Notice is hereby given that the City Council of the City of Omaha met on December 22, 2020 and passed and approved the following ordinance:
ORDINANCE NO. 42403
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 180th and Blondo Streets from AG-Agricultural District to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 81 and Outlots A-G, Bluestem Meadows, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to DR-Development Reserve District. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42405
AN ORDINANCE vacating a portion of Indiana Street east of North 28th Avenue, abutting Lots 1 through 4 of Riverview-McGavocks Addition; and the north/south alley south of Indiana Street abutting the NDOT ROW as well as abutting Lots 1 through 4 of The Highlander 2nd Addition and Lot 1 of Nelson’s Replat 1 Addition and Lots 1 through 5 of The Highlander 1st Addition, Douglas County, Nebraska; and providing the effective date hereof. WHEREAS Neb. Rev. Stat. Section 14-375 provides that the City Council may vacate a street or alley without petition upon City Planning Board recommendation; and, WHEREAS, the Statute further provides that a Committee of Appraisers be appointed to appraise damages, if any, to property affected by the vacation; and,
WHEREAS, Resolution No. 666 adopted June 25, 2019, appointed Vinny Palermo, Rich Pahls, and Pete Festersen members of the City Council, to assess damages to all property affected by the vacation; and, WHEREAS, on October 20, 2020, the Committee of Appraisers held a meeting at 10:45 a.m. in the Roskens Room, Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska, at which meeting the matter was laid over until a further day; and, WHEREAS, on November 10, 2020, the Committee of Appraisers held another meeting at 8:30 a.m. in the City Council Conference Room, Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska, at which no cause for any damages was found as a result of the vacation; and, WHEREAS, the City Council finds there are no damages as a result of this vacation, and that such vacation should be approved; and, WHEREAS, Fair Market Value has been waived and none required for the conveyance of the right-of-way to be vacated. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. A portion of Indiana Street east of North 28th Avenue, abutting Lots 1 through 4 of Riverview-McGavocks Addition; and the north/south alley south of Indiana Street abutting the NDOT ROW as well as abutting Lots 1 through 4 of The Highlander 2nd Addition and Lot 1 of Nelson’s Replat 1 Addition and Lots 1 through 5 of The Highlander 1st Addition, Douglas County, Nebraska, platted and recorded in Douglas County; be, and hereby is, vacated and without further act of the City, title to the vacated right-of-way shall pass to the abutting owner of said property thereof; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers and/or drainageways; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person. Section 2. That the property be divided as such; Title of Indiana Street east of North 28th Avenue abutting Lots 1 - 4 of Riverview-McGavocks Addition, will be passed to the property owner of Parcel ID 1308512006 with the address of 971 North 28th Avenue. Title of a portion of the north/south alley south of Indiana Street abutting NDOT ROW as well as abutting Lot 4, The Highlander 2nd Addition, will pass to the property owner of Parcel ID 1308512006 with the address of 971 North 28th Avenue. Title of a portion of the north/south alley south of Indiana Street abutting NDOT ROW as well as abutting Lot 3, The Highlander 2nd Addition, will pass to the property owner of Parcel ID 1308512004 with the address of 967 North 28th Avenue. Title of a portion of the north/south alley south of Indiana Street abutting NDOT ROW as well as abutting Lot 2, The Highlander 2nd Addition, will pass to the property owner of Parcel ID 1308512002 with the address of 963 North 28th Avenue. ORDINANCE NO. 42406
AN ORDINANCE to approve an Agreement between the City of Omaha and CentralSquare Technologies, LLC, a Delaware limited liability company, to provide billing and collections services for intrusions/fire alarm registrations, false alarm billings, and monitoring company fines and fee billings, for a term of five years commencing on January 1, 2021; to authorize the Finance Director to make payments in conformance therewith from General Fund 11111, Organization 119014, Account 42239; to provide an effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the attached Agreement between the City of Omaha and CentralSquare Technologies, LLC, a Delaware limited liability company, to provide billing and collection services for intrusions/fire alarm registrations, false alarm billings, and monitoring company fines and fee billings for a period of five years is hereby approved with payment by the Finance Director from General Fund 11111, Organization 119014, Account 42239. Section 2. That the Mayor is authorized to execute and the City Clerk to attest on behalf of the City of Omaha the attached Agreement and any other documents reasonable and necessary to consummate this transaction. Section 3. That this Ordinance not being legislative in character shall be in full force and take effect immediately from the date of its passage.

ORDINANCE NO. 42407
AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Dreamvesting Capital Group, LLC, a Nebraska limited liability company, to implement the Ten Square Townhomes Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 618-636 North 46 Street, which proposes to construct a single residential structure containing ten (10) for sale market rate townhome units; the agreement authorizes the use of up to $835,500.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Dreamvesting Capital Group, LLC, a Nebraska limited liability company, to authorize the use of up to $835,500.00, plus accrued interest, to offset TIF eligible costs such as acquisition, demolition, site preparation, architectural and engineering fees, and public improvements as required, for a project with total estimated costs of $5,062,750.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan.
Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 42408
AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and JAT Ventures, LLC, a Nebraska limited liability company, to implement the 39 Harney Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3922, 3924 and 3926 Harney Street, which proposes the demolition of existing structures and the construction of a 3,500 square foot restaurant which will include approximately 4,000 square feet of outdoor space and an adjoining structure containing 3,000 square feet of event space; the agreement authorizes the use of up to $678,835.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and JAT Ventures, LLC, a Nebraska limited liability company, to authorize the use of up to $678,835.00, plus accrued interest, to offset TIF eligible costs such as acquisition, architectural and engineering fees, site demolition and excavation, surveying, erosion control and SWPPP Maintenance, site utilities, facade improvements that exceed code requirements and other public improvements as required. The developer will also contribute $18,000.00 of the TIF loan proceeds to the Midtown Public Improvement Fund for public infrastructure enhancements and improvements in the Midtown area, for a project with total estimated costs of $3,923,693.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and, are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.
