NOTICE TO PUBLIC
The City Council of the City of Omaha will have a Pre-Council Meeting at 10:30 A.M. in the Jesse Lowe Conference Room, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business; and a regular Council Meeting at 2:00 P.M. on Tuesday, December 12, 2023, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska. This meeting will have video conference capability. Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened. The video conference details and an agenda for the meeting is posted on the City of Omaha website at www.cityofomaha.org.

PUBLIC HEARING NOTICES
NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on December 12, 2023, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:
An ordinance approving a Services Agreement between the City of Omaha and T2L Utility Partners as primary awardee and PL Integrated Services, LLC as secondary awardee for GIS, PACP and Engineering Technical Services for Sewer Maintenance, effective for an initial term of one (1) year with options to extend for two (2) additional one (1) year terms; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments according to actual usage, at an estimated first term cost of $549,480.00, to T2L Utility Partners, (Primary Awardee $433,520.00) and PL Integrated Services LLC (Secondary Awardee $115,960.00), from specific accounts.
An ordinance to approve a Non-Exclusive Public ROW License Agreement between the City of Omaha and Metro Fibernet, LLC, for a period of ten years with additional ten-year options; authorizing the Mayor to sign and the City Clerk to attest the Non-Exclusive Public ROW License Agreement.
An ordinance levying a special tax assessment for condemned buildings or structures in accordance with Section 48-93 of the Omaha Municipal Code on certain lots in the City of Omaha – Group No. 2023-01.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and SST Phase 1 LIHTC, LLC, and between the City of Omaha and SST Phase 1 Market, LLC, a Nebraska to implement the Southside Terrace Phase 1 Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located northwest of South 28th and W Streets, which proposes the demolition of two existing multifamily buildings and the construction of a new mixed income multifamily residential structure of four stories in height and containing 92 units; the agreement authorizes the use of up to $1,724,214.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Woodsonia Fowler, LLC, to implement the 30th & Fowler Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 4702-4720 North 30th Street, which proposes the demolition of three single family homes in poor condition and the construction of a new single story commercial/retail building of about 4,185 square feet; the agreement authorizes the use of up to $322,179.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Kennedy West, LLC, to implement the Kennedy Square West Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3005 and 3006 Emmett Street., which proposes the Martin Luther King Jr building be demolished and replaced with a mixed use building of four stories with 39 residential units and about 3,964 square feet of commercial space; the agreement authorizes the use of up to $473,486.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and The Mensch Group, LLC, to implement the Curtis Corner Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located southwest of Curtis and North 49th Avenues, which proposes the new construction of nine for-sale single family homes; the agreement authorizes the use of up to $551,017.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.
An ordinance to accept the bid of Garret’s Lawn Service in the total amount of $57,750.00 to furnish all labor, materials, and equipment necessary to complete the Grounds Maintenance for the Regency area.
An ordinance authorizing and providing for an issue of special tax revenue redevelopment bonds in the aggregate principal amount of not to exceed $50,000,000.00 to be termed for identification purposes “Special Tax Revenue Redevelopment Bonds, Series Fifty”; prescribing the form and detail of said bonds; ratifying and confirming the creation of a community development agency; providing for the annual certification of the amount of community redevelopment tax to be levied for each succeeding fiscal year; pledging the special tax revenues to the payment of the principal of and interest on &aid bonds as the same fall due and to carry out all other covenants of this Ordinance; limiting the payment of said bonds solely to said special tax revenues; authorizing the sale of said bonds by negotiation; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said bonds; appointing a Paying Agent and Registrar; approving the selection of an underwriter; directing that said bonds shall initially be issued and registered in bookentry form; providing for continuing disclosure; delegating authority an Authorized Officer to determine the final prices, interest rates, principal amounts and redemption provisions for said bonds.
An ordinance to amend Section 23-178 of the Omaha Municipal Code to eliminate the unique step placement progression for the Mental Health Crisis Co-Responder classification; to make the language in Section 23-178 consistent with language that exists in current Collective Bargaining Agreements; to codify the process for initial step placement for those employees in the Civilian Management, Administrative and Executive, and Civilian Bargaining classifications when employees in those classifications are promoted or reallocated to a new classification.
An ordinance to amend Section 23 - 177 of the Omaha Municipal Code concerning employment classifications by changing the salary range of the employment classification entitled Mental Health Crisis Co-Responder by moving it from a range of $47,757.00 to $72,322.00 to a range of $55,141.00 to $72,322.00; to repeal Section 23 – 177 as heretofore existing.
An ordinance to approve the acceptance of and authorize disbursement over more than one fiscal year for a grant award agreement for Award #197-2024-DA3010 from the Nebraska Commission on Law Enforcement and Criminal Justice (Nebraska Crime Commission) in the amount of $49,975.00, during the project period extending from July 1, 2023 to June 30, 2024 to fund the Omaha Police Department (OPD) SFY 2024 Edward Byrne Memorial Justice Assistance Grant (JAG) Program to provide funding for the Omaha Police Department to conduct hotspot crime prevention, enforcement, and suppression overtime operations; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter.
An ordinance to amend Chapter 40, Article V, Divisions 2 and 3 of the Omaha Municipal Code, by amending code provisions pertaining to the issuance of certificates for hoisting and portable engineers. The amendments eliminate all references to “third-grade certificates” for hoisting and portable engineers, and modify the duration other certificates required to be possessed by hoisting and portable engineers so that the fee schedule for such certificates coincide with other mechanical license charges.
An ordinance to amend Chapter 40, Article II, Division 2 of the Omaha Municipal Code to modify the licensing requirements for master and journeyman Air Conditioning and Air Distribution (ACAD) contractors, continuing education requirements for ACAD contractors, and the license renewals, license fees, and penalties for late license renewals for ACAD contractors.
An ordinance approving a Contribution Agreement by and between the City of Omaha, the Mental Health Innovation Foundation, and Children’s Nebraska for the construction of the Behavioral Health & Welfare Center at Children’s near 84th and Dodge Streets.
An ordinance to approve a parking lease and license agreement between the City of Omaha and the Noddle BD1, LLC for the lease of property and adjacent rights-of-way owned by the City of Omaha, as the leased property is legally described in Exhibit A to the parking lease and license agreement, for a term which shall be deemed to have commenced on July 1, 2022 and which shall expire as governed by the parking lease and license agreement, at the rate of $3,512.00 per month for the Leased Property, with the Leased Property being depicted in Exhibit B to the agreement, and $3,488.00 per month for the Licensed Property, with the Licensed Property being depicted in Exhibit C to the agreement.
An ordinance to amend Section 2-21 of the Omaha Municipal Code pertaining to the salary of City Councilmembers; to increase the City Councilmembers’ salary by 3% for 2027, 3% for 2028, 3% for 2029, and 3% for 2030 commencing on January 1 of each year and continuing through the end of the calendar year, to repeal the section as previously existing.
An ordinance to amend Section 2-71 of the Omaha Municipal Code pertaining to the salary of the Mayor; to increase the Mayor’s salary by 3% for 2027, 3% for 2028, 3% for 2029, and 3% for 2030 commencing on January 1 of each year and continuing through the end of the calendar year; to repeal the section as previously existing.
An ordinance to accept the bid of Sandry Fire Supply, LLC, to provide fire hose for the Omaha Fire Department; the term of the agreement for one-year with the option to extend the agreement for four additional years. Following the initial contract term, the awarded bidder may propose price increases for any contract extensions offered by the City. Price increases must be requested 30 days prior to proposed increase and must be justified with documentation. (Funds for the fire hose are to be paid from the Fire Department’s budget, 11111 General Fund, 114581 Fire Response, 44134 FF Equipment.).
An ordinance amending Ordinance No. 43220 previously adopted by the City of Omaha on December 13, 2022, approving Lease Revenue Bonds for the Streetcar System, to amend a parameter regarding the terms of the Bonds set forth in the prior ordinance.
An ordinance authorizing and approving the establishment of a Master Lease-Purchase Program for the construction and equipping of a modem streetcar system pursuant to a Master Lease Purchase Agreement inclusive of Schedules I, II and III thereto between the City of Omaha Public Facilities Corporation and the City of Omaha, Nebraska, to provide funds for the lease-purchase of and the financing of the costs of acquiring, constructing and equipping a modem streetcar system, including the lease-purchase of streetcars, an operations and maintenance building, streetcar track and all related public improvements; authorizing one or more Site Lease Agreements between the Corporation and the City for the ground leasing of the Project site by the City to the Corporation; authorizing and approving one or more Bills of Sale by the City to the Corporation for the sale of certain equipment to the Corporation; approving a Master Indenture of Trust and a First Supplemental Indenture between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds, as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final form of the Agreement, the Site Leases, the Bills of Sale and the Indenture, the final price, interest rates, principal amount, redemption provisions, and other terms and conditions thereof; and satisfying applicable federal income tax law requirements.
