Notice is hereby given that the City Council of the City of Omaha met on August 30, 2022 and passed and approved the following ordinances:
ORDINANCE NO. 43066
AN ORDINANCE proposing amendment to Section 2.07 of the Home Rule Charter of the City of Omaha, 1956, as amended, to change the process for determining if a Mayor is disabled and unable to perform the Mayor’s duties from one which requires the appointment of a medical committee to a process that is similar to the process outlined in the United States Constitution where the ultimate determination is made by a two-thirds majority of the City Council; to provide for the submission of the proposed amendment to the qualified electors of the City of Omaha for their approval or rejection at the General Election to be held on November 8, 2022; to repeal Section 2.07 of the Home Rule Charter of the City of Omaha as heretofore existing; and to provide the effective date hereof.

ORDINANCE NO. 43071
AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located at 4837 North 90th Street; and to provide for an effective date.
Summary: In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: LOT 7 - EX PT FOR 90 ST & N 100.61 FT- IRREG, Irvington Industrial, a Subdivision as surveyed, platted and recorded in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the 5B Street Project, South 38th Street from Hascall Street to Grover Street, identified as OPW 53976; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof.

AN ORDINANCE rescinding Ordinance No. 41242, passed on September 12, 2017 approving a Tax Increment Financing (TIF) Redevelopment Agreement with Alchemy Development, LLC, a Nebraska limited liability company, and subsequent amendments, to implement the Zone 6 Apartments at Aksarben Village Tax Increment Financing (TIF) Redevelopment Project Plan for the redevelopment site located at 6460 Frances Street and 6465 Shirley Street which proposed the new construction of two, five-story multi-family structures containing a total of 108 market-rate units, later amended to 124 market-rate units, with a total of 136 parking stalls available to the residential tenants, and providing for an effective date.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Metropolitan Utilities District for an operating permit renewal for the potable water treatment facility at 2710 Grebe Street, Omaha. The potential emissions, in tons, for this facility are: TSP 41.8, PM10 41.7, PM2.5 41.7, SOx 0.2, NOx 80.0, VOC 12.4, CO 13.8, Acrolein 0.1, Formaldehyde 0.7, MTBE 1.4, Toluene 2.4, Xylene 1.5 and CO2 equivalent 3,822.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from September 7, 2022 to October 7, 2022. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
