Notice is hereby given that the City Council of the City of Omaha met on May 7, 2019 and passed and approved the ordinances entitled:
ORDINANCE NO. 41808
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 132nd Street and Bennington Road from AG-Agricultural District to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1 and Outlot A, Evergreen Acres, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to DR-Development Reserve District. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41809
AN ORDINANCE to amend Ordinance No. 41725, passed February 12, 2019 declaring the necessity of appropriating and acquiring certain private property for the purpose of the Exposed Sewer Channel Crossings Rehabilitation Design located at the NW corner of Blondo Street and Interstate 680 project identified as OPW 53360; to allow the City to acquire additional property needed for the project as shown on the attached Exhibit "A" plat drawings; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Section 1 of Ordinance No. 41725 is amended to read as follows: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain lands for the purpose of the Exposed Sewer Channel Crossings Rehabilitation Design located at the NW corner of Blondo Street and Interstate 680 project identified as OPW 53360, and to acquire additional property needed for the project as necessary. Said properties and lands necessary for such purposes are described as follows: See the attached Exhibit "A" plat drawings of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That Section 1 of Ordinance No. 47125 as heretofore existing is hereby repealed. Section 3. That this Ordinance shall take effect and be in force after its passage.

ORDINANCE NO. 41810
AN ORDINANCE approving an Amendment to the Redevelopment Agreement between the City of Omaha and 1234 South 10th, LLC, a Nebraska limited liability company, which was approved by City of Omaha Council Ordinance No. 40547 on November 3, 2015, to increase the original redevelopment plan area to include certain parcels located northeast of 11th and Briggs Streets and southeast of 12th and Briggs Streets for the construction of six new, for-sale row houses located, and have these parcels be a part of the Rows on South Hill Tax Increment Financing (TIF) Redevelopment Project Plan and Agreement, as amended, authorizing an additional TIF loan allocation of $652,506.00, plus accrued interest, thereby increasing the original TIF loan from $1,500,000.00 to $2,152,506.00, plus accrued interest, and revising the estimated total project cost to $14,506,027.00; and, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date, all other terms and conditions contained in the Redevelopment Agreement not amended hereby, shall remain in full force and effect. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest the attached Amendment to a Tax Increment Financing Redevelopment Agreement between the City of Omaha and 1234 South 10th, LLC, approved by City of Omaha Council Ordinance No. 40547 on November 3, 2015, for the construction of six new, for-sale row houses, and to increase the TIF loan by $652,506.00 from $1,500,000.00 to $2,152,506.00, plus accrued interest. Section 2. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Amendment to Redevelopment Agreement between the City of Omaha and the 1234 South 10th, LLC, a Nebraska limited liability company to authorize the use of up to $2,152,506.00, plus accrued interest in TIF that will be used to offset TIF eligible costs such as acquisition, site work, architectural and engineering fees, and any public improvements required. Section 3. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 4. That this Ordinance, not being legislative in character, shall take effect upon the date of its passage in accord with Section 2.12 of the Omaha Municipal Code.

ORDINANCE NO. 41811
AN ORDINANCE (1) to approve an agreement between the City of Omaha and the Women's Center for Advancement in the amount of two hundred and seventy-one thousand, one hundred and thirty dollars ($271, 130); and (2) to authorize funding for such agreement from the City of Omaha's FY 2018 National Sexual Assault Kit Initiative (SAKI) Grant, Award #2018-AK-BX-0030, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for one (1) full-time bilingual advocate, partial funding of one (1) full-time crisis counselor, partial funding for one (1) full-time advocacy/self-sufficiency manager, at the Women's Center for Advancement and training as part of the Sexual Assault Kit Initiative (SAKI) Project; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and the Women's Center for Advancement in the amount of two hundred and seventy-one thousand, one hundred and thirty dollars ($271,130); and (2) to authorize funding for such agreement from the City of Omaha's FY 2018 National Sexual Assault Kit Initiative (SAKI) Grant, Award #2018-AK-BX-0030, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for one (1) full-time bilingual advocate, partial funding of one (1) full-time crisis counselor, partial funding for one (1) full-time advocacy/self-sufficiency manager, at the Women's Center for Advancement and training as part of the Sexual Assault Kit Initiative (SAKI) Project, is hereby approved. Section 3. There is no match with this grant. Section 4. That this Ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

ORDINANCE NO. 41813
AN ORDINANCE, pursuant to Home Rule Charter Section 5.17 involving the payment of moneys from appropriations of more than one fiscal year, to enter into an Interlocal Cooperation Agreement between the City of Omaha and the City of Valley, controlling the distribution of keno lottery proceeds; to provide that the City of Valley will receive 8.75% of the gross proceeds, the City of Omaha will receive 2% of the gross proceeds for state taxes and 1 % of the gross proceeds to defray City administrative costs, and the remaining proceeds shall be retained by the City of Omaha; and to approve the Agreement from the date of execution through May 14, 2021. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The attached Interlocal Cooperation Agreement between the City of Omaha and the City of Valley, relating to the City's operation of a lottery within the City of Valley is hereby approved and the Mayor and City Clerk are authorized to execute and attest the Interlocal Agreement. Section 2. This ordinance shall be in full force and take effect fifteen days from and after its passage.

ORDINANCE NO. 41812
AN ORDINANCE to approve the Tenth Amendment to Redevelopment Agreement between the CITY OF OMAHA and THE DURHAM MUSEUM, a Nebraska non-profit corporation, formerly known as WESTERN HERITAGE SOCIETY, INC. and also formerly known as DURHAM WESTERN HERITAGE MUSEUM, a Nebraska non-profit corporation, which extends the Redevelopment Agreement approved in January, 1995, for an additional period of three years for 2019, 2020, and 2021; for the term of the Amendment, the City agrees to provide the interest, dividends, and other income derived from the excess funds, not to exceed the amount of One Hundred Thousand dollars ($100,000), generated by the partial sale of the Byron Reed Collection to THE DURHAM MUSEUM for maintenance of the remaining part of the Byron Reed Collection; the Finance Department will pay such funds that are available from Fund 15112, Org. 126038 and the remaining funds will be paid from Fund 11111, Org. 126038; and to provide an effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The Mayor of the City of Omaha shall be authorized to execute the attached Tenth Amendment to Redevelopment Agreement between the City of Omaha, a municipal corporation and THE DURHAM MUSEUM, a Nebraska non-profit corporation, formerly known as WESTERN HERITAGE SOCIETY, INC. and also formerly known as DURHAM WESTERN HERITAGE MUSEUM, a Nebraska non-profit corporation. This Amendment which extends the term of a Redevelopment Agreement originally approved in January, 1995 for three years 2019 to 2021, provides that any interest, dividends, and other income derived from the excess funds, not to exceed the amount of One Hundred Thousand dollars ($100,000), generated by the partial sale of the Byron Reed Coin Collection as described in Ordinance No. 34 792 approved December 22, 1998 will be paid to The Durham Museum in exchange for their continued maintenance of that collection.
