CITY OF OMAHA
Notice is hereby given that the City Council of the City of Omaha met on April 2, 2019 and passed and approved the ordinances entitled:
ORDINANCE NO. 41768
AN ORDINANCE to create Multiple Improvement District No. 2019-02, in the City of Omaha, for the purpose of improving two areas along South 30 Street, near Dewey Avenue, by installing storm and sanitary sewerage, addressing sidewalks and paving roadway areas; to fix and define the boundaries of said district; to provide for the determination and assessment of damages, if any, occasioned by reason of change of grade; to authorize the Public Works Department, barring protest to the contrary in accordance with OMC 26- 65, to complete the associated improvement project; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Multiple Improvement District No. 2019-02 is hereby created in the City of Omaha for the construction of public improvements within the lots identified as 518, 522, and 526 South 30th Street as well as the area within the lot identified as 524 Park Avenue. These improvements, as petitioned by the property owners, include the installation of storm sewers, sanitary sewers, sidewalks, and roadway paving. Section 2. That Multiple Improvement District No. 2019-02, shall comprise two areas along South 30 Street, near Dewey Avenue, and shall include: Lots 5-7, Block 8 together with Lot 5, Block 6, Redicks - JI - Subdivision, located in the NE 1/4 of the SE Quartersection 21-15-13. The outer boundary of said District shall be the outer boundary of the lots hereinabove set forth. Section 3 That if this project shall include a change of grade, then a committee of three freeholders shall be appointed to assess, determine and report to the City Council the damages, if any, to property owners which may be caused by grading or change of grade, if any, in said District, taking into consideration in making such appraisement, the benefits accruing by virtue of the entire improvement contemplated and set forth in this Ordinance. If any damages may be found to have accrued to any property affected, such damages may upon finding of special benefits, be assessed against the properties in the District so benefited. Section 4. That the Public Works Department is authorized to create the design for the improvements, prepare an engineer’s estimate, solicit bids and carry out other associated required actions, to complete the project for this improvement District in accordance with the Omaha Municipal Code. Section 5. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

AN ORDINANCE to create Multiple Improvement District No. 2019-03, in the City of Omaha, for the purpose of improving three areas along Park A venue and South 31st Street, between Marcy Street and Woolworth Avenue, by installing storm and sanitary sewerage, addressing sidewalks and paving roadway areas; to fix and define the boundaries of said district; to provide for the determination and assessment of damages, if any, occasioned by reason of change of grade; to authorize the Public Works Department, barring protest to the contrary in accordance with OMC 26-65, to complete the associated improvement project; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section l. The outer boundary of said District shall be the outer boundary of the lots hereinabove set forth. ORDINANCE NO. 41770
AN ORDINANCE approving an amendment to a grant award contract with the Nebraska Department of Natural Resources for the Combined Sewer Overflow (CSO) Program, involving the payment of money from appropriations of more than one year m accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to authorize the increase of grant funds received in the amount of $1,030,952.00, as outlined in the amendment; to provide for reimbursements to a specific account; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby authorizes Amendment No. 3 to the grant award contract, originally authorized by Ordinance No. 40814 on July 12, 2016, for the increase of the grant funds received from $4,775,156.00 to $5,806,108.00, an increase of $1,030,952.00, for the implementation of the Comprehensive Combined Sewer Overflow Long Term Control Plan according to the attached Amendment to the Contract, which by this reference is made a part hereof. Section 2. That such grant funds are to provide as reimbursement for actual project costs within the CSO program, involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3 That this reimbursement shall be made to the Sewer Revenue Improvements Fund 21124. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 41771
AN ORDINANCE to accept the bid from Choppers Lawn Services for grounds maintenance at the Papillion Creek Wastewater Treatment Plant in the amount of $40,000.00 for a period of one year, with sole option by the City to extend the price agreement for up to four additional one-year periods; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid from Choppers Lawn Services for grounds maintenance at the Papillion Creek Wastewater Treatment Plant in the amount of $40,000.00 annually, for a one-year term, with sole option by the City to extend the price agreement with up to four additional one-year terms, is hereby accepted. Section 2. The payments for grounds maintenance at the Papillion Creek Wastewater Treatment Plant shall be made from appropriations of more than one year in accord with Section 5.17 of the Home Rule Charter of the City of Omaha of 1956, as amended. Section 3. That the Finance Department is authorized to pay the cost of grounds maintenance at the Papillion Creek Wastewater Treatment Plant from the Sewer Revenue Fund 21121, Papillion Creek Wastewater Treatment Organization 116611. Section 4. That the City of Omaha Purchasing Agent is authorized to issue a purchase order for grounds maintenance at the Papillion Creek Wastewater Treatment Plant. Section 5. That this Ordinance, being administrative in nature, shall take effect and be in full force upon date of its passage.

ORDINANCE NO. 41772
AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing Cole Creek 204, Phase 3, project identified as OPW 53206; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of constructing Cole Creek 204, Phase 3, project identified as OPW 53206; Said property and lands necessary for such purposes are described as follows: See the attached Exhibit "A" plat drawing of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha required to be given the owners or other persons having any interest in and to any of the above described real estate may be given by either the Public Works Department or the Law Department of the City of Omaha. The Public Works Department will be responsible for recording of all deeds, easements or other acquisition documents resulting from the exercise of the authority granted under this Ordinance in the Register of Deeds Office in the appropriate county. Section 3. That this Ordinance shall take effect and be in force after its passage.

ORDINANCE NO. 41773
AN ORDINANCE to approve an Investment Advisory Services and Fee Agreement, involving the payment of funds from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended, between the City of Omaha Municipal Corporation and Advanced Capital Group, Inc. to provide services related to the City of Omaha's 457 plan for such period as is mutually beneficial to both parties; to authorize the Finance Director to make payments to Advanced Capital Group, Inc. in the annual amount of $42,500 in accordance with such Agreement from General Fund No. 11111, Org. No. 119014, Professional Fees 42239 if such fees are not paid as part of agreements by the City of Omaha's 457 Plan participants; and to provide the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. That authority is hereby given for the execution of the attached Investment Advisory Services and Fee Agreement between the City of Omaha and Advanced Capital Group, Inc. to provide services related to the City of Omaha's City's 457 plan for such period as is mutually beneficial to both parties. Section 2. That the Mayor of the City of Omaha be and hereby is authorized and empowered to execute this Agreement on behalf of the City of Omaha and the City Clerk to attest this Agreement as authorized and approved by Section 1 above. Section 3. That the Finance Director is authorized to make payment to Advanced Capital Group, Inc. in accordance with such contract from General Fund No. 11111, Org. No. 119014, Professional Fees 42239. Section 4. That this Ordinance not being legislative in character, shall take full force and effect upon its passage.

The regular monthly meeting of the Board of Trustees of the Omaha Public Library will be held on Wednesday, April 17, 2019 at 5:00 P.M. at the Benson Branch Library, located at 6015 Binney Street. AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Omaha Public Power District to modify their operating permit for the electrical generation facility at 7475 Pershing Drive, Omaha. There will be no change in potential emissions due to this permit modification.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from April 10, 2019 to May 10, 2019. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
