heretofore existing, and to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Omaha Municipal Code Section 32-211 is hereby amended to read as follows: Sec. 32-211. Intent of division. In accordance with the adopted stormwater element of the Omaha Master Plan and its amendments, watershed management fees shall be collected from new developments and or significant redevelopment as determined by the Director, requiring a new subdivision agreement, a revision to an existing subdivision agreement, or a change to a recorded plat, and located wholly or in part in the Papillion Creek Watershed to provide funding for construction of regional detention structures and water quality basins contained in the Papillion Creek Watershed Plan. However, any parcel of property for which similar Watershed Management Fees have been collected previously will not be required to again contribute the fees as the result of a subsequent redevelopment. Through the terms of an interlocal cooperation act agreement, as may be amended from time to time, Omaha shall transfer such fees to the Papio-Missouri River Natural Resource District, which will be responsible for the construction of regional detention structures and water quality basins in accordance with the Papillion Creek Watershed Implementation Plan, as may be amended from time to time. Section 2. That the Omaha Municipal Code Section 32-212 is hereby amended to read as follows: Sec. 32-212. Collection of Fees. Effective November 1, 2019, watershed management fees shall be collected in amounts provided in section 32-213. The watershed management fees required shall be due and owing under this division shall be collected for each parcel at the time of issuance of the first a building permit for each parcel in a new development or significant redevelopment as described in section 32-211. However, parcels within zones A, B, and C of the city’s urban development policy described fully in the Central City Program portion of the Omaha Master Plan - Urban Development Element Developing which are part of subdivisions platted and recorded prior to July 1, 2009 shall be exempt from watershed management fees, unless there has been a re-plat or amendment to the subdivision agreement. Amendments to a Exempted subdivisions within zones A, B, and C of the city’s urban development policy created which are re-platted strictly for the purpose of adjusting lot lines of an existing recorded subdivision shall continue to be exempted from watershed management fees. Any watershed management fees specified in an approved subdivision agreement shall not change as long as such plat remains in effect. Effective July 1, 2014, watershed management fees for new and amended subdivisions shall be· collected in amounts provided in section 32-213. Section 3. That the Omaha Municipal Code Section 32-213 is hereby amended to read as follows: Sec. 32-213. - Schedule of charges. (a) Based upon the recommendations of the Papillion Creek Watershed Partnership and consistent with the terms of an Interlocal Cooperation Act Agreement with the Papio-Missouri River Natural Resource District the following rates are established for watershed management fees:

Fiscal years (FY) run from July 1-June 30. FY14 FY2020 watershed management fees are in effect until and including June 30, 2014 2020. FY19 FY2024 watershed management fees will remain in effect from July 1, 2018 2023 until such time as the fees are amended by the city council. The date to be used for the calculation of watershed management fees will be the date of initial application for building permit. (b) The per acre charges shall be computed to the nearest 1/100 acre, but the fee shall in no event be less than the applicable fee for a single-family unit in subsection (a) above. As used herein, the expression “institutional” refers primarily to religious assembly facilities and public and private schools. The fees for such institutional uses will be computed on acreage including the developed land, parking areas, and the land immediately adjacent to the facility which forms the usable part of the property, excluding playgrounds or sports activity areas. Commercial, industrial and mixed-use (e.g. first floor office or commercial with second floor residential above) acreage shall be based upon the entire zoned area. (c) The fees provided for in this division are in addition to all other sewer connection or use fees provided for elsewhere in this Code. Section 3. That sections 32-211, 32-212, 32-213 of the Omaha Municipal Code, as heretofore existing are herby repealed. Section 4. AN ORDINANCE to Amend ORDINANCE NO. 41232 declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing the Missouri River Omaha Flood Protection Relief Wells project, identified as OPW 52534; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and , providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of constructing the Missouri River Omaha Flood Protection Relief Wells project identified as OPW 52534; Said property and lands necessary for such purposes are described as follows: See the attached Exhibit “B” plat drawing of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha required to be given the owners or other persons having any interest in and to any of the above described real estate may be given by either the Public Works Department or the Law Department of the City of Omaha. The Public Works Department will be responsible for recording of all deeds, easements or other acquisition documents resulting from the exercise of the authority granted under this Ordinance in the Register of Deeds Office in the appropriate county. AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and PEKEDO, LLC, a Nebraska limited liability company, to implement the Elkhorn Station Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 2606 North Main Street, 2605 North 206th Street, and 20585 and 20575 Elkhorn Drive, which proposes the demolition of three existing structures for new construction of a four-story building along Main Street with retail and office uses on the lower level and a mix of one and two-bedroom market-rate apartment units on the upper three floors, and new construction of a four-story building on the western portion of the site with retail and office uses and garage parking stalls on the main level and a mix of one and two bedroom apartment units on the three upper levels, for a total of 90 apartment units, 94 surface stalls, 90 garaged parking stalls, and additional public surface parking in the unimproved North 216th Street and adjacent rail right-of-ways; the agreement authorizes the use of up to $3,200,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and PEKEDO, LLC, a Nebraska limited liability company, to authorize the use of up to $3,200,000.00, plus accrued interest, to offset TIF eligible costs such as acquisition, demolition and grading, site preparation work, architectural and engineering costs, and public improvements as required, for a project with total estimated costs of $16,200,000.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1402 Howard, LLC, a Nebraska limited liability company, to implement the 14 Howard Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 1402 and 1410 Howard Street, which proposes the rehabilitation of the two-story building on 1410 Howard Street, and demolition of the building on 1402 Howard Street to allow new construction of a mixed-use building, to be connected and function as a single facility, with approximately 6,650 square feet for restaurant and bar use, 3,114 square feet for retail use, 6,284 square feet for office use and 4,224 square feet for storage space; the agreement authorizes the use of up to $475,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, with the applicant contributing $10,000.00 of the TIF loan proceeds toward the Downtown Public Improvement Fund, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and 1402 Howard, LLC, a Nebraska limited liability company, to authorize the use of up to $475,000.00, plus accrued interest, to offset TIF eligible costs such as acquisition, demolition, building rehabilitation construction, architectural and engineering costs, and public improvements as required, which includes $10,000.00 of the TIF loan proceeds toward the Downtown Public Improvement Fund, for a project with total estimated costs of $4,073,582.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. AN ORDINANCE approving a Second Amendment to the Redevelopment Agreement between the City of Omaha and Alchemy Development, LLC, a Nebraska limited liability company, which was approved by City of Omaha Council Ordinance No. 41242 on September 12, 2017, executed by the Mayor of the City of Omaha on September 14, 2017, and administratively amended on June 7, 2018, to change the final assessed valuation, base and division years, total project cost and amount of Tax Increment Financing (TIF) loan proceeds requested for the Zone 6 Apartments at Aksarben Village Tax Increment Financing (TIF) Redevelopment Agreement, as amended, authorizing an additional TIF loan allocation of $484,732.00, plus accrued interest, thereby increasing the original TIF loan proceeds from $1,625,568.00 to $2,110,300.00, plus accrued interest, and revising the estimated total project cost to $19,113,500.00; and, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date, all other terms and conditions contained in the Redevelopment Agreement not amended hereby, shall remain in full force and effect. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest the attached Second Amendment to a Tax Increment Financing Redevelopment Agreement between the City of Omaha and Alchemy Development, LLC, approved by City of Omaha Council Ordinance No. 41242 on September 12, 2017, executed by the Mayor of the City of Omaha on September 14, 2017, and administratively amended on June 7, 2018, to change the project timeline and the total project cost, and to increase the TIF loan proceeds by $484,732.00 from $1,625,568.00 to $2,110,300.00, plus accrued interest. Section 2. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Amendment to Redevelopment Agreement between the City of Omaha and Alchemy Development, LLC, a Nebraska limited liability company to authorize the use of up to $2,110,300.00, plus accrued interest in TIF loan proceeds that will be used to offset TIF eligible costs such as acquisition, demolition, site preparation, site utility connections, special foundations-geopiers and footings, architectural and engineering fees, and any public improvements required. AN ORDINANCE approving an amendment to an agreement by and between the City of Omaha and Millwork District I, LLC, to complete the installation of Indiana Street between 11th and 13th Streets and increase the City’s expense allocation for the project to an amount not to exceed $1,100,000. AN ORDINANCE to amend Omaha Municipal Code Chapter 19, Article XVI, entitled “Restaurant and Drinking Places Occupational Privilege Tax,” by amending Omaha Municipal Code Section 19-805 to enable the City to suspend or revoke other licenses issued under the Omaha Municipal Code or other ordinances for a delinquency in the payment of the Restaurant and Drinking Places Occupational Privilege Tax; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Chapter 19, Article XVI of the Omaha Municipal Code, entitled Restaurant and Drinking Places Occupational Privilege Tax, Section 19-805 - “Suspension or revocation of other licenses,” is amended as follows: Sec. 19-805. - Suspension or revocation of other licenses. No delinquency in payment of the tax herein provided for by this article and no conviction for violation of this article may be grounds for the suspension or revocation of any other license issued to any person engaged in business within the city under any licensing provisions of this code or other ordinances, nor may the same be grounds for the suspension or revocation of any license issued by any licensing authority pursuant to the statutes enacted by the general assembly of Nebraska. Any taxpayer engaged in the business of a restaurant or drinking place who is delinquent on the payment of the tax herein provided for by this article may have any license issued under any licensing prov1s1on of this code or other city ordinances suspended or revoked. Section 2. The sections, subsections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance shall be declared invalid, unenforceable, or unconstitutional by the valid judgment or decree of a court of competent jurisdiction, such invalidity, unenforceability, or unconstitutionality shall not affect any of the remaining sections, subsections, paragraphs, sentences, clauses, or phrases of this Ordinance. Section 3. That this Ordinance shall be in full force and take effect 15 days from and after the date of its passage.

ORDINANCE NO. 41968
AN ORDINANCE to amend Omaha Municipal Code Chapter 34, Article VI, Division 3, entitled “Removal of Obstructions and Accumulations;” by modifying the existing Sections 34-331 through 34-334 and adding new Sections 34-335 through 34-339; to provide regulations, prohibitions, notice requirements, and penalties; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Chapter 34, Article VI, Division 3 of the Omaha Municipal Code, entitled “Removal of Obstructions and Accumulations,” is amended by modifying Sections 34-331 to 34-334 and by adding new Sections 34-335 through 34-339, reading as follows: DIVISION 3. - REMOVAL OF OBSTRUCTIONS AND ACCUMULATIONS Sec. 34-331. - Definitions. For purposes of this division, the following words shall have the meanings respectively ascribed to them: Occupant: Includes the person or persons actually occupying the lot, land, or real estate, whether he be tenant, lessee, or owner. Owner: Includes the person or persons holding the legal title to the lot, land, or real estate. Sec. 34-332. - Removal required Duty to remove snow and ice accumulations and other obstructions. (a) Snow or ice. It shall be the duty of the occupant, as well as the duty of the owner, of any lot or land or real estate in the city to clear all ice and snow from the sidewalks adjoining the said lot, land, or real estate within 24 hours after the city has declared that snow removal operations on the city’s major streets are complete. The said snow and ice shall be placed between the back of the curb and the sidewalk, on private property, or on any portion of the sidewalk provided that a clear area at least four feet in width on the sidewalk is maintained. The aforesaid duty shall not apply to a sidewalk that is both (a) along the rear of the lot, land, or real property, and (b) along a designated emergency snow route or other streets as designated by the public works director. Notwithstanding this section and other sections of this Code, an owner of property within the boundary of an active downtown improvement district or business improvement district may place snow or ice from his or her property and adjacent sidewalk onto approved collection areas within the right-of-way, if there is a written agreement in effect between such district and the public works director to allow such placement of snow and ice during the first 24 hours after the conclusion of a snow storm. It shall be unlawful to place snow and ice on any alley or street right of way from private sidewalks, driveways, parking lots, roofs or other private property. (b) Obstructions and accumulations other than snow or ice. It shall be the duty of the occupant, as well as the duty of the owner of any lot or land or real estate in the city, to clear all obstructions and accumulations from the sidewalks adjoining said property within 24 hours of becoming aware of the presence of such obstructions or accumulations by notice from the city or otherwise. Such obstructions or accumulations shall include, but are not limited to, glass and other sharp objects, grease and mud or other slick material, loose gravel, leaves, tree limbs, animal waste material, and other hazardous material. Sec. 34-333. Removal by city. If any sidewalk adjoining any lot, land or real estate within the city shall not be cleared of ice or snow or other accumulations or obstructions by the occupant or owner as required by this division, the public works director may cause said sidewalk to be cleared forthwith. Furthermore, if a property owner or occupant places snow, ice, or other accumulations from his/her property, or from the right of way for which he/she is responsible, onto a public street, alley, or sidewalk, then the city may remove the said material. The public works director may thereafter report the cost and expense of the city’s clearance or removal under this section to the city council. The council may thereupon levy a special tax on such lot or land sufficient to pay the costs and expenses of clearance or removal of ice or snow or other accumulations or obstructions. The special tax shall be due and payable at the date of the levy and become delinquent 50 days after the date of levy, and from and after becoming delinquent shall bear interest at the rate of one percent per month until paid. When any such special tax is levied, the city clerk shall forthwith deliver a copy of the ordinance levying the same to the city treasurer; and to every such copy of such ordinance so delivered to the city treasurer the city clerk shall append a warrant in the usual form, requiring the city treasurer to collect such special taxes in the same manner as for other special assessments if the same be not paid before the time fixed for the same to become delinquent. Sec. 34-333. - Failure to remove accumulations and obstructions. It shall be unlawful for any occupant or owner of any lot or land or real estate in the city to fail or refuse to clear all ice and snow and other obstructions from the sidewalks adjoining said lot or land or real estate in the city as required by this division. Failure to remove or clear all such accumulations and obstructions shall, upon conviction, be punished as provided in section 1-10 of this Code. Sec. 34-334. Injuries to persons or property. In the event any person shall be injured in body or property by reason of neglect, failure or refusal of any occupant or owner to clear the sidewalks contiguous to the premises occupied or owned by him or snow and ice or other accumulations or obstructions as herein provided, and such person so injured shall recover damages and costs from the city for the injuries so sustained, such owner shall be liable to the city for the amount of damages and costs so recovered, and the city may sue and recover same at law. Sec. 34-334. - Prohibition on placing snow or ice in the public right-of-way. It shall be unlawful for any person to place snow or ice on any alley or street right-of-way from private sidewalks, driveways, parking lots, roofs. or other private property. Sec. 34-335. - Removal by city. If any sidewalk adjoining any lot, land, or real estate within the city shall not be cleared of ice or snow or other accumulations or obstructions by the occupant or owner as required by this division, the public works director may cause said sidewalk to be cleared following the expiration of 24 hours after notice to the occupant or owner. Said notice shall be provided by posting notice upon any door to a structure upon said lot, land, or real estate, whether said notice be affixed to the door itself or left hanging upon a door knob or latch, or by posting notice upon the property in a clearly visible manner if no structure is located on said property. Furthermore, if a property owner or occupant places snow, ice, or other accumulations from the occupant or owner’s property, or from the right-of-way for which he or she is responsible, onto a public street, alley, or sidewalk, then the city may remove the said material without notice to the occupant or owner. The public works director may thereafter report the cost and expense of the city’s clearance or removal under this section to the city council. The council may thereupon levy a special assessment on such lot or land sufficient to pay the cost of the fees established by the public works director on an annual basis pursuant to section 34-337(a) below, or the costs and expenses of clearance or removal of ice or snow or other accumulations or obstructions pursuant to a contract for services entered into according to the terms of section 34-337(b) below, whichever is less. Sec. 34-337. - Yearly establishment of costs and fees; engineer’s estimate. (a) The public works department shall, on an annual basis, analyze the costs to the city for employees of the public works department to remove the snow and ice accumulations or other obstructions that are prohibited by, this division. The public works director shall, thereafter, establish the fees necessary to recover the costs of abatement for the removal of snow and ice accumulations and the removal of other obstructions by city personnel, and such fees shall be based upon the actual costs that the city will incur and shall be set forth on a cost per lineal foot plus snow depth basis. (b) If the department determines that the removal of snow, ice, and other accumulations shall be performed by non-city personnel through a contract for services, the department shall have made a detailed estimate of the costs of the contemplated work to be performed. Such estimate shall be itemized and totaled so that a comparison may be made between such estimate and the bids called for. Any contract for services for the work set forth in this article shall be awarded through the competitive public bidding procedures set forth in this Code. In the opening of bids for the performance of any such work the city clerk shall cause the amount of such estimate to be read, and such estimate shall also be submitted to the city council with any contract for services to be performed for any such work. Sec. 34-338. - Publication of general notice. The city shall, beginning in the month of October of each year, publish or cause to be published in one or more legal publications of general circulation a general notice setting forth the requirements of this article and the cost of the fees established by the public works director on an annual basis pursuant to section 34-337(a) above, or the costs and expenses of clearance or removal of ice or snow or other accumulations or obstructions pursuant to a contract for services entered into according to the terms of section 34-337(b) above, whichever is less. Such notice shall be published in any weekly publication every week for not less than four weeks and in any daily publication not less than 15 times spaced not more than two days apart. Sec. 34-339. Additional penalties. In addition to the payment of the actual costs as provided in section 34-334 and other sanctions as may be imposed by law, any person who fails to clear any accumulation or obstruction as required by this division shall pay the following penalties: (a) For the second violation at the same location within any 36 month period, a penalty in the sum of $150.00: (b) For the third violation and each subsequent violation thereafter at the same location within any 36 month period, a penalty in the sum of $300.00. In the event any person fails to pay the penalty herein provided the city may assess such penalty upon the property in the same manner as special assessments, or the city may sue any such occupant or owner in any court of competent jurisdiction for the amount of the penalty due and payable under the terms and provisions of this division, and may recover a judgment against such person or persons for the amount so due, together with interest. Section 2. The sections, subsections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance shall be declared invalid, unenforceable, or unconstitutional by the valid judgment or decree of a court of competent jurisdiction, such invalidity, unenforceability, or unconstitutionality shall not affect any of the remaining sections, subsections, paragraphs, sentences, clauses, or phrases of this Ordinance. AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Quin Global Adhesives to obtain a minor air emission construction permit for the canister spray adhesives manufacturing facility at 5710 “F” Street, Omaha. The potential emissions, in tons, for this project will be: VOC 90.0, any individual HAP 8.0 and total HAPs 20.0.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from October 2, 2019 to November 2, 2019. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
