Notice is hereby given that the City Council of the City of Omaha met on February 10, 2026 and passed and approved the following ordinances:

 

ORDINANCE NO. 44585

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 5073 Kansas Avenue from DR-Development Reserve District to R5-Urban Family Residential District.                                                                                                            

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 5, Block 6, Brighton, a subdivision in Douglas County, Nebraska, is hereby rezoned from DR-Development Reserve District to R5-Urban Family Residential District.

ORDINANCE NO. 44586

Summary: The official zoning map adopted by Section 5 5-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 3, Cedarnole Replat 5, in Douglas County, Nebraska, is hereby rezoned from GC-General Commercial District and TOD-1-MX-Transit Oriented Development District-Mixed Use to TOD-1-MX-Transit Oriented Development District-Mixed Use.

ORDINANCE NO. 44588

AN ORDINANCE to rescind the ACI- Areas of Civic Importance Overlay District for property located southwest of 72nd and Dodge Streets, and to provide for an effective date.

Summary: In accordance with Sections 55-609 through 55-617 of the Omaha Municipal Code, the ACI -Areas of Civic Importance Overlay District is hereby rescinded, for the following described land in Douglas County, Nebraska: Lot 3, Cedarnole Replat 5, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska.

AN ORDINANCE approving the contract with Clean Harbors Environmental Services, Inc. for Household Hazardous Waste Transportation & Disposal to be collected at Under the Sink, located at 4001 South 120th Street for a period of two years beginning January 1, 2026 and ending December 31, 2027, with the sole option by the City to extend the contract for one (1) additional one-year term; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and, to provide an effective date hereof.

AN ORDINANCE to transfer a permanent easement in land to Metropolitan Utilities District of Omaha, a Municipal Corporation and a Political Corporation, for purposes of relocating facilities, and appurtenances thereto, upon City-owned located on the Southeast corner of N. 209th Street and Park Road; to authorize the Mayor to execute the attached Right-of-Way Easement; and to provide an effective date thereof.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 3863 Mason Street, LLC, a Nebraska limited liability company, to implement the Rows at Field Club Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3863 Marcy Street and 3863 Mason Street, which proposes construction of 31 new market rate rowhome style rental units; the agreement authorizes the use of up to $1,661,799.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

AN ORDINANCE approving Amendment No. 2 to Agreement for Fire and Emergency Services Nebraska Interlocal Co-Operation Act Elkhorn Suburban Fire Protection District, # 2 and the City of Omaha which provides that the Elkhorn Suburban Fire Protection District, #2 (ESFD) will purchase two weed trucks at a total cost of $250,000 with ESFD paying the sum of $190,000 and the City paying the sum of $60,000 and ESFD will transfer title to the weed trucks to the City of Omaha which will satisfy its obligation to make annual payments of $40,000 per year to the City of Omaha for public education and fire prevention services; and provide an effective date hereof.

PUBLIC HEARING NOTICES

 

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on February 24, 2026, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

 

An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property located at 1111 “M” Plaza for the purpose of the Missouri River and Papillion Creek WRRF Secondary Treatment Design, project identified as OPW 54104; providing that the City negotiate with the property owner for land acquisition providing that if said parcel cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.

 

An ordinance to approve Amendment No. 1 to a Construction Manager at Risk (CMAR) Agreement, initially approved by the City Council by Resolution No. 1004 on September 17, 2024, between the City of Omaha and McCarthy Building Companies, Inc. for OPW 54503, being the Papillion Creek Water Resource Recovery Facility (PCWRRF) Secondary Expansion project, for a Guaranteed Maximum Price (GMP) of $411,028,480.00; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments according to actual usage, from a specific account.

 

An ordinance to approve an Agreement between the City of Omaha and Aqua-Aerobic Systems, Inc., formally known as a Procurement Contract, for OPW 54503, being the Papillion Creek Water Resource Recovery Facility (PCWRRF) Secondary Expansion project, in an estimated total amount of $88,465,230.00; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account.

 

An ordinance authorizing and approving an amendment to that certain Master Lease-Purchase Agreement (Streetcar Projects) dated as of February 1, 2024, with the additions of Schedules I, II and III thereto (collectively, the “Agreement”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”), to provide funds for the lease-purchase of and the financing of a portion of the costs of acquiring, constructing and equipping a modern streetcar system, including the lease-purchase of streetcars, an operations and maintenance building, streetcar track and all related public improvements (collectively, the “Project”); authorizing an amendment, if necessary to that certain Site Lease Agreement dated as of February 1, 2024 (the “Site Lease”) between the Corporation and the City for the ground leasing of the Project site by the City to the Corporation; authorizing and approving, if necessary, one or more Bills of Sale (collectively, the “Bills of Sale”) by the City to the Corporation for the sale of certain equipment to the Corporation; approving a Fourth Supplemental Indenture (collectively, the “Indenture”) between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds, Series 2026D (or such other designation or designations as may be determined by the City Finance Director) (collectively, the “Bonds”) in an aggregate principal amount of not to exceed $70,000,000, as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final form of the amendments to the Agreement, the amendment, if necessary, to the Site Lease, any Bills of Sale and the Indenture, the final price, interest rates, principal amount, redemption provisions, the tax-exempt or taxable status, and other terms and conditions thereof; and satisfying applicable federal income tax law requirements for any series of bonds issued as tax-exempt obligations.

 

An Ordinance authorizing and approving a Lease Purchase Agreement (the “Agreement”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”), to provide funds (a) for the lease-purchase of and financing of a portion of the costs of constructing and equipping a parking garage at the Crossroads Redevelopment Site located within the City, (ii) to refund on a current refunding basis all or a portion of the Corporation’s Lease Revenue Refunding Bonds (Omaha Baseball Stadium Project) Series 2016A (the “2016A Refunded Bonds”), and (iii) to refund on a current refunding basis all or a portion of the Corporation’s Lease Revenue Bonds (Police and Fire Projects) Series 2016D (the “2016D Refunded Bonds” and together with the 2016A Refunded Bonds, the “Refunded Bonds”); authorizing one or more Site Lease Agreements or Amended and Restated Site Lease Agreements, as the case may be (collectively, the “Site Leases”), between the Corporation and the City for the ground leasing of the particular project sites by the City to the Corporation; authorizing one or more Bills of Sale (collectively, the “Bills of Sale”) by the City to the Corporation for the sale of certain equipment to the Corporation; approving one or more Indentures of Trust (collectively, the “Indentures”) between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds, Series 2026B or Lease Revenue Refunding Bonds, Series 2026C (or such other designation or designations as may be determined by the City Finance Director) (collectively, the “Bonds”) in the aggregate principal amount of not to exceed $65,000,000, as set forth in the Indentures and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final form of the Agreement, the Site Leases, the Bills of Sale and the Indentures, the final price, interest rates, principal amounts, redemption provisions, the tax-exempt or taxable status, and other terms and conditions thereof; authorizing and directing the Corporation to defease (if applicable) and redeem the Refunded Bonds; and satisfying applicable federal income tax law requirements for any series of bonds issued as tax-exempt obligations.
