CITY OF OMAHA

Notice is hereby given that the City Council of the City of Omaha met on October 6, 2020 and passed and approved the following ordinances:

ORDINANCE NO. 42335

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Maple 37 Limited Partnership, a Nebraska limited partnership, to implement the HNHC Central Park Scattered Housing Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3832 Saratoga Street, 3825 Browne Street, 3806 Camden Avenue, 3930 Camden Avenue, 4123 Camden Avenue, 5120 N. 41 Street, 5110 N. 40 Street, 5118 N. 40 Street, 4004 Grand Avenue, 4006 Grand Avenue and 3815 Fort Street, which proposes the construction of 11 new homes on vacant sites in north Omaha; the agreement authorizes the use of up to $150,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Holy Name Housing Corporation, a Nebraska non-profit corporation, to authorize the use of up to $150,000.00, plus accrued interest, to offset TIF eligible costs such as site work, architectural and engineering costs, various studies, and public improvements as required, for a project with total estimated costs of $3,077,089.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage

ORDINANCE NO. 42336

AN ORDINANCE to add Section 10-271.5 entitled “Omaha Douglas Public Building Commission” to Chapter 10, Article IX of the Omaha Municipal Code; to provide for an exemption from the payment of fees for permits and inspections made by the city on property owned by the Omaha Douglas Public Building Commission; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Omaha Municipal Code Sec. 10-271.5 is hereby created to read as follows: Sec.10-271.5. - Omaha Douglas Public Building Commission. The Omaha Douglas Public Building Commission, a political subdivision, is hereby exempt from the payment of fees fixed for permits issued or inspections made by the city upon any property which is within the corporate limits of the city or within the area without the corporate limits of the city subject to the jurisdiction of the city. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 42337

AN ORDINANCE to amend Chapter 12, Article Ill, entitled “Prevention of COVID-19,” Section 12-51 of the Omaha Municipal Code; to extend the sunset provision; and to provide the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as a result of Novel Coronavirus (COVID-19) pandemic and with continued community transmission of confirmed COVID-19 cases within the City limits of the City of Omaha, a danger to the public health, safety, and welfare continues to exist within the City of Omaha. This ordinance seeks to extend the imposition a non-pharmaceutical intervention to combat the spread of COVID-19 and to halt the progression thereof. Section 2. That Chapter 12, Article Ill, Section 12-51 of the Omaha Municipal Code is hereby amended as follows: Sec. 12-51. -Sunset Provision. The requirements imposed by this Article shall expire and terminate at 11:59 p.m. on November 24, 2020, unless otherwise extended by ordinance of the City Council. Section 3. The sections, subsections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance shall be declared invalid, unenforceable, or unconstitutional by the valid judgment or decree of a court of competent jurisdiction, such invalidity, unenforceability, or unconstitutionality shall not affect any of the remaining sections, subsections, paragraphs, sentences, clauses, or phrases of this Ordinance. Section 4. This Ordinance shall be in full force and take effect 15 days from and after the date of its passage.
