The City Council of the City of Omaha will have a Pre-Council Meeting at 10:30 A.M. in the Conference Room, LC-1, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business; and a regular Council Meeting at 2:00 P.M. on Tuesday, July 13, 2021, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska. This meeting will have video conference capability. Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened. PUBLIC HEARING NOTICES
NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on July 13, 2021, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:
An ordinance levying a special tax and assessment on all lots and pieces of real estate within Road Maintenance District (RMD) 2019-08, in the City of Omaha, to cover the cost of constructing and improving Frances Street, from Mullen Road to Brookside Avenue, by asphalt overlay.
An ordinance levying a special tax and assessment on all lots and pieces of real estate within Road Maintenance District (RMD) 2019-09, in the City of Omaha, to cover the cost of constructing and improving South 91st Avenue, from Pacific Street to Hickory Street, and Poppleton Avenue from South 93rd Street to South 91st Avenue, including 92nd Circle, by asphalt overlay.
An ordinance levying a special tax and assessment on all lots and pieces of real estate within Street Improvement District (SID) 6882, in the City of Omaha, to cover the cost of constructing and improving South 79th Street, from Shirley Street north to Woolworth Avenue, and Shirley Street, from South 78th Street to South 79th Street, in Portland cement concrete.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Bread Pudding, LLC, to implement The Trio; 15th and Farnam Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located Southeast of 15th and Farnam Streets, which proposes a comprehensive rehabilitation of three buildings that will function as a single development and will ultimately contain 18 apartment units and three street level commercial spaces; the agreement authorizes the use of up to $920,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance to authorize and enter into an Agreement between the City of Omaha through the Omaha Police Department (OPD), and Behavioral Health Support Foundation and the Omaha Police Foundation, for a period from January 1, 2021 through December 31, 2024, to continue to fund the Co-Responder Program as part of the Behavioral Health and Wellness Unit (BHWU) at the Omaha Police Department.
An ordinance approving an Amendment to Agreement for Fire and Emergency Services with the Millard Suburban Fire Protection District # 1, providing that the amount paid by the Millard Suburban Fire District will be reduced from $0.136 per $100 of assessed valuation to $0.108 per $100 of assessed valuation for the remainder of the Agreement between the parties; to extend the term of the Agreement from an end date of August 21, 2027 to August 31, 2027.
An ordinance to create Section 23-537 of Chapter 23 of the Omaha Municipal Code to reflect changes negotiated between the City of Omaha and the Omaha Police Managers Association to create a six percent (6%) specialty pay for an Executive Deputy Chief of Police, designated by the Chief of Police, who shall perform administrative and supervisory duties determined by the Chief and shall act as the Chief of Police when the Chief is unavailable; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with this Ordinance shall not be applicable to those employees in Police Management.
An ordinance (1) to approve an agreement between the City of Omaha and Nebraska State Patrol in the amount of $389,668.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2020 National Sexual Assault Kit Initiative (SAKI) Grant, Award #2020-AK-BX-0029, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for two (2) Forensic Scientists dedicated to the testing of previously unsubmitted Sexual Assault Kits from the Omaha Police Department as part of the Sexual Assault Kit Initiative (SAKI) project; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.
An ordinance (1) to approve an agreement between the City of Omaha and Nebraska State Probation District 4A (Adult) in the amount of $5,985.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2019 Project Safe Neighborhoods Grant Award #2019-GP-BX-0056, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies to prevent and interrupt gun and gang violence by adult probationers in the District of Nebraska Project Safe Neighborhoods (PSN) focus area; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account.
An ordinance to amend Chapter 10, Article IV, Division 1, Section 10-110 of the Omaha Municipal Code, entitled “Rejection of bids;” by clarifying what constitutes a minor defect capable of correction after formal competitive bids have been opened.

FINAL PUBLIC NOTICE
The City of Omaha has applied for Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) funding through Nebraska Emergency Management Agency.
Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations. Under Executive Order (EO) 11988 and EO 11990, FEMA is required to consider alternatives, and to provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority and low-income populations. This notice may also fulfill requirements under Section 106 of the National Historic Preservation Act (NHPA).
Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

Special Flood Hazard Area Zone:
Work is located in a Floodway. Confirmation of location in a Special Flood Hazard Area (SFHA) was determined by the Sarpy County Flood Insurance Rate Map, Panel Number: 31153C0090H, dated 5/3/2010. The proposed work conforms to all applicable State of Nebraska and local floodplain regulations. There is a potential for the facility to be impacted by future flooding events due to its location within the floodway. The proposed work will not take place in wetlands per the United States Fish and Wildlife Service National Wetlands Inventory and will have little potential to impact or affect wetland values.
Proposed Work and Purpose:
EXISTING FACILITY:
a.) Cross Over – The existing aerial crossing over Copper Creek is located at (41.176399°, -95.997024°), it is a 90-inch steel pipe, approximately 50-feet of it is exposed. The current crossing is submerged during floods and is subject to backflow and damage from debris. There are signs of damage on the pipe due to debris collisions.
b.) Interceptor Pipe – The existing interceptor pipe is 3,000 ft long and was built within the levee prism, underneath the Keystone Trail. The existing interceptor located below the surface is a reinforced concrete pipe (RCP) that was designed with a 3-inch sacrificial concrete layer.
Closed-circuit television (CCTV) investigations showed significant signs of deterioration and corrosion. The interceptor is close to reaching its service life expectancy of 50 years (built in 1972) and its current condition is a reflection of its age.
REPAIR TO FACILITY:
a.) Cross Over – The existing pedestrian bridge over the aerial pipe would be temporarily removed during construction in order to remove the existing aerial pipe.
The new crossing of Copper Creek will be relocated approximately 200 ft upstream from the current crossing at (41.176685°, -95.996271°). The approach selected at the new Copper Creek Crossing is to construct a multi-barrel, inverted siphon in addition to relocating the interceptor outside of the levee.
b.) Interceptor Pipe – Applicant proposes to relocate the interceptor to a location outside of the levee prism to protect it from levee failure. It will be approximately 3,350 LF and 75 ft adjacent/parallel to the levee/existing interceptor location. The existing section of the interceptor would be filled with flowable fill and no longer be in use. The applicant plans on bypass pumping for approximately 18 days. Depth of excavation is approximately 14 ft deep, 3,350 ft long, and 50 ft wide for the interceptor. To access the areas of work with the necessary construction equipment and vehicles, the concrete and asphalt paths may be utilized as well as the parking lot area nearest to the levees. The parking lot may also serve as an area to stage and store materials and equipment during construction. Areas that are disturbed by the constructed improvements will be restored to their existing conditions. It is anticipated that adjacent agricultural land may incur some crop damage and/or delays in farming from the construction activities and will request compensation in advance.
Project Alternatives:
Alternative #2. Above ground aerial crossing
A second feasible alternative is relocating and constructing an aerial crossing instead of a siphon; however, since the section is restricted by existing inverts and a slope at a minimum standard, the aerial crossing would still be constructed below the 50-year flood event.
Alternative # 3. Lining the existing interceptor
Danger from debris collisions and flooding at the Copper Creek crossing still remains.
Alternative # 4. No alternative
Interceptor is almost 50 years old and continues to corrode. Danger from debris collisions and flooding at Copper Creek crossing still remains. Risk to levee and due to levee remains.

Comments are solicited from the public; local, state or federal agencies, and other interested parties in order to consider and evaluate the impacts of the proposed project.
