NOTICE TO CONTRACTORS
Sealed Bids for the construction of the WATER TREATMENT PLANT EXPANSION will be received, by City Of Valley, Nebraska, at the office of the Engineer, EAGLE ENGINEERING GROUP, until 10:00 AM local time on Tuesday, November 5, 2024, at which time the Bids received will be “publicly” opened and read. The Project consists of constructing a building for a 2,000 gpm water treatment facility including high service pumps, aerator, tanks, chemical feed equipment, controls, HVAC, electrical, plumbing systems to remove iron and manganese from the raw water supply.
Bids will be received for a single prime Contract. Bids shall be on a lump sum as indicated in the Bid Form.
Work under the proposed Project Contract shall be commenced within ten calendar days from the date of Notice to Proceed, and the work shall be substantially completed on or before March 1, 2026, and completed by May 1, 2026, subject to any extension of time which may be granted by the Owner.
The Issuing Office for the Bidding Documents is: A&D Technical Supply Co. Inc., 4320 S 89th Street, Omaha, Nebraska, 68127, (402) 592-4950. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8 a.m. to noon and 1 p.m. to 5 p.m., and may obtain copies of the Bidding Documents from the Issuing Office as described below.
Bidding Documents also may be examined at Lincoln Builders Bureau, Master Builders of Iowa, Omaha Builders Exchange; online at A&D Technical Supply Co. Inc. (www.adtechsupply.com); the office of the City of Valley, Nebraska 203 North Spruce Street, Valley, Nebraska, on Mondays through Fridays between the hours of 9 a.m. to 5 p.m; and the office of the Engineer, EAGLE ENGINEERING GROUP, 12100 W Center Road, Suite 803, Omaha, Nebraska 68144, Jacob Zimmerer, PE, jakez@eagleengineeringgroup.com, on Mondays through Fridays between the hours of 8 a.m. to noon and 1 p.m. to 5 p.m.
Bidding Documents may be obtained from the Issuing Office during the hours indicated above. Bidding Documents are available for download or on compact disc (as portable document format (PDF) files) for a non-refundable charge of $25.00 payable to “A&D Technical Supply Co. Inc.” Alternatively, printed Bidding Documents may be obtained from the Issuing Office either via in-person pick-up or via mail, upon Issuing Office’s receipt of payment for the Bidding Documents. The refundable cost of printed Bidding Documents is $100.00 per set, payable to “EAGLE ENGINEERING GROUP”, plus a non-refundable shipping charge. Refundable deposit shall be returned to the Bidder upon receipt of the contract documents in re-useable condition and within 14 days after award of the project. Upon Issuing Office’s receipt of payment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the prospective Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.
A pre-bid conference will be held at 11:00 am local time on Tuesday, October 22, 2024 at the Water Treatment Plant, 5002 N. 270th Street, Valley, NE 68064. Attendance at the pre-bid conference is highly encouraged but is not mandatory.
Bid security shall be furnished in accordance with the Instructions to Bidders.
This is a State Revolving Fund (SRF) funded project. As such, special requirements related to the SRF program will apply as listed herein.
DAVIS BACON ACT WAGE DETERMINATIONS: Contractors and subcontractors on USEPA federally assisted construction projects are required to pay their laborers and mechanics wages not less than those established by the U.S. Department of Labor. A current wage decision containing the appropriate building and/or heavy type rates is included in the specifications for bidding purposes.
DEBARMENT AND SUSPENSION: The prospective participants must certify by submittal of EPA Form 5700-49, Certification Regarding Debarment, Suspension and Other Responsibility Matters, that to the best of its knowledge and belief that it and its principals are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any federal department or agency.
NONDISCRIMINATION IN EMPLOYMENT: Bidders on this work will be required to comply with the President’s Executive Order No. 11246. Requirements for bidders and contractors under this order are explained in the specifications.
DISADVANTAGED BUSINESS ENTERPRISE (DBE): Each bidder must fully comply with the requirements, terms and conditions of the U.S. Environmental Protection Agency, Disadvantaged Business Enterprise (DBE) requirements, including the fair share objectives for disadvantaged business participation during the performance of this contract. The bidder commits itself to the fair share objective for disadvantaged business participation contained herein and all other requirements, terms and conditions of these bid conditions by submitting a properly signed bid.
BUY AMERICAN IRON AND STEEL PRODUCTS: On January 17, 2014, H.R. 3547, “Consolidated Appropriations Act, 2014,” was enacted. Section 436 of the Act requires that none of the appropriated funds may be used for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States, unless a waiver is provided to the recipient by EPA. Conditions for the waiver are found under the Information for Bidders. BUILD AMERICA, BUY AMERICA “On November 15, 2021, the Bipartisan Infrastructure Law (BIL) (also known as the Infrastructure Investment and Jobs Act (IIJA)) was passed. Section 70901 of Public Law 117-58, et seq., as amended, and Section 70914(a) of the IIJA require that Federal funding for infrastructure, including Wastewater Treatment and Public Water System projects, complies with the Build America Buy America (BABA) Act. Absent a waiver, all iron, steel manufactured products, and construction materials permanently incorporated into an infrastructure project receiving BIL funding, or are an SRF Equivalency project as match for Federal funding, are subject to the BABA requirements and must be produced in the United States. No Bidder shall withdraw his Bid within 30 days after the actual date of the opening thereof.
The Owner reserves the right to reject any and all bids, to waive irregularities and informalities therein and to award the Contract in the best interest of the Owner.
