ORDINANCE NO. 41931
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northeast of Saddle Creek Road and Davenport Street from R3-Single Family Residential District (Medium Density) and GC-General Commercial District to CC-Community Commercial District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-2, Poppleton Park Replat 3, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from R3-Single Family Residential District (Medium Density) and GC-General Commercial District to CC-Community Commercial District. ORDINANCE NO. 41933
AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located northeast of Saddle Creek Road and Davenport Street; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1-3, Poppleton Park Replat 3, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

AN ORDINANCE to approve a PUR-Planned Unit Redevelopment Overlay District in a R5-Urban Family Residential District and CC-Community Commercial District located northeast of Saddle Creek Road and Davenport Street, to approve the Development Plan, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County, Nebraska: Lots 1-3, Poppleton Park Replat 3, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska. Section 2. The proposed Development Plan has been reviewed and evaluated pursuant to, and meets each of, the site plan criteria set forth in Section 55-885 of the Omaha Municipal Code. Section 3. AN ORDINANCE approving an Agreement between the City of Omaha, Nebraska and the following parties, to-wit: the CITY OF BELLEVUE, Nebraska; the VILLAGE OF BOYS TOWN, Nebraska; the CITY OF GRETNA, Nebraska; the CITY OF LAVISTA, Nebraska; the CITY OF PAPILLION, Nebraska; the CITY OF RALSTON, Nebraska; the COUNTY OF SARPY, Nebraska; and, the PAPIO-MISSOURI RIVER NATURAL RESOURCES DISTRICT, hereinafter being referred to collectively as "the Papillion Creek Watershed Partnership," or "the Partnership" involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended, for a five-year term commencing July 1, 2019; to designate a representative of the City of Omaha to the Partnership Executive Committee; to authorize the Finance Department to pay the cost share to the Partnership as called for in such amended agreement, including a contribution of $184,400 from the Storm Water Fee Revenue Fund 12128, Storm Water Management Organization 128026; to amend the Master Plan of the City of Omaha to incorporate plans contained within the Amended Interlocal Agreement; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby approves the Agreement between the City of Omaha, and the following parties, to-wit: the CITY OF BELLEVUE, Nebraska; the VILLAGE OF BOYS TOWN, Nebraska; the CITY OF GRETNA, Nebraska; the CITY OF LAVISTA, Nebraska; the CITY OF PAPILLION, Nebraska; the CITY OF RALSTON, Nebraska; the COUNTY OF SARPY, Nebraska; and, the PAPIO-MISSOURI RIVER NATURAL RESOURCES DISTRICT, hereinafter being referred to collectively as "the Papillion Creek Watershed Partnership," or "the Partnership," which by this reference is made a part hereof, that outlines the terms and conditions under which Omaha and the PMRNRD, will participate in the implementation of an updated regional watershed management plan for a five-year period commencing July 1, 2019. Section 2. The Finance Department is authorized to make payments to the PMRNRD for this project involving appropriations of more than one year, which is authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the Environmental Services Manager of the City of Omaha is authorized to represent Omaha on the Partnership's Executive Committee and to cast Omaha's vote on any Partnership action· items within the scope of the Partnership's mission, goals and authorized funding level as defined in the Agreement. Section 4. That the City of Omaha shall make payments to the Partnership for the City's cost share, beginning with an initial contribution of $184,400 and continuing according to the disbursement terms outlined in the Agreement, which will be paid from the Storm Water Fee Revenue Fund 12128, Storm Water Management Organization 128026. Section 5. That the Master Plan of the City of Omaha is hereby amended to incorporate the plans contained in the Agreement. Section 6. That this Ordinance, being administrative in character shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 41935
AN ORDINANCE vacating that portion of alley East of South 51st Street, between Walnut Street and Hickory Street, abutting Lots 9 through 12, Block 28 of West Side Addition, subdivision, as surveyed, platted and recorded in Douglas County; and providing the effective date hereof. WHEREAS, Neb. Rev. Stat. Section 14-375 provides that the City Council may vacate a street or alley without petition upon City Planning Board recommendation; and, WHEREAS, the Statute further provides that a Committee of Appraisers be appointed to appraise damages, if any, to property affected by the vacation; and, WHEREAS, Resolution No. 666 adopted June 25, 2019, appointed Vinny Palermo, Rich Pahls, and Pete Festersen members of the City Council, to assess damages to all property affected by the vacation; and, WHEREAS, on July 16, 2019, the Committee of Appraisers held a meeting immediately following the 10:30 a.m. staff meeting in the City Council Conference Room, Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska, at which meeting no cause for any damages was found as a result of the vacation; and, WHEREAS, the City Council finds there are no damages as a result of this vacation, and that such vacation should be approved; and, WHEREAS, Fair Market Value has been waived and none required for the conveyance of the right-of-way to be vacated. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the portion of alley East of South 51st Street, between Walnut Street and Hickory Street, abutting Lots 9 through 12, Block 28 of West Side Addition, subdivision, as surveyed, platted and recorded in Douglas County; be, and hereby is, vacated and without further act of the City, title to the vacated right-of-way shall pass to the abutting owner of said property thereof; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person. Section 2. That the property be divided as such; title of the entire portion of the alley East of South 51st Street, between Walnut Street and Hickory Street, abutting Lots 9 through 12, Block 28 of West Side Addition will be passed to the abutting property owner of 5040 Walnut Street, Mrs. Maria De Lourdes Acuna Arzaga. WHEREAS, Neb. Rev. Stat. ORDINANCE NO. 41939
AN ORDINANCE to approve a contract between the City of Omaha and the Elkhorn Public Schools for the City to provide, through its assignment, one uniformed police officer and a marked police car to the premises of Elkhorn High School, located at 711 Veterans Drive, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property each day that school is in session during the regular school year, not to exceed a 7.5 hour school day, from August 15, 2019 and ending at the close of the 2021-2022 school year. The reimbursement payment from the Elkhorn Public Schools to the City for Year 2019-2020 will begin at $81,632.46 and will not exceed $84,081.40; for Year 2020-2021 will be $84,081.40; and for Year 2021-2022 will be $84,081.40; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, in conformity with Section 5.17 of the Home Rule Charter, approval is hereby given to a three year contract, (for the 2019-2020, 2020-2021, and 2021-2022 school years) involving appropriations extending over more than one fiscal year, with Elkhorn Public Schools for the City to provide, through its assignment, one police officer. The officer's salary to be reimbursed to the City from Elkhorn Public Schools, specifically being, one uniformed police officer and a marked police car to the school premises located at 711 Veterans Drive, with a reimbursement payment to the City from the Elkhorn Public Schools in the amount beginning at $81,632.46 for Year 2019-2020 not to exceed $84,081.40; in the amount of $84,081.40 for Year 2020-2021; and in the amount of $84,081.40 for Year 2021-2022 for the officer. Section 2. That this ordinance being administrative in character shall be in full force and take effect immediately upon passage.

AN ORDINANCE to approve an Agreement between the City of Omaha and the Elkhorn Public Schools for the City to provide, through its assignment, one Associate School Resource Officer and a marked police cruiser, subject to the availability of such cruiser and Elkhorn's needs, to the premises of Elkhorn High School, located at 711 Veterans Drive, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property twenty (20) hours per week while school is in session during the regular school year, from August 15, 2019 and ending at the close of the 2019-2020 school year; reimbursement from the Elkhorn Public Schools to the City will be in the amount of $35.00 per hour for the officer, not to exceed $27,451.00; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, in conformity with Section 5.17 of the Home Rule Charter, approval is hereby given to an Agreement, (for the 2019-2020 school year) involving appropriations extending over more than one fiscal year, with Elkhorn Public Schools for the. ORDINANCE NO. 41941
AN ORDINANCE (1) to approve a professional services agreement between the City of Omaha and Dave Okada in the amount of thirty-one thousand five hundred dollars ($31,500); and (2) to authorize funding for such agreement from the City of Omaha's FY 2018 STOP School Violence Prevention Program, Award #2018-SV-WX-0045, awarded by the U.S. Department of Justice, Office of Community Oriented Policing; to provide funding for one (1) Safety and Threat Assessment Subject Matter Expert and associated training costs; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and Dave Okada in the amount of thirty-one thousand, dollars ($31,500), budgeted from the U.S Department of Justice, Office of Community Oriented Policing, FY 2018 STOP School Violence Prevention Program, Award #2018-SV-WX-0045, to provide funding for one (1) Safety and Threat Assessment Subject Matter Expert, is hereby approved. Section 2. That, the agreement extends from April 11, 2019 to September 30, 2020, commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, total expenditures as outlined in the attached agreement, from such grant funds and involving appropriations of more than one year, are hereby approved and that the Finance Director is authorized to make payment in accordance therewith. Section 3. That there is no match with this grant award. Section 4. That this ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

AN ORDINANCE to amend Sections 23-177, 23-402, 23-403, 23-404, 23-462, 23-483 of the Omaha Municipal Code to reflect changes negotiated between the City of Omaha and the Civilian Management Professional and Technical Employees Council (CMPTEC) for the years 2018, 2019, 2020, and 2021; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with this ordinance shall not be applicable to those employees in CMPTEC; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Due to the length of the effected ordinances, Omaha City Council Rule VII(B) requiring amending ordinances to recite the entire section is hereby waived solely for the purposes of Section 2 of this ordinance and only the lined out material to be deleted and the underlined material to be added shall be recited herein. Section 2. That Section 23-177 of the Omaha Municipal Code is hereby amended as follows: Sec. 23-177. Classifications and pay rates schedule. The following are the classifications and pay rates for employment with the city. A. CLASSIFICATIONS-CIVILIAN MANAGEMENT 2013 SALARIES: Effective December 23, 2012. (0 percent increase over 2012 salaries) See attached Table identified as “Attachment #1.” Each employee shall be paid a lump sum wage supplement equal to 1 percent of the employee’s 2013 non-overtime earnings for all employees that remain on the active employee payroll on March 1, 2015. This wage supplement shall not be a pensionable earning and no pension withholding or pension contributions will be made from it. 2014 SALARIES: Effective December 22, 2013. (3% percent increase over 2013 salaries) See attached Table identified as “Attachment #2.” 2015 SALARIES: Effective December 21, 2014. (2% percent increase over 2014 salaries) See attached Table identified as “Attachment #3.” 2016 SALARIES: Effective December 20, 2015. (2% percent increase over 2015 salaries) See attached Table identified as “Attachment #4.” 2017 SALARIES: Effective December 18, 2016. (2% percent increase over 2016 salaries) See attached Table identified as “Attachment #5.” 2018 SALARIES. Effective December 17. 2017 (3% increase over 2017 salaries) See attached Table identified as "Attachment #1." 2019 SALARIES. Effective December 16. 2018 (3% increase over 2018 salaries except as otherwise modified by OMC 23-462.) See attached Table identified as "Attachment #2." 2020 SALARIES. Effective December 15. 2019 (3% increase over 2019 salaries except as otherwise modified by OMC 23-462) See attached Table identified as "Attachment #3." 2021 SALARIES. Effective December 27. 2020 (2% increase over 2020 salaries except as otherwise modified by OMC 23-462) See attached Table identified as "Attachment #4." Section 3. That Section 23-402 of the Omaha Municipal Code is hereby amended as follows: Sec. 23-402. - City's contribution generally; premium. The city shall provide a group health care plan for each employee and covered dependents. Such employees may elect their health insurance coverage as follows: single coverage, single + 1 coverage, or family coverage. Employees selecting single + 1 coverage shall pay two times the single COBRA rate for their premium. Effective December 25, 2011, all current and newly hired police management, CMPTEC, AEC employees and effective 30 days after legal execution of Ordinance No. 39422, fire management, shall pay a premium for this health care plan of seven percent of the applicable COBRA rate. Effective December 15, 2019, all current and newly hired AEC and CMPTEC employees shall pay a premium for their health care plan based on the blended health care premium equivalency rate, using the experience of both active and retired civilian employees, of ten percent of the applicable COBRA rate. Effective upon adoption of the ordinance approving the agreement between the city and the Police Manager's Association for 2018 through 2021, all current and newly hired police management employees shall pay a premium for their health care plan based on the blended health care premium equivalency rate of the members of the plan to which members of the Omaha Police Officer's Association are a part of in the following amounts: Family: 23 percent; Single + 1: 23 percent; and Single: 15 percent. All employees newly hired with the city shall have a one-year waiting period on any preexisting condition(s) unless such employee presents to the city evidence that he/she had, with a previous employer, continuous health coverage without a break in service of 63 days within the last 18 months prior to his/her employment with the city. Section 4. That Section 23-403 of the Omaha Municipal Code is hereby amended as follows: Sec. 23-403. - Health care benefits. A. Health care benefits for CMPTEC until December 31, 2019, AEC until December 31, 2019, and fire management employees. (a) The health care plan provided herein shall be set forth in the master contract on file with and administered by the city's third party administrator or health insurance provider. The city shall provide employees with a written summary of the health care benefits herein. Such health care coverage shall commence on the first day of employment. (b) The health care benefits shall include, without limitation: (1) Effective June 19, 2001, comprehensive major medical health care coverage with 70 percent paid by the city and 30 percent paid by the employee on all covered charges, unless the health care services are provided by a preferred provider organization (PPO), in which case the city shall pay 80 percent and the employee shall pay 20 percent of the covered charges. (2) For CMPTEC, AEC, and fire management, a deductible of $400.00 for an individual with single coverage, $400.00/per individual with single + 1 coverage, or $800.00 aggregate for family coverage; deductible will apply to all covered services. (3) There is no maximum lifetime benefit per individual, but there remains a $20,000.00 maximum lifetime benefit for chemical dependency. (4) For CMPTEC, AEC, and fire management, stop loss (maximum cost to the employee for covered medical service in a calendar year) of $1,000.00 for a person with single coverage, $1,000.00 per individual with single + 1 coverage, or $2,000.00 aggregate for family coverage, all per year. The deductible applies to the stop loss. (5) Effective June 19, 2001, the following items shall be excluded from coverage: a) elective corrective eye surgery (such as RK, PRK, Lasik, and its successors) and b) all fertility procedures and fertility drug coverage. (6) For CMPTEC employees, AEC employees, and fire management employees, the city will institute a wellness program where the city will allow coverage up to $200.00 for each covered individual for preventative services of well-baby exams, routine physicals, school physicals, annual well woman examinations, routine colonoscopies, routine mammograms, immunizations, pap smears. Such coverage shall be handled through the city's health care provider in a manner similar to covered benefits under the health care plan, including application of any amounts to be paid against the covered individual's deductibles. After such coverage is met on any of these listed preventive services, any further preventative services are subject to the normal deductible and coinsurance under the health care plan. (7) Hospital precertification. All inpatient admissions must be certified. Planned admission, or as soon as medically possible. The penalty for failure to certify is $500.00 of in-hospital charges. The penalty for hospitalization past certified number of days is a reduction of coverage by 50 percent of both physician and hospital charges. All inpatient admissions must be precertified as above. Hospitalizations beyond the certified number of days must be recertified. If the hospitalization is recertified, there is no penalty. The penalty for hospitalization past the certified number of days is a reduction by 50 percent of both physician and hospital covered charges, which will not be paid by the city and will be the responsibility of the employee. (8) Any disputes regarding precertification or recertification in a particular case may be presented to the city's disputes committee. (9) For CMPTEC employees, and AEC employees that voluntarily participate and follow the rules of the city wellness program, they will be eligible for city-specified incentives, including but not limited to, reductions in health insurance premiums, waiving of health insurance copays for specified medical facilities, gift cards, gym memberships, etc. No employee is required to participate in the wellness program and the city maintains the absolute right to set forth the terms and conditions surrounding the program. B. Health care for police management employees. 32 (a) Police management employees will have the same high deductible healthcare plan 33 (HDHP) that is being implemented for police bargaining employees effective January 1, 34 2018. If the city negotiates a new health care plan with the Omaha Police Officers 35 Association during the term of this agreement, then the police management group will 36 have the ability to inform the city that they want to move to the same plan and the city 37 shall do so. The health care plan provided herein shall be set forth in the summary plan 38 description on file with and administered by the city's third party administrator or health 39 insurance provider. The city shall provide employees with a written summary of the 40 health care benefits herein. Such health care coverage shall commence on the first day 41 of employment. 42 (b) The health care benefits shall include, without limitation: (1) In-patient hospital precertification: All in-hospital admissions must be certified. Planned admissions must be certified in advance. Emergency admissions must be certified within 24 hours of admission or as soon as medically possible. The penalty for failure to certify is $500.00 of the hospital charges. Hospitalizations beyond the certified number of days must be recertified. If the hospitalization is recertified, there is no penalty. The penalty for hospitalization past certified number of days without recertification is a reduction by 50 percent of both physician and hospital charges. (2) Hospital certifications (and recertifications) shall be phoned in to a telephone number provided each employee on his/her I.D. card. The employee or any person on his behalf (e.g., spouse, nurse, doctor, hospital personnel) may precertify. Any disputes regarding precertification or recertification in a particular case may be presented to the city's disputes committee. (3) The health care benefit is a qualified high deductible health plan with a network component. Benefits are available for service from in-or out-of-network providers, a $2,700.00 deductible applies for single coverage and/or $5,400.00 embedded deductible for single + 1 and family coverage per calendar year. The deductible for an out-of-network provider will be twice the in-network amount. Should federal regulations require changes to the deductible or any other plan benefits, the plan will comply with said requirements. (4) The maximum lifetime benefit per plan member is unlimited. (5) Prescription coverage: A pharmacy benefit manager (PBM) manages administration of the prescription drug benefit. Prescription drug services are available from in- and out-of-network pharmacies. When an in-network pharmacy is utilized both deductible and coinsurance amounts apply to the out-of-pocket maximum. Out of network pharmacies will be handled as shown on the summary plan description on file for police bargaining and administered by the city's third party administrator. The cost will be applied to the deductible and then will be covered at 50 percent. Unless specifically required by the physician, generic drugs will be dispensed whenever possible. (6) Wellness program: Preventative services as outlined by the Affordable Care Act (ACA) are covered with no member cost sharing when received from an in-network provider. If preventative services are received from an out-of-network provider the benefit is limited to $175.00 for employee only. Members of the bargaining group who voluntarily participate and follow the rules of the city wellness program will be eligible for city-specified incentives, including but not limited to, reductions in health insurance premiums, waiving of health insurance copays for specified medical facilities, gift cards, gym memberships, etc. No employee is required to participate in the wellness program and the city maintains the absolute right to set forth the terms and conditions surrounding the program. (7) Vision program: If the Omaha Police Officer Association creates a voluntary vision program for its members that are funded entirely by the employee, the city shall work with police management in order to allow them to participate. (8) The above summary only highlights the covered benefits under the qualified high deductible health plan. For a more extensive review, consult the summary plan description provided by the city's third party administrator. (9) Health savings account (HSA). The city shall make a contribution to a HSA on behalf of the employee in the following amounts: 2018 and 2019 Single: $1,300.00 annual contribution then 75 percent city match up to $500.00 on the first $666.67 of employee contributions. The maximum cumulative city lump sum and matching contribution shall be $1,800.00. Single + 1 and Family: $2,600.00 annual contribution then 75 percent city match up to $1,000.00 on the first $1,333.33 of employee contributions. The maximum cumulative city lump sum and matching contribution shall be $3,600.00. 2020 and 2021 Single: $1,300.00 annual contribution then a 50 percent city match up to $375.00 on the first $750.00 of employee contributions. The maximum cumulative city lump sum and matching contribution shall be $1,675.00. Single + 1 and Family: $2,600.00 annual contribution then 50 percent city match up to $750.00 on the first $1,500.00 of employee contributions. The maximum cumulative city lump sum and matching contribution shall be $3,350.00. Other conditions. The city's annual HSA contribution will be contributed as a lump sum on the first pay period of the calendar year. For employees hired mid-year, the city's annual contribution will be prorated for the remaining months of the plan year. C Health care for CMPTEC and AEC employees commencing on January 1, 2020. (a) CMPTEC and AEC employees will have the same high deductible healthcare plan (HDHP) that is being implemented for Local 251 employees effective January 1, 2020. The health care plan provided herein shall be set forth in the summary plan description on file with and administered by the city's third party administrator or health insurance provider. The city shall provide employees with a written summary of the health care benefits herein. Such health care coverage shall commence on the first day of the month following employment. (b) The health care benefits shall include, without limitation: (1) Hospital Precertification - All in-patient admissions must be certified. Planned admission must be certified in advance, or as soon as medically possible. The penalty for failure to certify is $500 of the in-hospital charges, which will not be paid by the CITY and will be the responsibility of the employee. Hospitalizations beyond the certified number of days must be recertified. If the hospitalization is recertified, there is no penalty. The penalty for hospitalization past the certified number of days a reduction by 50% of both physician and hospital covered charges, which will not be paid by the CITY and will be the responsibility of the employee (2) Hospital certifications (and recertifications) shall be phoned in to a telephone number provided each employee on his/her I.D. card. After such coverage is met on any of these listed out of network preventive services, any further preventative services are subject to the normal deductible and coinsurance under the health care plan. Members of the bargaining group who voluntarily participate and follow the rules of the CITY Wellness Program will be eligible for CITY-specified incentives, including but not limited to, reductions in health insurance premiums, waiving of health insurance copays for specified medical facilities, gift cards, gym memberships, etc. No employee is required to participate in the Wellness Program and the CITY maintains the absolute right to set forth the terms and conditions surrounding the program. (7) Vision program: The CITY has created a voluntary vision program that is funded entirely by the employee. (8) The above summary only highlights the covered benefits under the qualified high deductible health plan. For a more extensive review, consult the summary plan description provided by the city's third party administrator. (9) Health savings account (HSA). The CITY shall set up Health Savings Accounts and allow employees to make voluntary contributions to the Accounts as permitted by Federal Law. The CITY shall make a contribution to a HSA on behalf of the employee in the following amounts: Single: $1,750 annual contribution. Single + 1 and Family: $3,500 annual contribution. Other conditions. The contributions to the HSA of $1,750 annually for single and $3,500 annually for single + 1 and family shall also be in effect for CMPTEC for 2021. The city's annual HSA contribution will be contributed as a lump sum on the first pay period of the calendar year. For employees hired mid-year, the city's annual contribution will be prorated for the remaining months of the plan year. (10) Active Employees who are eligible for Medicare benefits under Title XVIII of the Social Security Act due to age, disability, or end-stage renal disease on January 1 of a plan year and who are enrolled in the City's HDHP Plan, are enrolled in Medicare, and are not eligible to receive the City's contribution to a HSA account, shall receive a lump sum payment in the following amounts, depending on the coverage they have, at the same time that they receive pay for the first pay period of the calendar year: Single: $2,375 Single + 1 and Family: $4,750. This lump sum payment shall be treated as taxable income and is subject to all tax withholdings. Section 5. That Section 23-404 of the Omaha Municipal Code is hereby amended as follows: Sec. 23-404. - Prescription cards. For CMPTEC until December 31. 2019, AEC until December 31, 2019, and fire management, the city shall pay covered prescription costs through an employee "prescription card" in addition to benefits identified above. On January 1, 2020, CMPTEC and AEC will move to the qualified high deductible health care plan described in Omaha Municipal Code Section 23-403 which section describes health care and prescription drug benefits provided to CMPTEC and AEC and this section shall no longer apply to CMPTEC and AEC employees. The prescription card plan shall include the following: (a) Each employee will be issued a card which will allow the employee or covered member(s) to purchase prescriptions by paying, at the time and site of purchase and after the applicable yearly deductible has been satisfied, the following based on a tiered prescription system: (1) Generic: actual cost of the drug up to $5.00. (2) Formulary brands: 20 percent of the cost of each covered prescription (minimum $20.00, maximum $40.00). (3) Non-formulary brands: 20 percent of the cost of each covered prescription (minimum $30.00, maximum $60.00). (b) The yearly deductible shall be $100.00 for single, single plus one, or family coverage. The prescription deductible and co-insurance are separate and distinct from the health coverage deductible and co-insurance, except prescriptions dispensed in the hospital shall be applied to the health coverage deductible and co-insurance. (c) Unless specifically required by the physician, generic drugs will be dispensed whenever possible. (d) The card will be valid at the majority of pharmacies in the Omaha area; however, it is understood that some pharmacies may not participate. In order to be covered for prescription costs within the city, the employee must use a participating pharmacy. (e) After an employee has expended $750.00 (after payment of the deductible) in a given calendar year, the card will allow an employee to obtain covered prescriptions at a flat rate of $5.00 per prescription. (f) The employee percentage cost per covered prescription may be higher when prescriptions are purchased outside the city if participating pharmacies are available. Additionally, the employee may be required to pay the total cost and then seek reimbursement through a claim filing process. (g) Prescriptions required for an extended period of time (i.e., in excess of 30 days) must be ordered through the city's designated mail-order program. For a mail-order 90-day supply, the employee must pay two co-pays, pursuant to subsection (a), above. Section 6. That Section 23-462 of the Omaha Municipal Code is hereby amended as follows: Sec. 23-462. - Pay plan. The city shall provide base pay to CMPTEC employees as set forth in section 23-177. As a result of the ordinance approving a collective bargaining agreement for 2018, 2019, 2020, and 2021, the City agrees to jointly construct a wage only survey with CMPTEC, to be completed by the end of 2019, to determine the market salary range for all classifications in the bargaining group. The wage survey will include the following cities: Des Moines, IA, Kansas City, MO, Lincoln, NE, Madison, WI, Milwaukee, WI, Wichita, KS, and Oklahoma City, OK. Upon completion of the wage survey, wages for those classifications which are below the market established by the survey by 10% or greater at the top step after consideration of the negotiated wage increases of 3% each for 2018 and 2019 will be adjusted. For those positions, new pay scales will be generated reflecting minimum and maximum pay which bring the affected classifications to 97% of the midpoint of the wage survey over contract years 2019, 2020, and 2021 in increments agreed to by City Human Resources and CMPTEC. Any changes to the 2019 pay scale for these affected positions will be paid to the affected employees from October 1, 2019 to the end of the payroll year. The annual wage increases described in 23-177 for 2020 and 2021 apply to the affected CMPTEC positions, unless otherwise agreed upon by City and CMPTEC. Any classification determined by the jointly constructed wage only survey for 2019, after consideration of the negotiated wage increases of 3% each for 2018 and 2019, to be above the market by 10% or greater at the top stop will not receive the annual wage increases of 3% for 2020 and 2% for 2021 contemplated by 23-177. This change will also be shown on new pay scales which will be generated. Section 7. That Section 23-483 of the Omaha Municipal Code is hereby created as follows: Sec. 23-483. - CMPTEC Bargaining Unit. When the City of Omaha hires or promotes an employee into a CMPTEC bargaining unit position, the City shall notify and provide the employee the right to join CMPTEC and shall also notify CMPTEC that such employee was hired or promoted into a CMPTEC bargaining unit position. Section 8. This Ordinance, being legislative in character, shall be in full force and take effect on fifteen (15) days after its passage.

ORDINANCE NO. 41925
AN ORDINANCE awarding a contract to Fomento de Construcciones y Contratas, S. A. (FCC) for OPW 53407, being the Omaha Solid Waste Collections Contract 2021-2030, with an estimated annual cost of $22,691,046.00 and subject to an annual CIP increase of a maximum of 4% per year, for a ten-year term with up to two (2) five-year renewals; to provide for payments involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter, as amended; to provide for payments from a specific account; and to provide an effective date hereof. WHEREAS, bids were received on January 30, 2019 for OPW 53407, being the Omaha Solid Waste Collections Contract 2021-2030; and, WHEREAS, the Public Works Department has reviewed the bids submitted, vetted the contractors and now recommends award of the contract to FCC, being the lowest and best responsive bid received, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The contract with Fomento de Construcciones y Contratas, S. A. (FCC) for OPW 53407, being the Omaha Solid Waste Collections Contract 2021-2030, having an initial term of ten years and subject to up to two (2) five-year renewals, is approved. Section 2. That the award of this contract includes the specific services and prices for: A) a two-cart collection system, providing for comingled garbage and yardwaste to be collected weekly and recyclable materials to be collected every other week, at an estimated annual cost of $20,514,000.00, subject to an annual CPI increase capped at a maximum of 4% per year, and billed based on the actual number of households served; B) the provision of the carts to be utilized for the collection service, at a service level of two carts per household served, at an annual estimated cost of $1,991,546.00, and billed based on actual deployment of additional households or replacement carts needed in subsequent years; C) the provision of compactor trucks, rolloff containers and hook trucks for annual Spring Clean-up and Fall Clean-up events, as programmed by the City, for an estimated annual cost of $185,500.00, subject to an annual CPI increase capped at a maximum of 4% per year, and billed based on the actual number of equipment utilized; and D) the standardization of costs for extraordinary services that may be extended to households at their discretion, being a per-unit cost for Yard Waste Stickers of $1.98 and service of an extra cart (above the two-cart service level established by this contract) on a per-cart basis of $1.75, subject to an annual CPI increase capped at a maximum of 4% per year. Section 3. That the award of this contract provides for payments to FCC involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 4. That the Finance Department is authorized to make payments based on actual work performed, plus any applicable price adjustment factor, as specified in the terms of the attached bid and subsequent correction, which by this reference becomes a part hereof, through the General Fund 11111, Solid Waste Collection and Disposal Organization 116321. Section 5. That this Ordinance, being administrative in nature, shall be in force and take effect immediately upon passage.

ORDINANCE NO. 41924
AN ORDINANCE to amend Section 33-46 to change the number of permanent inhabitants needed in a single unit to exceed the established solid waste limit from eight to five; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Section 33-46 of the Omaha Municipal Code is hereby amended as follows: Sec. 33-46. - Maximum amount of waste set out for collection. (a) Each residential unit shall be limited to a maximum of five rigid containers or bags meeting the specifications for solid waste containers for collection by the city. (b) Where solid waste exceeds the amount established by this section, and such excess is not due to the failure of the city to make collections as provided herein, the public works director may require the tenant of such property or the owner or operator of the same to collect, remove and dispose of such excess; provided that such regulation shall be applicable to all such tenants, owner or operators without discrimination. However, each single unit with eight five or more permanent inhabitants will be allowed to exceed the solid waste limit established herein upon presentation to the city public works director of reasonable proof of the number of inhabitants actually residing at such residence. Such requests for the use of extra containers will be granted or denied in writing, and all granted requests shall state the exact number of solid waste containers allowed. A written statement by at least one responsible resident at the specific location, signed and notarized, shall create a rebuttable presumption that such residence is entitled to the exemption provided for herein. Such exemption shall be revoked upon evidence of a failure to properly place recyclables in bins as provided in this article. ORDINANCE NO. 41942
AN ORDINANCE awarding a contract to Formento de Construccciones y Contratas, S.A. (FCC) for OPW 53641, being the Yardwaste Collection Spring and Fall contract, with an estimated annual cost of $1,494,000.00 and subject to an annual CIP increase of a maximum of 4% per year, for a five-year term with up to one (1) additional five-year renewal period; to provide for payments involving appropriations of more than one year in accordance with Section 5.17 of the Horne Rule Charter, as amended; to provide for payments from a specific account; and to provide an effective date hereof. WHEREAS, bids were received on July 31, 2019 for OPW 53641, being the Yardwaste Collection Spring and Fall Contract; and, WHEREAS, the Public Works Department has reviewed the bids submitted, vetted the contractors and now recommends award of the contract to FCC, being the lowest and best responsive bid received, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The contract with Formento de Construccciones y Contratas, S.A. (FCC) for OPW 53641, being the Yardwaste Collection Spring and Fall Contract, having an initial term of five years and subject to up to one (1) five-year renewal, is approved. Section 2. That the award of this contract includes the specific services and prices for an 8-12 week collection period to be divided into a spring and fall period, providing for unlimited bagged yard waste to be collected weekly, at an estimated annual cost of $1,494,000.00, subject to an annual CPI increase capped at a maximum of 4% per year, and billed based on the actual number of households served; Section 3. That the award of this contract provides for payments to FCC involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 4. That the Finance Department is authorized to make payments based on actual work performed, plus any applicable price adjustment factor, as specified in the terms of the attached bid, which by this reference becomes a part hereof, through the General Fund 11111, Solid Waste Collection and Disposal Organization 116321. Section 4. That this Ordinance, being administrative in nature, shall be in force and take effect immediately upon passage.
