NOTICE OF PUBLIC HEARING
Notice is hereby given by Douglas County, Nebraska (the “County”) of a public hearing to be held at 9:00 a.m. on July 27, 2021 in Room 702 of the Omaha-Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska 68183, regarding the advisability of (1) the issuance by the County in one or more series pursuant to a plan of financing in accordance with the Nebraska Industrial Development Act, Chapter 13, Article 11, Reissue Revised Statutes of Nebraska, as amended (the “Act”), of Educational Facilities Revenue Bonds (Creighton University Projects), Series 2021A (the “Series 2021A Bonds”), to be issued in the aggregate principal amount not to exceed $55,000,000, and (2) the issuance by the County in one or more series pursuant to a plan of financing in accordance with the Act, of Educational Facilities Revenue Refunding Bonds (Creighton University Projects), Series 2021B (the “Series 2021B Bonds” and together with the Series 2021A Bonds, the “Bonds”), to be issued in the aggregate principal amount not to exceed $94,075,000.
The proceeds of the Series 2021A Bonds will be used to make a loan to Creighton University, a Nebraska nonprofit corporation and a private institution of higher education and an organization described in 501(c)(3) of the Internal Revenue Code of 1986, as amended (the “Code”), as borrower (the “Borrower”), to finance and refinance the cost of (i) the construction, preparation, equipping and furnishing of a health sciences education facility at the Borrower’s Omaha campus designed to serve as the new School of Medicine and provide shared spaces for each of the other health sciences schools, (ii) the construction, preparation, equipping and furnishing of a 400-bed suite-style residence hall for students, (iii) the renovation and refurbishment of the Borrower’s Criss Science building, and (iv) any other permissible capital project of the Borrower as permitted by the Act (collectively, the “New Money Projects”). The proceeds of the Series 2021B Bonds will be used to make a loan to the Borrower, to (i) refund and redeem $94,075,000 in aggregate principal amount of The County of Douglas, Nebraska, Educational Facilities Revenue Refunding Bonds, Series 2014 (Creighton University Projects) (the “Refunded Bonds”), which Refunded Bonds financed and refinanced the costs of various capital projects for the facilities utilized by the Borrower (collectively, the “Prior Projects” and together with the New Money Projects, the “Projects”). All of the Projects are, or will be, upon completion thereof, owned by the Borrower and located at the Borrower’s Omaha campus located generally at or near the intersection of Interstate 480 and Highway 75 in Omaha, Nebraska.
Following such public hearing, the County Commissioners will consider for adoption a resolution granting public approval relating to the issuance of the Bonds and the financing and refinancing, as applicable, of the Projects, for the purpose of complying with Section 147(f) of the Code.
The Bonds shall be limited obligations of the County, and the principal of, premium, if any, and interest thereon will be payable solely from the sources provided for in the proceedings pursuant to which the Bonds are issued. The Bonds do not constitute or give rise to a pecuniary liability of the County, nor shall the Bonds become a charge against its general credit or taxing powers.
At the time and place fixed for the public hearing, all interested persons will be given an opportunity to express their views orally or in writing on the proposed issuance of the Bonds and the location and nature of the Projects.
Persons wishing to make comments in writing about the proposed issuance of the Bonds and financing and refinancing, as applicable, of the Projects shall do so in advance of the commencement of the public hearing on July 27, 2021 to Douglas County, Nebraska, County Clerk, H08 Civic Center, Omaha, NE 68183.
