AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 204th and Fort Streets from AG-Agricultural District to R5-Urban Family Residential District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE to amend the boundaries of the ACI-3-Area of Civic Importance Overlay District, to incorporate into that district the property located at 10810 Harney Street; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-609 through 55-617 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 7 and the east 158 feet of Lot 8, Harney West Professional Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the ACI-3-Area of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. ORDINANCE NO. 41952
AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Midtown Crossing at Turner Park, located east of 33rd and Farnam Streets, to allow temporary signage to exceed 32 square feet and allow a three year permit, between the City of Omaha and Susan Bishop, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located east of 33rd and Farnam Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

AN ORDINANCE to approve an Amendment to the Urban Design Element of the Omaha Master Plan to include Transit Oriented Development. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Section 7.05 of the Charter of the City of Omaha allows for the City Council to adopt amendments to the City’s Master Plan as deemed necessary and appropriate upon recommendation by the Planning Board. Section 2. The Planning Board, at their July 3, 2019, public hearing, recommended approval of the proposed amendment as provided for on Exhibit “A” attached hereto and made a part hereof by this reference. Section 3. The said proposed amendment to the City’s Master Plan, as set forth in the attached Exhibit “A” is hereby approved. Section 4. That this Ordinance shall be in full force and effective fifteen (15) days from the date of its passage.

AN ORDINANCE to amend Section 23-177 of the Omaha Municipal Code by changing the title of the employment classification known as Right of Way Agent I to Real Estate Specialist I without changing the range code of 04135 ($24.64 to $30.42); to change the title of the employment classification known as Right of Way Agent II to Real Estate Specialist II without changing the salary range for the classification of 15.2MC ($55,531 to $67,871); to repeal Section 23-177 as heretofore existing; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Due to the length of the affected Ordinance, Omaha City Council Rule VII(B) requiring amending ordinances to recite the entire section is hereby waived solely for the purposes of this Ordinance and only the lined out material to be deleted and the underlined material to be added shall be recited herein. Section 2. That part E. Classifications - Civilian Bargaining Unit, subpart Engineering (04) of Section 23-177 of the Omaha Municipal Code is hereby amended by changing the name of the classification known as Right of Way Agent I to Real Estate Specialist I, Code Number 5830, with the range code 04135 ($24.64 to $30.42), remaining unchanged, as follows: Code No. 5830 Class Title Right of Way Agent I Real Estate Specialist I Pay Range 04135 ($24.64 to $30.42) Section 3. That part A. Classifications - Civilian Management, subpart Engineering (10) of Section 23 - 177 of the Omaha Municipal Code is hereby amended by changing the name of the classification known as Right of Way Agent II to Real Estate Specialist II, Code Number 1330, with the salary range of 15.2MC ($55,531 to $67,871) remaining unchanged, as follows: Code No. 1330 Class Title Right of Way Agent II Real Estate Specialist II Pay Range 15.2 MC Section 4. ORDINANCE NO. 41957
AN ORDINANCE to amend Section 23-177 of the Omaha Municipal Code concerning employment classifications by adding the employment classification entitled Real Estate Specialist III with a salary range of 18.1 MC ($64,307 to $77,541); to repeal Section 23-177 as heretofore existing; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Due to the length of the affected Ordinance, Omaha City Council Rule VII(B) requiring amending ordinances to recite the entire section is hereby waived solely for the purposes of this Ordinance and only the lined out material to be deleted and the underlined material to be added shall be recited herein. Section 2. AN ORDINANCE (1) to approve an agreement between the City of Omaha and the Women’s Center for Advancement in the amount of forty-five thousand three hundred and eighty-two dollars and sixty-two cents ($45,382.62); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2018 STOP Violence Against Women (VAWA) Grant, Award #18-VW-0708 and FY 2016 STOP VAWA Grant, Award #16-VW-0717, awarded by the Nebraska Crime Commission; to provide partial funding for one (1) full-time Client Attorney and one (1) full-time Victim Advocate, Supplies, and Indirect Costs as part of the Douglas County Community Response Team; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and the Women’s Center for Advancement in the amount of forty-five thousand three hundred and eighty-two dollars and sixty-two cents ($45,382.62), budgeted from the Nebraska Crime Commission FY 2018 STOP Violence Against Women (VAWA) Grant, Award #18-VW-0708 and FY 2016 STOP VAWA Grant, Award #16-VW-0717, for partial funding of one (1) full-time Client Attorney and one (1) full-time Victim Advocate, Supplies, and Indirect Costs as part of the Douglas County Community Response Team, is hereby approved. AN ORDINANCE (1) to approve an amendment to an agreement between the City of Omaha and the City of Portland, Oregon in the amount of nine thousand, eight hundred and thirty-eight dollars ($9,838); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2018 National Sexual Assault Kit Initiative (SAKI) Grant, Award #2018-AK-BX-0030, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to allow for funding for site visits to implement the City of Portland’s Sexual Assault Management System (SAMS) as part of the Sexual Assault Kit Initiative (SAKI) Project, and training; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. ORDINANCE NO. 41961
AN ORDINANCE to provide for approving an Interlocal Agreement between the City of Omaha and the City of Bennington, Nebraska, for more than one year, for the City Prosecutor’s Office to provide certain prosecutorial services for Bennington; and to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That in conformity with the Interlocal Agreements Act, approval is hereby given to an Interlocal Agreement between the City of Omaha and the City of Bennington, Nebraska, for the City Prosecutor’s Office to provide certain prosecutorial services for Bennington, for a term of more than one year. Section 2. That this Ordinance, not being of legislative character, shall be in full force and effect upon its passage.

ORDINANCE NO. 41958
AN ORDINANCE to approve an Agreement between CHI Nebraska d/b/a CHI Health, a Nebraska nonprofit corporation and the City of Omaha, a municipal corporation; to provide for an Employee Assistance Program (EAP) for a period of three years from June 1, 2019 through May 31, 2022 at a cost of eight dollars and six cents ($8.06) per employee per year; the Agreement provides for two one-year options; such funds to be paid from Fund 11111, Organization 105011, Account No. 42239; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is granted and hereby given for the execution of an Agreement between CHI Nebraska d/b/a CHI Health, a Nebraska nonprofit corporation and the City of Omaha, a municipal corporation to provide the establishment and operation of an Employee Assistance Program for a period of three years with two one-year options. Section 2. That the Mayor is authorized to execute and the City Clerk to attest on behalf of the City of Omaha entry into the attached Agreement between CHI Nebraska d/b/a CHI Health, a Nebraska nonprofit corporation and the City of Omaha, a municipal corporation which provides an Employee Assistance Program with the City’s expenditure being eight dollars and six cents ($8.06) per employee per year which funds are to be paid annually from Fund 11111, Organization 105011, Account No. 42239. Section 3. This Ordinance not being legislative in character shall be in full force and take effect immediately after its passage.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of American Laboratories, LLC for a renewal to their air emission operating permit for the food grade enzymes manufacturing facility at 5020 South 33rd Street, Omaha. The potential emissions, in tons, for this project will be: PM10 8.9, PM2.5 8.9, SOx 0.1, NOx 7.3, VOC 1717.4, CO 6.2 and CO2 equivalent 8,852.1.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from September 18, 2019 to October 18, 2019. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
