NOTICE
Notice of Duty of all property owners, agents, occupants or persons in possession of property to cut weeds, grass and worthless vegetation and not to litter or to cause or allow litter, including vehicular litter, to be deposited thereon or to allow such litter to remain on such property other than in proper receptacles provided thereof; further notice of duty of all property owners not to park or store any vehicle or machine on residential property in violation of any Municipal Law, State Statute, or Federal Law.
Notice is hereby given that Chapter 18, of the Omaha Municipal Code requires owners, agents, occupants or persons in possession or control of any lot or ground, or part thereof, in the City to cut and clear such property together with one-half (1/2) of the streets and alleys abutting thereon of all weeds, grass and worthless vegetation which has reached the height of twelve (12) inches or more.
Such weeds, grass and worthless vegetation must be cut as close to the ground level as possible and shall be so maintained that the same do not extend twelve (12) inches or more above the ground at any time and such cutting shall be raked and removed from such premises.
Notice is also hereby given that Charter 18, of the Omaha Municipal Code as amended requires owners, agents, occupants or persons in possession or control of any lot or ground, or part thereof, in the City of Omaha not to litter or to cause or allow litter (as defined in said Ordinance) to be deposited thereon or to allow to remain on such property, other than in proper receptacles provided therefore.
Notice is further given that it shall be unlawful for a person who owns or who is in control any property to fail or refuse to keep such property free of litter, to prevent litter from being carried or deposited by the elements beyond such property or to allow litter to remain on such property.
Notice is further given that it shall be unlawful for any person who owns or is in control of any property to place, cause to be placed, or allow to remain on his property any Vehicular litter or any vehicle or vehicles or parts thereof which are as set forth in Section 18-21 of said Ordinance, provided, however, that said Section shall not apply to any vehicle which qualifies as an historic or special interest vehicle as defined in Sections 60.311.15 through 60.311.20 Revised Statues of Nebraska, 1943, as amended, or to any Vehicle which is kept in the operation of a business pursuant to any Municipal Ordinance or is kept within a garage.
Notice is further given that it shall be unlawful for any person to park or store any vehicle, machine, or parts thereof in violation of the Municipal Code, State Statutes or Federal Law. Notice is further given that whenever the City and through its authorized Representative determines that any litter as defined in Section 18-21 or other condition prohibited by the Chapter 18 of the Omaha Municipal Code, causes imminent danger to public health, safety or welfare, it may remove such litter or remedy such conditions, at the expense of the owner of the land on which such litter is found.
Furthermore, if the owners agents, occupants or persons in possession or control of any such property shall fail to so cut and clear said property as above described, the City may cause such weeds, grass and worthless vegetation to be cut or sprayed or such litter to be removed or any combination thereof, and assess the actual cost thereof in amounts as determined by Resolution of the City Council during the month of April each year upon the property in the same manner as special assessments and shall have the right to continue cutting such weeds at anytime after the dates provided until new growth of the following year.
Furthermore, in addition to the payment of the actual cost as provided in section 18-28 and the penalty for violations provided in section 18-30 hereof, any person, firm or corporation who fails to cut weeds, grass and worthless vegetation, or to remove litter, or both, as required by this Chapter shall be subject to the following penalties:
For the first violation a penalty in the sum of Seventy-Five Dollars ($75.00) will apply. For the second violation at the same location a penalty in the sum of One Hundred-Fifty Dollars ($150.00) will apply. For the third or more violation a penalty in the sum of Three Hundred Dollars ($300.00) will apply unless, if within 24 months of two prior violations, a penalty in the sum of Five Hundred Dollars ($500.00) will apply.
In the event any person, firm, or corporation fails to pay the cost of the penalty as above provided, the City may assess the same upon the property in the same manner as special assessments or the City may sue any such person or persons in any court of competent jurisdiction for the amount of the penalty due and payable under the terms and provisions of this Chapter and may recover a judgment against such person or persons for the amount so due, together with interest.
In addition to the penalties above set forth, any person who violates any of the provisions of Chapter 18, of the Omaha Municipal Code is deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in any sum not to exceed Five Hundred Dollars ($500.00) or to be imprisoned not to exceed six (6) months in jail or any combination of such fine and imprisonment for each offense in the discretion of the Court.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Watco Mechanical Services for a renewal of their air emission operating permit for the railcar repair facility at 13810 “L” Street, Omaha. The potential emissions at this facility, in tons, will be: TSP 65.1, PM10 35.6, PM2.5 11.0, VOC 98.0, individual HAP 9.0 and total HAP 24.0.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from March 18, 2020 to April 18, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application. ORDINANCE NO. 42166
AN ORDINANCE to approve a Mixed Use District Development Agreement for property located southwest of 204th Street and Honeysuckle Drive between the City of Omaha and Aldrich Holdings, LLC, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located southwest of 204th Street and Honeysuckle Drive is developed in accordance with the provisions of the Mixed Use District Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. AN ORDINANCE approving an amendment to a grant award contract with the Nebraska Department of Natural Resources for the Combined Sewer Overflow (CSO) Program, involving the payment of money from appropriations of more than one year m accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to authorize the increase of grant funds received in the amount of $1,086,503.30, as outlined in the amendment; to provide for reimbursements to a specific account; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby authorizes Amendment No. 4 to the grant award contract, originally authorized by Ordinance No. 40814 on July 12, 2016, for the increase of the grant funds received from $5,806,108.00 to $6,892,611.30, an increase of $1,086,503.30, for the implementation of the Comprehensive Combined Sewer Overflow Long Term Control Plan according to the attached Amendment to the Contract, which by this reference is made a part hereof. Section 2. That such grant funds are to provide as reimbursement for actual project costs within the CSO program, involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That this reimbursement shall be made to the Sewer Revenue Improvements Fund 21124. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

AN ORDINANCE to transfer a permanent easement in land to Metropolitan Utilities District of Omaha, a municipal Corporation and a Political Corporation, for purposes of relocating facilities, and appurtenances thereto, upon City-owned property located near Tranquility Park, north of 120th & West Maple Road; to authorize the Mayor to execute the attached Right-of-Way Easement; and to provide an effective date thereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, notwithstanding the procedure outlined in Section 27-51 to 27-75 of the Omaha Municipal Code will transfer to the Metropolitan Utilities District of Omaha, a municipal Corporation and a Political Corporation, a permanent easement to the extent it has any interest in the following piece of property. Section 2. That the Mayor of the City of Omaha shall be authorized to execute the permanent easement attached to this Ordinance.
Section 3. That this ordinance shall be in full force and take effect on the date of its passage.

AN ORDINANCE to amend Section 23 - 177 of the Omaha Municipal Code concerning employment classifications by adding the employment classification entitled Vision Zero Coordinator with a salary range of 16.1 MC ($64,813 to $77,771); to repeal Section 23 - 177 as heretofore existing; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Due to the length of the affected Ordinance, Omaha City Council Rule Vll(B) requiring amending ordinances to recite the entire section is hereby waived solely for the purposes of this Ordinance and only the lined out material to be deleted and the underlined material to be added shall be recited herein. Section 2. That Part A Classifications - Civilian Management, subpart Engineering (1 O) of Section 23 - 177 of the Omaha Municipal Code is hereby amended by adding the classification entitled Vision Zero Coordinator, Code Number 1450, pay range 16.1 MC which has a salary range of $64,813 to $77,771, as follows:

SPECIAL ORDINANCE NO. 10275
A Special Ordinance to approve the Omaha Downtown Improvement District Association (ODIDA) 2020-2021 Budget and Workplan and levying a special tax and assessment on all lots and pieces of real estate within Business Improvement District No. 6874 in the City of Omaha in the amount of $559,791.94 such assessment shall cover the costs anticipated by the Business Improvement District for March 2020 to February 2021 and contemplated by Ordinance No. 37504 which was approved by the City Council of the City of Omaha on October 3, 2006, and reauthorized by Ordinance No. 38957 approved on March 8, 2011 and amended by Ordinance No. 41463 approved on April 26, 2018; and to provide an effective date therein. WHEREAS, it having been, and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred will each specially benefit to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of the improvements contemplated in Ordinance No. 37504, passed October 3, 2006, which established Business Improvement District No. 687 4 for purposes of maintenance and cleaning, public activity and promotion, and management and operations, Ordinance No. 38957 passed March 8, 2011, and Ordinance No. 41463 passed on April 26, 2018, within the Business Improvement District from March 2019 to February 2020. THEREFORE, for the purpose of paying for the cost of said improvements. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the attached Omaha Downtown Improvement District Association (ODIDA) 2020/2021 Budget and Workplan which details the work to be done in Business Improvement District No. 6874 from March 2020 to February 2021 as described in Exhibit “A” attached hereto, which has been adopted as the Work Plan for said Business Improvement District is hereby approved. Section 2. That the cost of the Budget and Workplan for Business Improvement District No. 6874 for March 2020 to February 2021, said cost being the sum of $559,791.94 ($502,025.44) of such cost being levied pursuant to Ordinance No. 41463, an additional $38,511.00 being assessed against the property of Union Pacific Railroad Company voluntarily as it is centrally assessed, and an additional $19,255.50 being assessed to the Metropolitan Entertainment & Convention Authority), be and hereby is levied and assessed according to benefits by reason of said improvements, upon the following described lots and pieces of real estate within the City as shown by the generally recognized maps, plats and ordinances of the City of Omaha, or where the maps, plats and records on file in the office of the City Engineer of said City; said costs being levied on said lots and pieces of real estate respectively. Section 3. That said special taxes levied aforesaid on said lots respectively, shall become delinquent fifty days from the passage and approval of this Ordinance. Each assessment shall draw no interest from the time of the levy aforesaid, until the same shall become delinquent. Interest at the rate of fourteen percent per annum, as provided by State law, payable in advance, shall be paid on each delinquent assessment. Section 4. That the entire amount of tax so levied and assessed on any of said lots may be paid by any person on any part of said lots within fifty days from said levy and, thereupon, said lots or parts of lots shall be exempt from any lien or charge thereto. Section 5. That the City Council of the City of Omaha hereby approves the Omaha Downtown Improvement District Association 2020/2021 Budget & Workplan presented by the Omaha Downtown Improvement District Association (ODIDA) and Business Improvement District No. 6874 which requests approval for the work contemplated by this Ordinance. Section 6. That this Special Ordinance shall take effect fifteen (15) days after its passage and be in force thereafter.

To the owners of all lots, lands, tracts, and parcels of land within proposed Street Improvement Project No. 2019-05, and to all owners of property abutting on and adjacent to Poppleton Avenue, from South 78th Ave to South 78th Street:
Notice is hereby given that there has been filed with the City Clerk of the City of Omaha a petition for the improvement of Poppleton Avenue, from South 78th Ave to South 78th Street by grading, curbing, and paving in Portland cement concrete, as well as addressing storm drainage, according to City Specification.
We, the undersigned, owners of lots or lands abutting upon that part of Poppleton Avenue, from South 78th Ave to South 78th Street in proposed Street Improvement Project No. 2019-05 in the City of Omaha, being record owners of a majority of the feet frontage on said part of said street, as shown by the generally recognized maps of said city, do hereby petition that the same be improved by grading, curbing, and paving in Portland cement concrete.
