AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Metropolitan Utilities District for a renewal of their air emission operating permit for the Propane Storage and Construction Yard Facility at 3100 South 61st Avenue, Omaha. The potential emissions, in tons, for this project will be: PM 2.1, PM10 2.0, PM2.5 2.0, SOx 0.1, NOx 31.6, VOC 7.5, CO 20.3, Ammonia 0.1, Manganese 0.1, Total HAP 3.9 and CO2 Equivalent 26,084.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from February 5, 2020 to March 5, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application. ORDINANCE NO. 42117
AN ORDINANCE awarding a contract to FCC Environmental Services Nebraska, LLC for OPW 53624, being the Omaha Mixed Recyclables Processing 2021-2026 Project, Bid Package B, Alternate 1, with an estimated annual cost of $312,400.00, for a five-year term with up to three (3) five-year renewals; to provide for payments involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter, as amended; to provide for payments from a specific account; and to provide an effective date hereof. WHEREAS, bids were received on October 23, 2019 for OPW 53624, being the Omaha Mixed Recyclables Processing 2021-2026 Project.; and, WHEREAS, the Public Works Department has reviewed the bids submitted, vetted the contractors and now recommends award of the contract Bid Package B, Alternate 1, to FCC Environmental Services Nebraska, LLC, being the lowest and best responsive bid received, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The contract with FCC Environmental Services Nebraska, LLC for OPW 53624, being the Omaha Mixed Recyclables Processing 2021-2026 Project, having an initial term of five years subject to up to three (3) five-year renewals, is approved. Section 2. That the award of this contract includes the specific services and prices for Bid Package B, Alternate 2, which is for Recycling Drop Off Site Operation, Contractor Supplied. Section 3. That the award of this contract provides for payments to FCC involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 4. That the Finance Department is authorized to make payments based on actual work performed, plus any applicable price adjustment factor, as specified in the terms of the attached bid and subsequent correction, which by this reference becomes a part hereof, through the General Fund 11111, Solid Waste Collection and Disposal Organization 116321. Section 5. That this Ordinance, being administrative in nature, shall be in force and take effect immediately upon passage.

ORDINANCE NO. 42118
AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 424 S. 24TH STREET, LLC, a Nebraska limited liability company, to implement the Garage Lofts Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 424 South 24th Street, which proposes the demolition of existing structures on the site and new construction of a three-story, affordable, multi-family housing structure with the assistance of TIF and low-income housing tax credits; the agreement authorizes the use of up to $230,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and 424 S. 24TH STREET, LLC, a Nebraska limited liability company, to authorize the use of up to $230,000.00, plus accrued interest, to offset TIF eligible expenses, as allowed by the Community Redevelopment Law, for public improvements such as streetscaping and right-way-dedication, and also site work, for a project with total estimated costs of $6,045,444.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and 1701, LLC d/b/a/ Habitat for Humanity of Omaha, a Nebraska limited liability company to authorize the use of up to $269,500.00, plus accrued interest, to offset TIF eligible costs such as acquisition, demolition, site preparation, architectural and engineering fees, and public improvements as required, for a project with total estimated costs of $2,647,524.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. AN ORDINANCE (1) to approve an agreement between the City of Omaha and Nebraska State Probation District 4A (Adult) in the amount of eight thousand, three hundred thirty-four dollars ($8,334); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2018 Project Safe Neighborhoods Grant Award #2018-GP-BX-0012, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies to prevent and interrupt gun and gang violence by adult probationers in the District of Nebraska Project Safe Neighborhoods (PSN) focus area; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and Nebraska State Probation District 4A in the amount of eight thousand, three hundred thirty-four dollars ($8,334), budgeted from the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA) FY 2018 Project Safe Neighborhoods, Grant Award #2018-GP-BX-0012, to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies to prevent and interrupt gun and gang violence by adult probationers in the District of Nebraska Project Safe Neighborhoods (PSN) focus area, is hereby approved. AN ORDINANCE to approve a contract between the City of Omaha and Omaha Public Schools for the City to provide, through its assignment, one uniformed police officer and a marked police car to the premises of South High School located at 4519 South 24th Street, North High School located at 441 O North 36th Street, Benson High School located at 5120 Maple Street, Blackburn Alternative School located at 3030 Spaulding Street, Central High School located at 124 North 20th Street, Northwest High School located at 8204 Crown Point, Monroe Middle School located at 5101 Bedford Avenue, Norris Middle School located at 2235 South 46th Street, McMillan Magnet Center located at 3802 Redick Avenue, and Burke High School located at 12200 Burke Boulevard; and one uniformed K-9 certified police officer as a School Resource Officer and a canine to be available at any of the School District’s High Schools, Middle Schools, or Alternative Schools, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work within the District each day that school is in session during the regular school year, or as otherwise directed by the school principal, not to exceed a 7.5 hour school day, from the first day of the semester of August, 2019, and expiring on July 31, 2022; reimbursement from the Omaha Public Schools to the City for Year 2019-2020 will begin at $897,957.06 and will not exceed $924,895.40; for Year 2020-2021 will be $924,895.40; and for Year 2021-2022 will be $924,895.40, in addition to Omaha Public Schools being responsible for other costs related to the canine; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, in conformity with Section 5 .17 of the Home Rule Charter, approval is hereby given to a three year contract (for the 2019-2020, 2020-2021, and 2021-2022 school year) involving appropriations extending over more than one fiscal year, with Omaha Public Schools for the City to provide, through its assignment, ten police officers and one uniformed K-9 certified police officer as a School Resource Officer and a canine. The officers’ salary to be reimbursed to the City from the Omaha Public Schools, specifically being, ten uniformed police officers and marked police cars to the school premises located at 4519 South 24th Street, 4410 North 36th Street, 5120 Maple Street, 3030 Spaulding Street, 124 North 2Qth Street, 8204 Crown Point, 5101 Bedford Avenue, 2235 South 46th Street, 3802 Redick Avenue, and 12200 Burke Boulevard, and one uniformed K-9 certified police officer as a School Resource Officer and a canine to be available at any of the School District’s High Schools, Middle Schools, or Alternative Schools, with a reimbursement to the City from the Omaha Public Schools in the amount beginning at $897,957.06 for Year 2019-2020 not to exceed $924,895.40; in the amount of $924,895.40 for Year 2020-2021; and in the amount of $924,895.40 for Year 2021-2022 for the ten officers and K-9 SRO with Omaha Public Schools being responsible for some costs of care of the canine. AN ORDINANCE to approve an Agreement between the City of Omaha and Omaha Public Schools for the City to provide, through its assignment, up to eleven Associate School Resource Officers and marked police cruisers, subject to the availability of such cruisers and the School District’s needs, to specifically designated locations, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work within the District with each Associate School Resource Officer working no more than 28 hours per week while school is in session during the regular school year, from the first day of the semester of August, 2019 and ending on July 31, 2020; reimbursement from the Omaha Public Schools to the City will be in the amount of $35.00 per hour for each officer for the 2019-2020 school year; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, in conformity with Section 5.17 of the Home Rule Charter, approval is hereby given to the attached Agreement (for the 2019-2020 school years) involving appropriations extending over more than one fiscal year, with Omaha Public Schools for the City to provide, through its assignment, up to eleven Associate School Resource Officers. AN ORDINANCE levying a special tax assessment for cutting and clearing weeds, grass and worthless vegetation in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha. WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereafter referred to, have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of cutting and clearing weeds, grass and worthless vegetation thereon, by the City of Omaha. THEREFORE, for the purpose of paying the incurred cost of weed, grass and worthless vegetation cutting work. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1.
