ORDINANCE NO. 42413
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest and northeast of 19th Street and Saint Mary’s A venue from OS-Downtown Service District to CBD-Central Business District (property is located within an ACI-1-Areas of Civic Importance Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 8 through 18, Block 3, E. Kountzes Reserve Replat, and Lots 7 and 8 and the south 88.93 feet of Lot 9, Block 2, E. Kountzes Reserve, subdivisions as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from OS-Downtown Service District to CBD-Central Business District (property is located within an ACI-1-Areas of Civic Importance Overlay District).; and Section 2. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: The south 137.5 feet of Lot 2, Block 11, Smiths Addition, and the northeast 276 square feet triangle of Lot 17, Lot 18 - excluding the southwest 485 square feet and north 15 square feet of vacated street on the west, and Lots 19 and 20, Block 20, Highland Place, subdivisions as surveyed, platted and recorded in Douglas County, Nebraska are hereby rezoned from GC-General Commercial District to NBD-Neighborhood Business District (property is located in an ACI-1 Overlay District). AN ORDINANCE to transfer a permanent easement in land to Metropolitan Utilities District of Omaha, a Municipal Corporation and a Political Corporation, for purposes of relocating facilities, and appurtenances thereto, upon City-owned property located near South 68th Street between Mercy Road and West Center Road; to authorize the Mayor to execute the attached Right-of-Way Easement; and to provide an effective date thereof. ORDINANCE NO. 42416
AN ORDINANCE approving a bid for a Purchase Order to Dale’s Trash Service, Inc. dba Port-A-Johns for Trash Collection Services for City-Owned Receptacles submitted through Douglas County Purchasing Department on November 18, 2020, with an annual estimated cost of $115,641.00 for a three (3) year price agreement total of $346,923.00 with the option to extend for an additional two (2), one (1) year extensions upon agreement by both parties; involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and, to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid from Dale’s Trash Service, Inc. dba Port-A-Johns for Trash Collection Services for City-Owned Receptacles, based on the bid submitted to Douglas Country Purchasing on November 18, 2020 with an annual estimated cost of $115,641.00, be awarded for a three (3) year term totaling $346,923.00 with the option of two (2), one (1) year extensions. Section 2. That payments for Trash Collection Services for City-Owned Receptacles, involving appropriations of more than one year, are authorized in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the cost of Purchase Orders for repairs shall be paid through the General Fund 11111, Solid Waste - Collect & Disposal Organization 116321. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 42417
AN ORDINANCE to accept the bid from Tab Holding Co., Inc., d/b/a TAB Construction, for OPW 53978, being the Omaha Traffic Maintenance Facility Site Improvements - Phase I Project, in the amount of $279,799.53, to approve appropriations of more than one year in accordance with Section 5 .1 7 of the Home Rule Charter of 19 5 6, as amended; to provide payments from a specific account in the amount of $279,799.53, and to provide an effective date hereof. WHEREAS, bids were received on November 18, 2020, for OPW 53978, being the Omaha Traffic Maintenance Facility Site Improvements - Phase I Project.; and, WHEREAS, the Public Works Department has reviewed the bid submitted and recommends award of the contract to Tab Holding Co., Inc., d/b/a TAB Construction in the amount of $279,799.53, being the lowest and best bid received. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the contract with Tab Holding Co., Inc., d/b/a TAB Construction for OPW 53978, being the Omaha Traffic Maintenance Facility Site Improvements - Phase I Project, is approved. Section 2. That the award of this contract involves appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the Finance Department is authorized to make payments for OPW 53978, being the Omaha Traffic Maintenance Facility Site Improvements - Phase I Project, in the amount not to exceed $279,799.53, which shall be made from the Sewer Revenue Improvement Fund 21124, CSO Control Implementation Organization 116918; year 2020 encumbrances in the amount of $225,000.00, and year 2021 encumbrances in the amount of $54,799.53. Section 5. That this Ordinance, being administrative in nature, shall take effect and be in full force upon date of its passage.

AN ORDINANCE to accept the bid of Abe’s Trash Service, Inc. to provide rubbish container services for the Omaha Fire Department, including all fire stations, the Public Education Office (Station 10), the Public Safety Training Center, and the Technical Services Division building, for a term of 12 months at a total cost of $21,138.00, with the option to extend the agreement for an additional two years; and to provide an effective date hereof; WHEREAS, Abe’s Trash Service, Inc. submitted a bid of $21,138.00 to provide rubbish container services for the Omaha Fire Department for 12 months with the option to extend the agreement for an additional two years; and, WHEREAS, the bid of Abe’s Trash Service, Inc., in the amount of $21,138.00 to provide rubbish container services for the Omaha Fire Department, was the lowest and best bid that met or exceeded specifications and is attached hereto and by this reference made a part hereof; and, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1.That the attached bid of Abe’s Trash Service, Inc., involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha 1956 as amended, in the amount of $21,138.00 for the purchase of rubbish container services for the Omaha Fire Department, in accordance with the attached specifications, for 12 months with the option to extend the agreement for an additional two years, is hereby accepted, and the Mayor of the City of Omaha is authorized to execute any further agreement that may be necessary to implement such a bid; and, Section 2. AN ORDINANCE to approve an Interlocal Agreement between the City of Omaha and the City of Papillion, Nebraska, for more than one year, for the City of Omaha, on behalf of the Eastern Nebraska Clean Energy Assessment District, to administer portions and undertake certain duties of the City of Papillion Clean Energy Assessment District and Papillion’s PACE program; and to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, in accordance with the provisions of the Interlocal Agreement attached hereto and made a part hereof by reference, and the Interlocal Cooperation Act, the City of Omaha, on behalf of the Eastern Nebraska Clean Energy Assessment District, and the City of Papillion desire to approve the administration of portions and undertake certain duties of the City of Papillion Clean Energy Assessment District and Papillion’s PACE program. Section 2. The Interlocal Agreement between the City of Omaha and the City of Papillion, Nebraska, for a term of more than one year, is hereby approved. Section 3. That this Ordinance, not being of legislative character, shall be in full force and effect upon its passage.

FINAL PUBLIC NOTICE
The City of Omaha has applied for Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) funding through Nebraska Emergency Management Agency (NEMA) as a sub- recipient.
Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations. Under Executive Order (EO) 11988 and EO 11990, FEMA is required to consider alternatives, and to provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority and low-income populations. This notice may also fulfill requirements under Section 106 of the National Historic Preservation Act (NHPA).
Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

Special Flood Hazard Area Zone:
All work is located in an AH Floodzone. Confirmation of location in a Special Flood Hazard Area (SFHA) was determined by the Sarpy County Flood Insurance Rate Map, Panel Number: 31153C0230G, dated 12/02/2005. The proposed work conforms to all applicable State of Nebraska and local floodplain regulations. There is a potential for the facility to be impacted by future flooding events due to its location within the AH floodzone. The proposed work is located near wetlands per the United States Fish and Wildlife Service National Wetlands Inventory, however, the project has little potential to impact or affect wetland values.
Proposed Work and Purpose:
The Papillion Creek Water Resources and Recovery Facility was inundated with floodwaters from the nearby confluence of the Missouri and Platte Rivers and damaged capacitor banks, switchgear, switchboards, generators and transformers. The Sub-Applicant is proposing to replace and elevate the equipment by placing the equipment on top of concrete pads to prevent future damage.
Project Alternatives:
Alternative #1 (No action): Would implement flood protection measures on specific equipment. While this will allow plant managers to improve particularly vulnerable and/or critical pieces of equipment for flood protection measures, it will not uniformly apply 450-year protection to all the PCWRRF electrical equipment. Public safety would be lowered, and costs would continue to be incurred in flood events. A “no-action alternative” would leave the PCWRRF highly vulnerable to repeated damages and service disruption from overtopped levees. Without flood protection measures at a minimum, the plant’s ability to discharge treated effluent into the river when at high flood stages is at risk, potentially hydraulically forcing partially treated water to be discharged within the site. Environmental and public safety risks also remain.

Comments are solicited from the public; local, state or federal agencies, and other interested parties in order to consider and evaluate the impacts of the proposed project.
