ORDINANCE NO. 44276
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 2861 Ellison Avenue and 5625 North 29th Street from R4(35)-Single-Family Residential District (High-Density) to R5-Urban Family Residential District.
Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: West 40 feet of Lot 34 along with North 14 feet of street vacation adjacent and the south 38.5 feet of the north 77 feet of the east 136.25 feet of the west 161.25 feet of Lot 41, Ellistone Park Place, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4(35)-Single-Family Residential District (High-Density) to R5-Urban Family Residential District.

AN ORDINANCE to approve an Agreement between the City of Omaha, a Municipal Corporation and Sampson Construction Co., Inc. for construction of the Millwork Parking Garage - OPW 54828 with a Guaranteed Maximum Price (GMP) of $26,000,000 dollars; authorizing the Mayor to sign and the City Clerk to attest the attached Agreement; funding for the agreement will come from Fund 21136 Org 116226 (Parking Construction); and providing the effective date hereof.

AN ORDINANCE to approve an Amendment to Special Pay 401 (a) Plan and Health Reimbursement Arrangement (“HRA”) for covered employees that is available to employees covered by the Collective Bargaining Agreement with the Omaha Professional Firefighters Local 385 to replace the existing matrix with a revised matrix; to provide authorization for the Mayor to execute and the City Clerk to attest her signature; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with the provisions of the Collective Bargaining Agreement shall not be applicable to those employees in the Bargaining Unit described in Article 1, Section 1, of said Collective Bargaining Agreement; and to provide the effective date hereof.

AN ORDINANCE to approve exercising up to four one-year extensions, at the same cost to the City of Omaha, in agreements between the City of Omaha and Vixen L.L.C., TMC Complete Construction, Inc., OHMS-NE-L.L.C., and B.J.’s Fleet Wash, L.L.C., respectively; the agreements were for a one-year term and were approved on April 30, 2024 by Ordinance No. 43819; the agreements were the result of bids to provide homeless encampment cleanup, on an as-needed basis, over the duration of the agreements, with the agreements being for a period of one year with up to four one-year extensions at the sole discretion of the City; and to provide an effective date hereof.

An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 2226 Howard St, LLC, to implement the Muller Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 2226 Howard Street, which proposes the construction of a new four story apartment building with 34 market rate units; the agreement authorizes the use of up to $852,814.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance to accept the bid of S2 Rolloffs LLC-DC, in the amount of $39,227.50 to provide portable chemical restroom services for various parks located throughout the City of Omaha, through December 31, 2025, with the option of three one-year term extensions.
An ordinance to approve the Interlocal Cooperation Agreement between Douglas County, Nebraska, and the City of Omaha, to facilitate cooperation with respect to the administration and implementation of assistance during SWAT operations for a period in excess of one year.
An ordinance to approve the Interlocal Cooperation Agreement between Washington County and the City of Omaha, to facilitate cooperation with respect to the administration and implementation of assistance during SWAT operations for a period in excess of one year.
An ordinance to accept the quote from Axon Enterprise, Inc. in the amount of $491,699.09 for a 72-month program for use of five (5) Axon Air Skydio drones, products, services, and warranties for the Omaha Police Department, providing a unique and non-competitive article, and as provided in Chapter 5.16 of the Home Rule Charter 1956 as amended, is hereby approved, and that, funds of $491,699.09 for a 72-month program for use of five (5) Axon Air Skydio drones, products, services, and warranties have been appropriated from the Omaha Police Department General Fund 11111, Organization 113182 Air Support Unit, Account 42266 Information Technology Contracted Services.
An ordinance authorizing the acceptance of the bids from eighteen (18) vendors for accident and violation towing services for various classes of vehicles and material for the Omaha Police Department for three years, with the option to extend on a yearly basis for two additional years, at the sole option of the City of Omaha to authorize payment from appropriations of more than one fiscal year, in accordance with the provisions of Section 5.17, Home Rule Charter of 1956, as amended; to provide for payments from a specific account.
An ordinance to establish, pursuant to Section 40-251 of the Omaha Municipal Code, a Class “B” Flammable Liquids Storage District to be known as District No. B-226 at 200 South 14th Street as requested by Mutual of Omaha.
An ordinance to amend Sections 23-222 and 23-232 of the Omaha Municipal Code to reflect changes to allow for having more than one eligibility list pending at one time in certain circumstances as determined by the Human Resources Director; to delete Section 23-233 entitled “Administrative Leave for COVID 19 pandemic after declaration of state of emergency”.
An ordinance approving a Ninth Amendment to the Agreement and Lease between the City of Omaha and Metropolitan Entertainment & Convention Authority regarding the construction and funding of an expansion to the Omaha Convention Center/Arena, a remodel and upgrade of existing convention center facilities; identifying the obligations of the City to fund $100,000,000.00 to the project; identifying various other rights and obligations of the parties.

PUBLIC NOTICE
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Douglas County Health Center for a renewal of the air emission operating permit for the Hospital at 4102 Woolworth Avenue, Omaha. The potential emissions at this facility, in tons, will be: PM10 4.3, PM2.5 3.9, SOx 10.6, NOx 42.2, VOC 2.7, CO 26.8, Ammonia 1.2, Hexane 0.5, Total HAP 0.6 and CO2 equivalent 43,950.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from June 11, 2025 to July 11, 2025. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
