AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 6048 Bridle Path from DR-Development Reserve District and R2-Single-Family Residential District (Low Density) to R2-Single-Family Residential District (Low Density) (property is located within an ED-Environmental Resources Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 168th Street and Kansas Avenue from AG-Agricultural District to R4-Single Family Residential District (High Density). ORDINANCE NO. 42242
AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located southwest of George B. Lake Parkway and West Q Road; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot l, MPS 210 & Q Campus, a subdivision in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the Papillion Creek North 210 Project (CSO), identified as OPW 53320; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of the Papillion Creek North 210 Project (CSO), project identified as OPW 53320; Said property and lands necessary for such purposes are described as follows. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized; empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. ORDINANCE NO. 42250
AN ORDINANCE to amend Omaha Municipal Code Sections 20-297, 20-306, and 34-144; to change requirements for notification of adjacent residences and businesses in certain instances when special event permits are requested, to insure that retail sales adjacent to a property when a special event permit has been issued are consistent with what the business normally sells, and to make clear right-of-way leases are not required for temporarily permitted uses; to repeal Sections 20-297, 20-306, and 34-144 as heretofore existing; and to provide the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Omaha Municipal Code Sec. 20-297 is hereby amended to read as follows:
Sec. 20-297. -Standards for issuance.
(a) The director shall issue a large parade or public assembly permit as provided for herein when, from a consideration of the application and from such other information as may otherwise be obtained, he or she finds that:
(1) The conduct of the parade or public assembly will not substantially interrupt the safe and orderly movement of other pedestrian or vehicular traffic contiguous to its route or location;
(2) The conduct of the parade or public assembly will not require the diversion of so great a number of city police officers to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection of the city;
(3) The concentration of persons, animals, and vehicles at public assembly points of the parade or public assembly will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such public assembly areas;
(4) The conduct of the parade or public assembly is not reasonably likely to cause injury to persons or property;
(5) The parade or public assembly is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays en route;
(6) Adequate sanitation and other required health facilities are or will be made available in or adjacent to any public assembly areas;
(7) There are sufficient parking places near the site of the parade or public assembly to accommodate the number of vehicles reasonably expected;
(8) Such parade or public assembly is not for the primary purpose of advertising any product, goods or event that is primarily for private profit, and the parade itself is not primarily for profit. The prohibition against advertising any product, goods or event shall not apply to signs identifying organizations or sponsors furnishing or sponsoring exhibits or structures used in the parade;
(9) No parade or public assembly permit application for the same time and location is already granted or has been received and will be granted;
(10) No parade or public assembly permit application for the same time but different location is already granted or has been received and will be granted, where the police resources required for that prior parade or public assembly are so great that in combination with the subsequent proposed application, the resulting deployment of police services would have an immediate and adverse effect upon the welfare and safety of persons and property; and
(11) No event is scheduled elsewhere in the city where the police resources required for that event are so great that the deployment of police services for the proposed parade or public assembly would have an immediate and adverse effect upon the welfare and safety of persons and property.
(b) No permit shall be granted that allows for the erection or placement of any structure, whether permanent or temporary, on a city street, sidewalk, or right-of-way unless advance approval for the erection or placement of the structure is obtained from the director.
(c) In reviewing an application, the director shall notify, and may receive recommendations from, the police and fire departments, and from the 911/communications department of the county. An application shall not be approved unless the police and fire departments shall approve the same.
(d) The director may require, as a condition of the application, that a pre-event meeting be held between the director, the applicant, and any other interested parties, to address issues raised by the application.
(e) For parades, public assemblies, and non-commercial street closing events. The Director may require that the applicant notify adjacent residents and businesses that could be affected by the granting of a Permit. The Director may consider any feedback that is received prior to issuance of the permit or create conditions on the issuance of the permit.
Section 2. That Omaha Municipal Code Sec. 20-306 is hereby amended to read as follows:
Sec. 20-306. - Public conduct during parades or public assemblies.
(a) No person shall unreasonably hamper, obstruct or impede, or interfere with any event permitted under this article or with any person, vehicle or animal participating or used in such an event.
(b) No driver of a vehicle shall drive between the vehicles or persons comprising a parade or public assembly when such vehicles or persons are in motion and are conspicuously designated as a parade or public assembly.
(c) The director shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along a street constituting a part of the route of a parade or public assembly. The director may post signs to that effect, and it shall be unlawful for any persons to park or leave unattended any vehicle in violation thereof. No person shall be liable for parking on a street unposted in violation of this article.
(d) Retail businesses adjacent to an area where a Special Event permit has been issued may sell goods normally sold inside the retail business on the sidewalk immediately in front of their business subject to leaving (1) five feet of clear unobstructed sidewalk space for pedestrians; and (2) not interfering with the permittee’s use of right-of-way contemplated by the Permit.
(e)Retail businesses shall not sell or allow others to sell goods in front of their retail business which are not sold in the retail business on a regular basis prior to the event.
Section 3. That Omaha Municipal Code Sec. 34-144 is hereby amended to read as follows:
Sec. 34-144. - Exceptions.
(a) The lease requirements of this article shall not apply to any gas, steam, condensate or chilled water line, energy distribution line, or utility line, where the same is installed or operated by the holder of any franchise or other contract rights granted by the city wherein service is provided to the inhabitants of the city.
(b) The lease requirements of this article shall not apply to any telecommunications lines, wires, cables or related wire facilities in the city right-of-way. Such telecommunications lines, wires, cables or related wired facilities may be placed in the right-of-way after consent therefor by resolution of the city council.
(c) The lease requirements of this article shall not apply to a vacant lot owned by the city, if there is an agreement with a person or organization to maintain such lot for the purpose of gardening activities. Such gardening agreement shall be for one growing season at a time, and shall be on such terms as stated on a gardening agreement form provided by the planning director.
(d) The lease requirements of this article shall not apply to temporarily permitted uses of right-of-way that are approved by a permit issued by the Public Works Department.
Section 4. That Omaha Municipal Code Sections 20-297, 20-306, and 34-144 as heretofore existing are hereby repealed. Section 5. That this Ordinance shall be in full force and take effect 15 days from and after the date of its passage.

ORDINANCE NO. 42251
AN ORDINANCE (1) to approve an agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of one hundred and eighty-two thousand, eight hundred and sixty-eight dollars ($182,868); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2019 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #2019-DJ-BX- 0620, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for law enforcement equipment, prosecutor and corrections programs, and technology improvements and training; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha has been awarded the FY 2019 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #2019-DJ-BX-0620, from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, in the amount of $374,737. Section 2. That the City of Omaha will retain $9,038 to provide grant administration and the balance of $365,699 will be equally split between the Omaha Police Department ($182,831) and Douglas County ($182,868). Section 3. That Douglas County’s allocation of $182,868 will fund law enforcement equipment, prosecutor and corrections programs, and technology improvements and training, during the project period of April 7, 2020 to September 30, 2022. Section 4. That, as recommended by the Mayor, the agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of one hundred and eighty-two thousand, eight hundred and sixty-eight dollars ($182,868); is hereby approved. Section 5. That, the terms of the agreement shall extend through the award project period of April 7, 2020 to September 30, 2022 commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, total expenditures as outlined in the budget, from such grant funds and involving appropriations of more than one year, are hereby authorized and the Finance Director is authorized to make payment in accordance therewith. Section 6. There is no match with this grant. Section 7. That this Ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

ORDINANCE NO. 42252
AN ORDINANCE to approve and execute an Agreement involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended, with Silverstone Group, Inc., for group benefit consulting services for a period from March 1, 2020 to and ending on February 28, 2023, with an option for two 1 -year extensions beginning respectively on March 1, 2023, and March 1, 2024; to authorize the Mayor to execute and the City Clerk to attest to such Employee Benefits Fee for Services Agreement; to authorize payment in accordance with the terms and conditions contained therein in the monthly amounts of $13,800 in Year 1 from approval to February 29, 2021, $14,200 in Year 2, and $14,600 in Year 3, and if the extension options are exercised, in the amounts of $15,000 in Year4; and $15,400 in Year 5 from General Fund 11111, Organizations 105011-105015 for services related to Human Resource functions such as open enrollment, compliance and communication assistance; from General Fund 11111, Organizations 118018 (Active}, 118014 (Retiree), 118015 (COBRA), Account 41331 for services related to health care; and from General Fund 11111, Organization 118017, Account 42135, for services related to workers’ compensation and related fields; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That authority is hereby given for the execution of an Agreement involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended, by and between the City of Omaha and Silverstone Group, Inc., for group benefit consulting services for a period commencing on March 1, 2020 and ending on February 28, 2023, with an option for two 1 -year extensions beginning respectively, on March 1, 2023, and March 1, 2024, in the monthly amounts of $13,800 in Year 1 from approval to February 29, 2021, $14,200 in Year 2, and $14,600 in Year 3, and if the extension options are exercised, in the amount of $15,000 in Year 4, and $15,400 in Year 5. Section 2. That the Mayor of the City of Omaha be, and hereby is, authorized and empowered to execute for and on behalf of the City of Omaha, and the City Clerk to attest, the attached Employee Benefits Fee For Services Agreement authorized and approved in Section 1 hereof, attached hereto. Section 3. That the Finance Director is authorized to make payments in accordance with the terms and conditions contained therein in the monthly amounts specified herein from General Fund 11111, Organizations 105011-105015 for services related to Human Resource functions such as open enrollment, compliance and communication assistance; from General Fund 11111, Organizations 118018 (Active), 118014 (Retiree), 118015 (COBRA), Account41331 for services related to health care; and from General Fund 11111, Organization 118017, Account 42135, for services related to workers’ compensation and related fields. A SPECIAL ORDINANCE LEVYING A SPECIAL TAX AND ASSESSMENT ON CERTAIN LOTS, PARTS OF LOTS AND PIECES OF REAL ESTATE IN THE CITY OF OMAHA, TO COVER THE COST OF SIDEWALK SNOW REMOVAL IN DISTRICT NO. SWSR 2020-01. WHEREAS: It having been and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred to have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of clearing snow and ice from such sidewalks along and adjoining the said lots and pieces of real estate. THEREFORE, for the purpose of paying the cost incurred for said snow and ice removal along and adjoined the said lots and pieces of real estate, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: SECTION 1. That the cost of clearing snow and ice from such sidewalks along and adjoining the several lots and pieces of real estate in the City of Omaha, herein described be and hereby is levied and assessed according to special benefits by reason of the clearing of snow and ice from such sidewalks upon the following lots and pieces of real estate, as shown by the maps and plats on file in the office of the City Engineer of said City, said costs being so levied on said lots and pieces of real estate, respectively. SECTION 2. The special tax levy shall be due and payable at the date of the levy. The special tax levy shall become delinquent fifty (50) days from and after the passage and approval of this Ordinance; from and after becoming delinquent shall bear interest at the rate of one percent (1.00) per month until paid. SECTION 3. That the entire amount of tax so levied and assessed on any of said lots, or the entire equal pro-rate proportion of said tax on any of said lots may be paid by any person on any part of said lots within fifty days from said levy and, thereupon, said lots or parts of lots shall be exempt from any lien or charge thereto. SECTION 4. That this Special Ordinance shall take effect fifteen days after its passage and be in force thereafter.
