Notice is hereby given that the City Council of the City of Omaha met on May 5, 2020 and passed and approved the following ordinances:
ORDINANCE NO. 42199
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest and southwest of 11th and Dodge Streets from DS-Downtown Service District and CBD-Central Business District to CED-Central Business District (property is located within an A CI- I-Areas of Civic Imp011ance Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots I and 2, OPA Campus, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from northwest and southwest of 11th and Dodge Streets from DS-Downtown Service District and CBD-Central Business District to CBD-Central Business District (property is located within an ACI-1-Areas of Civic Importance Overlay District). AN ORDINANCE to approve a PUR-Planned Unit Redevelopment Overlay District in a GC-General Commercial District located at 119 North 72nd Street, to approve the Development Plan, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County, Nebraska: Lot l, Furniture Row 78, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska. AN ORDINANCE approving the receipt of Fiscal Year 2019 Better Utilizing Investments to Leverage Development (BUILD 19) Transportation Grant funds in the amount of $16,960,000.00, along with is associated terms and conditions, to finance the construction of Project OPW 50949, being improvements to 1201h Street between Stonegate Drive and Roanoke Boulevard; to authorize the Mayor to execute the final BUILD 19 grant agreement with from the US Department of Transportation, to provide for reimbursements involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter, as amended; to provide for payments to a specific account; and to provide an effective date hereof. AN ORDINANCE to amend the agreement dated August 3, 2017 and Ordinance number 41196 passed July 25, 2017 between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of two hundred and sixty-two thousand, seven hundred and ninety-nine dollars ($262,799) for an amended agreement amount of four hundred eighty-one thousand, dollars nine hundred and seventy dollars ($481,970), the amendment authorizes funding to the Douglas County Attorney’s Office for one (1) Domestic Violence Unit Attorney, one (1) Domestic Violence Unit Liaison, training; and to the Douglas County Sheriff’s Office for one (1) Protection Order Locate System, one (1) Civil Process Server, Human Trafficking Warrant Sweeps, Human Trafficking Investigative/Surveillance Initiative, Domestic Violence Warrant Sweep Operations, and training; to authorize payment from such funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE (1) to approve an agreement between the City of Omaha and Nebraska Preparedness Partnership in the amount of sixty-six thousand dollars ($66,000) and (2) to authorize the funding for such agreement from the FY 2019 State Homeland Security Grant (SHSG) Award #EMW-2019-SS-00090, awarded by the Nebraska Emergency Management Agency, to provide enhanced security of critical infrastructure assets as prioritized by critical infrastructure operators through public-private partnerships, coordinated plan implementation, and resource management; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and the Nebraska Preparedness Partnership in the amount of sixty-six thousand dollars ($66,000) budgeted from the Nebraska Emergency Management Agency’s FY 2019 State Homeland Security Grant (SHSG) Award #EMW-2019-SS-00037-S01 to enhance security of critical infrastructure assets as prioritized by critical infrastructure operators through public-private partnerships, coordinated plan implementation, and resource management; is hereby approved. AN ORDINANCE to approve an Amendment to an Agreement between the Omaha Fire Department and ZOLL Data Systems, Inc., in the initial amount of $40,557.16 for the period of January 1, 2020 through December 31, 2020 followed by an annual cost of $113,070.60 per year beginning January 1, 2021 for a term of up to a total of seventy--two months, and training expenses not to exceed $6,000.00; such Amendment is to be for the benefit of the City of Omaha Fire Department in support of the RescueNET ePCR Suite purchased by Resolution No. 1677 on December 17, 2013, and includes the termination of existing ePCR and FireRMS licenses and gives the right to access and use emsCharts and Fire Reports; such Amendment involves the appropriations of more than one year in accordance with § 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; to authorize the Finance Department to make payment for specified accounts; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE to approve a Second Agreement Pursuant to lnterlocal Cooperation Agreement between the City of Omaha, a Nebraska Municipal Corporation in Douglas County, Nebraska and the Board of Regents of the University of Nebraska, a public body corporate of the State of Nebraska, to complete payment of the city’s Unfunded Reimbursement, as identified in that lnterlocal Cooperation Agreement by and between the parties approved by the Omaha City Council on October 25, 2013 and authorizes the use of $2,539,000.00 in transportation bond proceeds to fund the costs of the public improvements; and provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council hereby and does approve the attached Second Agreement Pursuant to lnterlocal Cooperation Agreement between the City of Omaha and the Board of Regents of the University of Nebraska, which authorizes $2,539,000.00 in transportation bond proceeds to be used to complete payment of the City’s Unfunded Reimbursement for the UNO Improvements, as identified in that certain lnterlocal Cooperation Agreement between the parties approved on October 25, 2013, as indicated in the agreement, thereby fulfilling completely any and all payment or other obligations of the City of Omaha. Section 2. That the Mayor of the City of Omaha is hereby authorized to execute, and the City Clerk to attest, the attached Second Agreement Pursuant to lnterlocal Cooperation Agreement between the City of Omaha and the Board of Regents of the University of Nebraska, in addition to any other related documents necessary or appropriate to implement the Agreement.
Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and ZAN Properties, LLC, a Nebraska limited liability company to implement the Pacific Heights Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 1217 and 1219 Pacific Street, which proposes an infill redevelopment project comprised of a six unit apartment building with each unit having two bedrooms; the agreement authorizes the use of up to $267,122.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and ZAN Properties, LLC, a Nebraska limited liability company to authorize the use of up to $267,122.00, plus accrued interest, to offset TIF eligible costs such as acquisition, site work, architectural and engineering costs, and public improvements as required, for a project with total estimated costs of $2,289,000.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

SPECIAL ORDINANCE NO. 10276
A SPECIAL ORDINANCE levying a special tax and assessment on all lots and pieces of real estate within Roadway Maintenance District (RMD) 2019-04, in the City of Omaha, to cover the cost of constructing and improving North 891h Circle, from Burt Street north to end of the cul-de-sac, by asphalt overlay, and to provide an effective date hereof. WHEREAS, it having been and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred to have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of the improvement of the street within RMD 2019-04 by the City of Omaha. THEREFORE, for the purpose of paying the cost of said improvements BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the cost of RMD 2019-04, being the improvement of North 89111 Circle, from Burt Street north to end of the cul-de-sac, by asphalt overlay said cost being $75,799.11, be and the same is hereby levied and assessed according to special benefits by reason of said improvement upon the following described lots and pieces of real estate within the City of Omaha as shown by the generally recognized maps, plats, and ordinances of the City of Omaha, or by the maps, plats, and records on file in the office of the City Engineer of said City, said cost being so levied on said lots and pieces of real estate, respectively, as set forth as follows. Section 2. That said special taxes aforesaid on said lots, respectively, shall become delinquent per the “Monetary Table for Assessing” as follows. Each of said installments, except the first, shall draw interest at the rate of 5 .00 percent per annum from the time of the levy aforesaid until the same shall become delinquent. Where the individual assessment is Four Hundred Ninety Nine and 99/100 Dollars ($499. 99) or less the total amount shall become delinquent fifty days (50) from and after the passage and approval of this Ordinance. Interest at the rate of fourteen percent per annum, as provided by State law, payable in advance shall be paid on each delinquent installment or on each delinquent assessment of Four Hundred Ninety Nine and 99/100 Dollars ($499.99) or less. Section 3. That the entire amount of tax so levied and assessed on any of said lots, or the entire equal pro-rate proportion of said tax on any of said lots, may be paid by any person on any part of said lots within fifty days from said levy and, thereupon, said lots or parts of lots shall be exempt from any lien or charge thereto.
