NOTICE IS HEREBY GIVEN that a regular meeting of the Mayor and City Council of the City of Bellevue will be held at 6:00 P.M. on Tuesday, September 15, 2020, at the Bellevue City Hall, 1500 Wall Street, Bellevue, Nebraska.
The agenda for the regularly scheduled meeting, which is kept continually current, may be amended as permitted by law and shall be available for public inspection during normal business hours at the office of the City Clerk at City Hall beginning Wednesday, September 9, 2020, at 4:00 P.M., and is available on the Internet at www.bellevue.net.

Bellevue City Council Proceedings

A meeting of the Mayor and Council of the City of Bellevue was called to order by Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m. on September 1, 2020. Present were Council Members Bob Stinson, Paul Cook, Pat Shannon, Don Preister, Thomas Burns, and Kathy Welch.
Notice of this meeting was given in advance thereof by publication in the Gretna Guide “Omaha Daily Record” and posted in two public places, the designated method for giving notice, and was given to the Mayor and all members of the City Council. All proceedings hereafter were taken while the convened meeting was open to the public. Mayor Hike announced that a copy of the Open Meetings Act is posted in the back of the City Council Chambers.
Mayor Hike led in the Pledge of Allegiance. Assistant Pastor William Johnson, Revival Tabernacle Church, 2226 Jefferson Street, Bellevue, gave the invocation.
The following items of business were considered:
1. Council approved the Agenda after amending to remove Item 10a per the applicant’s request and to move Item 11a after Item 18a.
2. After Councilman Cook removed the Claims, Council approved the Consent Agenda, which included the following: Approval of the August 18, 2020 City Council Minutes and Approval of the appointment of Evonne Edgington to the Library Advisory Board for a 5-year term, ending June 2025.
3. Council approved the claims following clarification on a claim Councilman Cook asked about under legal to Erickson & Sedestrom, PC for $8,824.60. Mr. Jim Ristow, City Administrator, informed him Councilman Shannon has named the City Attorney, Bree Robbins, as a defendant in a lawsuit against the city, therefore Ms. Robbins has to conflict out and not represent the city so the city contracted out with them for legal matters.
4. Mayor Hike read a Proclamation declaring September as “National Library Card Signup Month” and presented it to the Library Director, Julie Dinville.
5. Mayor Hike and Mr. Jim Ristow, City Administrator, presented a token of appreciation to Interim Chief Tom Dargy for his dedication and leadership during this time of transition.
6. Mr. Ristow introduced the new Bellevue Police Chief, Mr. Ken Clary, who was joined by his wife Jodi Clary. Police Chief Clary was sworn in by Mayor Hike.
7. Following the third and final reading Ord. No. 4005: An ordinance to adopt the budget statement to be termed the Annual Appropriations and Ord Bill; to appropriate sums for necessary expenses and liabilities; to provide for an effective date was approved. Following pa public hearing Res. No. 2020-35: a resolution to set the 2020-2021 property tax request was also approved, along with approval of an additional 1% in the base of restricted funds.
8. Ord. No. 4006: An ordinance to amend or revise certain ordinances as further detailed herein which have been affected by or generated by legislative changes and to add or change legislative citations, to repeal such sections as heretofore existing; and to provide for the effective date of this ordinance, was read for the first time with the second reading and public hearing being scheduled for September 15th.
9. Council approved tabling Res. No. 2020-36 as staff is still working pulling with all departments on the Fee Schedule. Council unanimously approved Res. No. 2020-38: Authorizing the Mayor to sign the Annual Year-End Certification of City Street Superintendent Form for 2020 verifying Robert Joseph Riggs as the City Street Superintendent from January 1, 2020 to December 31, 2020.
10. Council approved the following items: Approve and authorize the Mayor to sign the addendum to the original contract with DIY Holding Company, LLC., increasing the original contract to for 2020 Concrete Projects by $175,000.00; Approve and authorize the Mayor to sign the Agreement with AVI to provide professional engineering services for the emergency operation center, in an amount not to exceed $17,867.52; and approve and authorize the Mayor to sign the amended Lease Agreement, as it was amended and provided to Council on September 1st, for the leasing of certain properties in Haworth Park.
11. Administrative Reports: The monthly report for August was attached and reviewed by the Council.
12. Motion was made to adjourn Sine Die, motion died due to a lack of a second.
13. City Attorney Bree Robbins excused herself and turned matters to Heather Viek, who is representing the City in Litigation matters. Council adjourned into Closed Session at 6:48 p.m., for the protection of the public interest. The subject matter to be discussed was Litigation Updates. The following individuals were included in closed session: Mayor Rusty Hike, Jim Ristow, Bob Stinson, Paul Cook, Don Preister, Thomas Burns, Kathy Welch, Bree Robbins, Heather Viek, Tahnee King, Susan Kluthe, Mark Elbert, Tammi Palm, and Darryl Kuhlman. At 6:51 p.m. roll call was taken of those present in Closed Session and Darryl Kuhlman was not in attendance.
14. Council came out of Closed Session and re-convened into Open Session at 7:08 p.m.
15. Ord. No. 4004: An ordinance to amend the official zoning map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about 2221 Main Street, more particularly described in Section 1 of the ordinance and to provide an effective date, was read for the third and final time. Councilman Shannon stated he objected and was opposed to action on this. He recused himself and sat in the audience. With no further discussion, Ord. No. 4004 was approved on a 5-0-1 vote, with Shannon abstaining. Shannon asked the Clerk to reflect in the minutes he returned to his seat.
16. There being no further business to come before the Council at this time, on motion duly made and seconded, at 7:13 p.m. the meeting adjourned.

AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATIONS BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BELLEVUE, NEBRASKA:
Section 1. That after complying with all procedures required by law, the budget, Exhibit A, as presented and set forth in the budget statement, is hereby approved as the Annual Appropriations Bill for the fiscal year beginning October 1, 2020, through September 30, 2021. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the City of Bellevue. A copy of the budget document, Exhibit A, shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, Nebraska, and to the County Clerk of Sarpy County, Nebraska, for use by the levying authority.
Section 2. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.

NOTICE OF CONSTRUCTION

Improvements; C.N. 22276
Weather permitting, construction of Phase 1 of the Bellevue 36th Street Improvement Project could begin as early as September 23, 2020. Phase 1 includes the area from Bline Avenue to Sheridan Road. The entire Phase 1 construction is anticipated to take two construction seasons to complete and 36th Street will remain open to traffic for the duration of construction. Access to adjacent properties will be maintained but may be limited at times due to phasing requirements. Vrana Construction is the contractor.
The City of Bellevue will hold a virtual public information meeting regarding the construction of Phase 1 on the project website, www.bellevue36thstreet.com. Information will be posted on the site beginning September 23, 2020.
