PUBLIC NOTICE
HOUSING FOUNDATION
FOR SARPY COUNTY

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Housing Foundation for Sarpy County (HFSC).

REQUEST FOR RELEASE OF FUNDS

On or about June 30, 2020 the HFSC will submit a request to the Nebraska Department of Economic Development (NDED) for the release of Nebraska Affordable Housing Trust Fund HOME Investment Partnership Program funds under the Nebraska Affordable Housing Act (Nebraska Revised Statutes beginning in Sec 58-703) as amended to undertake the project known as Belle Plaine Apartment for the purpose of constructing a multifamily affordable housing development.

The Project involves the construction of multi-family housing project located southeast of the intersection of Grenoble Drive and Highway 75, in Bellevue, Sarpy County, Nebraska on approximately 12 acres of undeveloped land. The project will consist of 8 newly constructed 2-story multifamily housing units. The project will consist of 38 three-bedroom units and 37 four-bedroom units, for a total of 75 dwelling units.  The units will each have 2 bathrooms and be 1250 and 1500 square feet respectively. The project will be co-sponsored by the Housing Foundation for Sarpy County and Summit Housing Group, Inc., and owned by Belle Plaine Apartments, LP dba Cedarview Crossing Apartments, LP, a Montana Limited Partnership authorized to transact business in Nebraska. The proposed site is located in an existing residential neighborhood and will use existing roads and infrastructure as well as extending existing roads into the neighborhood as a drive through for vehicle access; there will be no displacement of residents during construction.  The site plan and development has been approved by the city of Bellevue. There will be fifteen (15) market rate units and sixty (60) low income housing units. The project will adhere to the (IRS) Section 42 Low Income Housing Tax Credit (LIHTC) Program and will primarily benefit low-to-moderate income families at or below 60% of the Area Median Income. Construction is planned to start in July 2020 and to be completed by June 2021. The estimated project costs of $14,271,938 and will be funded with $500,000 of Nebraska Affordable Housing Trust Fund (NAHTF) HOME Investment Partnerships Program (HOME) Match funds, $5,499,999 in LIHTC equity, $2,400,000 in Nebraska Affordable Housing Tax Credit equity, $5,600,000 in standard bank loans, and $271,939 in developer equity.  HOME funds will assist four (4) out of the total 75 units.  

FINDING OF NO SIGNIFICANT IMPACT

The Housing Foundation of Sarpy County has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Housing Foundation of Sarpy County, 8214 Armstrong Circle, Bellevue, Nebraska 68147, and online sarpyhousing.org and may be examined or copied by appointment.  

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the HFSC.  All comments received by July 22, 2020; will be considered by the HFSC prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.  Comments should be sent to director@sarpyhousing.org.

ENVIRONMENTAL CERTIFICATION

The HFSC certifies to NDED that Carolyn Pospisil in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  NDED’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the HFSC to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

NDED will accept objections to its release of fund and the HFSC’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the HFSC, (b) the HFSC has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by NDED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to NDED Office at 301 Centennial Mall South, Lincoln , NE 68509-4666.  Potential objectors should contact NDED to verify the actual last day of the objection period.
