Tips Sought in Scurlock Fatal Shooting Case
The Douglas County District Court has established a tip line for the grand jury investigation into the fatal shooting of James Scurlock.
Scurlock was shot last month by Jake Gardner outside an Old Market bar near 12th and Harney streets and died at a hospital. Douglas County Attorney Don Kleine declined to press charges, saying the shooting appeared to meet the criteria to be an act of self-defense.
The shooting of Scurlock, a Black man, by Gardner, a white man, was followed by allegations of racially charged language, but Kliene said that his office uncovered no audio evidence of racial motivation.
Protests since the shooting have called for Justice for James, and his is one of several people killed during the civil unrest that followed the death of George Floyd, a Black man who pleaded for air as a white Minneapolis officer jammed a knee into his neck.
Scurlock’s family called for a grand jury investigation, which Kleine supported. Justin Wayne, an attorney representing the Scurlock family, described the initial investigation into the shooting as “a rush to judgement” and later praised the court’s selection of a special prosecutor for the grand jury investigation.
Frederick D. Franklin, the special prosecutor appointed in the case, sent a news release through the court last Thursday to announce the tip line is now available to the public.
“The Special Prosecutor is particularly interested in audio and video files depicting the voices/actions of James Scurlock or Jake Gardner or anyone thought to be associated with them on the night of the shooting, May 30, 2020,” the release states.
