ORDINANCE NO. 42378
AN ORDINANCE vacating the east/west alley between South 5th Street and South 6th Street and between Woolworth Avenue and Pine Street, abutting Lots 1 through 8, Block 22 of Credit Foncier Addition, platted and recorded in Douglas County; and providing the effective date hereof. WHEREAS, a petition representing owners of more than seventy-five (75) percent of the property abutting the alley described above, has filed with the City of Omaha; and, WHEREAS, Fair Market Value has been determined and paid as required for the conveyance of the right-of-way to be vacated. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The east/west alley between South 5th Street and South 6th Street and between Woolworth Avenue and Pine Street, abutting Lots 1 through 8, Block 22 of Credit Foncier Addition, as surveyed, platted and recorded in Douglas County; be, and hereby is, vacated and without further act of the City, title to the vacated right-of-way shall pass to the abutting owner of said property thereof; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person. Section 2. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 42379
AN ORDINANCE to authorize the acceptance of the bid from Waste Connections of Nebraska, Inc., involving the payment of money from appropriations of more than one fiscal year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; for rubbish container service at various Omaha Police Department facilities in the annual bid amount of $16,764.00; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, in conformity with Section 5.17 of the Home Rule Charter, approval is hereby given to accept the bid from Waste Connections of Nebraska, Inc. for rubbish container service at various Omaha Police Department facilities effective for three years, with the option to extend on a yearly basis for two additional years, based on the bid received for this service on September 28, 2020, is the lowest and best bid received.
Section 2. That, funds in the amount of $14,832.00 for this service shall be paid from the Omaha Police Department General Fund 11111, Organization 113141 Fleet/Facilities, Account 42252 Contract Services; and funds in the amount of $1,932.00 will be paid from Equitable Sharing Fund 11111, Organization 177779, Account 42252 Contract Services. Section 3. This Ordinance, being not of a legislative character, shall be in full force and take effect immediately upon passage under and by virtue of the authority granted by Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

AN ORDINANCE to accept the bid of Sandry Fire Supply, LLC to provide fire hose for the Omaha Fire Department for a term of 36 months at a total cost of $46,836.75 with the option to extend the agreement for an additional four years; and to provide an effective date hereof; WHEREAS, Sandry Fire Supply, LLC submitted a bid of $46,836.75 to provide fire hose for the Omaha Fire Department for 36 months with the option to extend the agreement for an additional four years; and, WHEREAS, the bid of Sandry Fire Supply, LLC, in the amount of $46,836.75 to provide fire hose for the Omaha Fire Department, was the best bid that met or exceeded specifications and is attached hereto and by this reference made a part hereof; and, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1.That the attached bid of Sandry Fire Supply, LLC, involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha 1956 as amended, in the amount of $46,836.75 for the purchase of fire hose for the Omaha Fire Department, in accordance with the attached specifications for fire hose for the Omaha Fire Department, for 36 months with the option to extend the agreement for an additional four years, is hereby accepted and the Mayor of the City of Omaha is authorized to execute any further agreement which may be necessary to implement such a bid; and, Section 2. That the City Finance Department is hereby authorized to make the payments contemplated by the accepted bid, with such sums to be paid from the appropriations for the Omaha Fire Department, 11111 General Fund, 114581 Fire Response, 44134 FF Equipment; and, Section 3. That this Ordinance, not being of a legislative character, shall be in full force and take effect on its date of passage.

AN ORDINANCE to approve exercising both one (1) year options in an Agreement between the City of Omaha and Ameritas Life Insurance Company to provide administrative services for the City’s self-insured dental plan at a cost of $3.00 per month per covered employee that was originally approved by the City Council on November 21, 2017 by Ordinance No. 41321 with such funds to be paid from Fund No. 11111, Organization No. 118016; to provide an effective date herein. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That authority is hereby granted and approval hereby given for the exercise of the two (2) one (1) year options contained in an Agreement between the City of Omaha and Ameritas Life Insurance Company for administrative services for the City’s self-insured dental plan which three (3) year Agreement was originally approved on November 21, 2017 by Ordinance No. 41321. Section 2. That the Mayor is authorized to execute and the City Clerk to attest on behalf of the City of Omaha, any necessary paperwork needed to exercise that option for administrative services for the City’s self-insured dental plan at a rate of $3.00 per month per covered employee. Such funds to be paid from Fund No. 11111, Organization No. 118016. Section 3. That this Ordinance, not being legislative in character, shall take full force and effect upon its passage.

AN ORDINANCE (1) to approve an agreement between the City of Omaha and the YouTurn in the amount of two thousand, eight hundred eighty dollars ($2,880); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2019 Project Safe Neighborhoods Grant Award #2019-GP-BX-0056, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies as the PSN community engagement partner; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and YouTurn in the amount of two thousand, eight hundred eighty dollars ($2,880), budgeted from the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA) FY 2019 Project Safe Neighborhoods, Grant Award #2019-GP-BX-0056, to serve as the community engagement partner to District of Nebraska, Project Safe Neighborhoods (PSN) operations, is hereby approved. Section 2. That, project period extends from October 1, 2019 to September 30, 2022, commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, total expenditures as outlined in the attached agreement, from such grant funds and involving appropriations of more than one year, are hereby approved and that the Finance Director is authorized to make payment in accordance therewith. Section 3. There is no match with this grant. Section 4. That, this Ordinance, being administrative and not legislative in character, shall be in full force and take effect immediately upon passage.

ORDINANCE NO. 42383
AN ORDINANCE to amend Section 10-187 to lower the financial limits for the selection of firms being awarded contracts for professional services in architecture, engineering, land surveying, and landscape architecture; to require the submission of additional supporting material to the City Council upon award of a contract; and to amend the language about the finance department’s reporting requirement concerning professional services contracts; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Section 10-187 of the Omaha Municipal Code is hereby amended as follows:
Sec. 10-187. - Method of selection.
The method of selection of a firm for professional services shall be in accordance with the following estimated fees, as established by the department head sponsoring the project:
(a) Up to and including $100,000.00, the department head shall select the firm directly, giving consideration which shall include, but not be limited to, the following:
(1) Firms which have sufficient professional manpower to meet project schedules;
(2) Firms with a sound performance record for meeting time and budget requirements;
(3) Firms which possess and project
experience and management ability;
(4) Recent, current and projected work load with the city;
(5) Any other specialized qualification which the firms might possess to benefit the project.
(b) Above $100,000.00 but less than $250,000.00, the selection committee shall, where possible, select the three, or more at its discretion, best qualified firms in accordance with the considerations set out in subsection (a) above, and from the reply to the items set out in section 10-186. The selection committee shall rank the firms first, second, third, etc. When any professional services contract is awarded based on the recommendation of the selection committee, the recommending department shall submit the following documents to the city council with such award: (1) a list of the firms considered for the contract: (2) a statement describing why the recommended firm was selected for the contract: and, (3) the names of the selection committee members.
(c) Two hundred and fifty thousand dollars and above, the selection committee shall follow the procedure as set out in subsection (b), above, and, additionally, where possible, the three, or more at its discretion, best qualified firms shall be given a time and place for a personal interview by the selection committee. After review of submittal materials and the personal interview, the selection committee shall rank the firms first, second, third, etc. When any professional services contract is awarded based on the recommendation of the selection committee, the recommending department shall submit the following documents to the city council with such award: (1) a list of the firms considered for the contract: (2) a statement describing why the recommended firm was selected for the contract: and. (3) the names of the selection committee members.
(d) The finance department will provide the city council with a quarterly report listing all professional service contracts awarded by the city, organized by firm, including each such contract, amendment or change order, with quarterly and year-to-date dollar amounts.
Section 2. This Ordinance, being legislative in character, shall be in full force and take effect fifteen (15) days after its passage.

ORDINANCE NO. 42385
AN ORDINANCE to amend the boundaries of the ACI-4 Area of Civic Importance Overlay District, to incorporate into that district the property located southwest of 72nd and State Streets; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-609 through 55-617 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Country Club Plaza Replat 1, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned to be included in and incorporated into the ACI-4-Area of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. SPECIAL ORDINANCE NO. 10283
A SPECIAL ORDINANCE levying a special tax and assessment on all lots and pieces of real estate within Sewer Improvement District (SD) 1579, in the City of Omaha, to cover the cost of constructing public sewers, serving an area between Mason Street and Marcy Street from South 31st Street to the west approximately 250 feet, and to provide an effective date hereof. WHEREAS, it having been and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred to have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of the improvement of the sewers within SD 1579 by the City of Omaha. THEREFORE, for the purpose of paying the cost of said improvements BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the cost of SD 1579, being the installation of public sewers, and all ancillary work thereto, said cost being $386,988.31, be and the same is hereby levied and assessed according to special benefits by reason of said improvement upon the following described lots and pieces of real estate within the City of Omaha as shown by the generally recognized maps, plats, and ordinances of the City of Omaha, or by the maps, plats, and records on file in the office of the City Engineer of said City, said cost being so levied on said lots and pieces of real estate, respectively, as set forth as follows. AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Omaha Airport Authority for an operating permit for the airport at 4501 Abbott Drive, Omaha. The potential emissions, in tons, for this facility are: TSP 5.6, PM10 4.6, PM2.5 4.4, SOx 6.5, NOx 98.6, VOC 3.8, CO 35.2, Ammonia 0.7, Total HAP 0.3 and CO2 equivalent 29,397.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from December 16, 2020 to January 16, 2021. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
