AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southeast of 181st and Spencer Streets from AG-Agricultural District and R4-Single-Family Residential District (High Density) to R4-Single-Family Residential District (High Density). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-6, Spruce 180 Replat One, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District and R4-Single-Family Residential District (High Density) to R4-Single-Family Residential District (High Density). ORDINANCE NO. 42091
AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Altech Business Park, located northwest of 144th and F Streets, to add Lot 9 to the agreement, as well as amend the agreement in relation to Lots 3 thru 6, 10, and 48, between the City of Omaha and Ted Grace, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located northwest of 144th and F Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

AN ORDINANCE to amend the boundaries of the ACl-3(PL)-Areas of Civic Importance Overlay District, to incorporate into that district the property located at 11540 West Dodge Road; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-609 through 55-617 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 6, West Dodge Plaza, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned to be included in and incorporated into the ACI-3(PL)-Areas of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. AN ORDINANCE to accept the bid from Chopper’s Lawn Service for grounds maintenance of the right-of-ways identified as Area 1, being from 90th Street east to the Missouri River and from Cuming Street north to the City Limits and Area 3, being from 90th Street west to 168th Street and from Dodge Street north to the City Limits in the amount of $186,645.60 per year, for a two year period ending November 30, 2021; providing for the payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956 as amended; to authorize the Purchasing Agent to issue a purchase order; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid from Chopper’s Lawn Service for grounds maintenance of the right-of-ways identified as Area 1, being from 90th Street east to the Missouri River and from Cuming Street north to the City Limits and Area 3, being from 90th Street west to 168th Street and from Dodge Street north to the City Limits in the amount of $186,645.60 per year, for a two year period ending November 30, 2021 is hereby accepted. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon date of its passage.

AN ORDINANCE to approve a 12-month price agreement, with three (3) one-year optional extensions, with Galls, LLC for Public Works’ Street Maintenance Division uniforms at an estimated annual cost of $30,000.00; to provide for payments from specific accounts; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby approves the price agreement with three (3) one-year optional extensions with Galls, LLC for Public Works’ Street Maintenance Division uniforms, to be effective from January 1, 2020 through December 31, 2020. Section 2. That payment for the Public Works’ Street Maintenance Division uniforms, involving appropriations of more than one year, is authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended, is authorized. Section 3. That the Finance Department is authorized to pay the cost of this price agreement, with extensions, in the amount of $30,000.00, from the Street and Highway Allocation Fund 12131, Pavement Maintenance Organization 116158 based on actual services rendered and product provided. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 42096
AN ORDINANCE approving an Interlocal Agreement between the City of Omaha and the Omaha-Council Bluffs Metropolitan Area Planning Agency (MAP A) involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for the terms and conditions under which Omaha and MAP A will participate in a project to obtain regional digital map products; to authorize the Finance Department to pay cost share to MAP A not to exceed $106,372.00 according to the disbursement terms contained within the Agreement; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby approves the Inter local Agreement between the City of Omaha and the Omaha-Council Bluffs Metropolitan Area Planning Agency (MAP A), which by this reference is made a part hereof, that outlines the terms and conditions under which Omaha and MAP A, will participate in a project to obtain digital map products, including aerial photography of the planning region. Section 2. The Finance Department is authorized to make payments to MAP A for this project involving appropriations of more than one year, which is authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the City of Omaha shall make payments to MAP A according to the disbursement terms set out in the Agreement for the City’s portion of this cost share in an amount not to exceed $106,372.00. This cost will be will be paid from the Street and Highway Allocation Fund 12131, Administration Organization 116111, with reimbursements to this Organization from the various Public Works Department Divisions’ budgets and other Departments as outlined in the attached schedule. Section 4. That this Ordinance, being administrative in character shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 42099
AN ORDINANCE to approve the execution of a Sublease Acknowledgement and Agreement between the City of Omaha, a Municipal Corporation, and the Omaha Performing Arts Society, for a parking lease to the Park Eight parking garage; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given for the execution of the Sublease Acknowledgement and Agreement between the City of Omaha, a Municipal Corporation, and the Omaha Performing Arts Society, involving the continuation of a parking lease between the Omaha Performing Arts Society and the Union Pacific Railroad Company after the termination of the Union Pacific parking lease agreement. Section 2. The Mayor of the City of Omaha is authorized to execute, and the City Clerk to attest, on behalf of the City of Omaha, the Sublease Acknowledgement and Agreement entered into between the City of Omaha, a Municipal Corporation, and the Omaha Performing Arts Society, approve of Section 1 hereof, attached hereto and marked as Exhibit 1, and by this reference may depart hereof as is set forth here. Section 3. This Ordinance, being not of a legislative character, shall be in full force and take effect immediately upon passage under, and by virtue of the authority granted by Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

ORDINANCE NO. 42100
AN ORDINANCE providing for an amendment to the levy of a general business occupation tax as requested by the property owner(s) of the Capitol District; and related matters. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Findings and Determinations. Pursuant to Neb. Rev. Stat. Chapter 18, Article 21, as amended (the “Act”), Chapter 19 of the Omaha Municipal Code, and Ordinance No. 41188 the City Council established an enhanced employment area for the purpose of paying all or any part of the costs and expenses of a redevelopment project pursuant to the approved Capitol District Redevelopment Plan, which, in part, provides for the development of a mixed use project (the “Redevelopment Project”) within the area bounded by 101h Street on the East, 121h Street on the West, Capitol Avenue on the South, and Interstate 480 on the North (“Capitol District Redevelopment Project Area”); which together with that area bounded by 9th Street on the East, 11th Street on the West, Dodge Street on the South, and Capitol Avenue on the North (“South Capitol District Area”), previously designated as “substandard and blighted” pursuant to Neb. Rev. Stat. §18-2109, constitute the established as an “enhanced employment area” as defined in Neb. Rev. Stat. Section 18-2103(22), as amended (the “Enhanced Employment Area”). Pursuant to the authority of Neb. Rev. Stat. § 18-2142.02, as amended, and at the request of the property owners located within the Enhanced Employment Area, and pursuant to Ordinance No. 41188, the City authorized the levy and collection of a general business occupation tax upon businesses and users of space within the Enhanced Employment Area for the purpose of paying all or any part of the costs and expenses of the Redevelopment Project within the Enhanced Employment Area and determined, based on written undertakings provided by the developer, the investment in the Enhanced Employment Area satisfied the employment requirements of the Act. The City Council further determines that it is necessary, desirable, advisable and in the best interests of the City to amend the established general business occupation tax imposed within the Enhanced Employment Area and implementing Ordinance No. 41188, as provided for herein, and as authorized by the Act and Chapter 19, Article XVII of the Omaha Municipal Code entitled “general enhanced employment tax”, and for the purpose set forth in Section 19-901 (b) of the Omaha Municipal Code. Section 2. Amendment. Section 2 of Ordinance No. 41188 is hereby amended and replaced with the following: “Section 2. Tax Imposed; Collection of Tax Commencing upon the issuance of a certificate of occupancy for a business located within the Enhanced Employment Area, and in each calendar month thereafter (except for residential apartments which shall be collected on an annual basis) until December 31, 2037, there shall be imposed a general business occupation tax upon each and every Person operating a business therein. The amount of such tax shall be based on the following business uses taking place within the Enhanced Employment Area:
1. 1.50% (one and one half percent) of the gross sales of all retail, restaurant, or hotel (other than hotel group/event sales) businesses located in the Capitol District Redevelopment Project Area;
2. 1.25% (one and one quarter percent) of the gross sales of all hotel group/event sales businesses located in the Capitol District Redevelopment Project Area;
3. 0. 75% (three quarters of one percent) of the gross sales of all retail, restaurant, or hotel businesses located in the South Capitol District Area;
4. $0.25 (twenty-five cents) per square foot (gross) of commercial office space area not occupied by retail, restaurant, or hotel businesses; and
5. $95.00 per year for each residential apartment.
6. Parking: none.
Such tax shall be imposed on the gross receipts resulting from the sale, lease, or rental of any products, rooms, units, or services within the Enhanced Employment Area, as indicated above, except that such tax shall not be imposed on any transaction which is subject to tax under Sections 53-160, 66-489, 66-489.02, 66-4, 140, 66-4, 145, 66-4, 146, 77-2602, or 77-4008, or which is exempt from tax under section 77-2704.24, Reissue Revised Statutes of Nebraska, as amended from time to time. The amount of such tax shall at all times be subject to such applicable rules and regulations imposed by the State of Nebraska Department of Revenue, regarding the use and imposition of the general business occupation tax authorized by Neb. Rev. Stat.§ 18-2142.02.
The Person engaged in operating a business may include the tax on or for the selling price, services rendered, charges incurred, rates, or other consideration received on a bill, statement, receipt, or other similar invoice to the purchaser, but each Person engaged in a Business shall remain liable for the tax imposed by this Ordinance.
Section 4. Effect. Except as provided for in this Ordinance, all other aspects of Ordinance No. 41188 shall remain in full force and effect. Section 5. Execution. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached First Amendment to Redevelopment Agreement For Occupation Tax In An Enhanced Employment Area, and that certain Amended and Restated Redevelopment Promissory Note in the amount of $17,000,000.00, and related documents necessary or appropriate in order to implement the Agreement, consummate the loan, or implement the provisions of this Ordinance. Section 6. Effective Date. This Ordinance shall be in full force and take effect 15 days from and after the date of its passage.

AN ORDINANCE to adopt the amended and restated Park Covenants of the Heartland of America Park; and to provide an effective date hereof. ORDINANCE NO. 42102
AN ORDINANCE to approve an Inter-Local Agreement for an initial term of five years with Douglas County for the operation of the joint 911 Emergency Communication System; to provide for the payments called for in said Agreement from a specific account; and, providing for an effective date hereof. WHEREAS, the City of Omaha and Douglas County on behalf of themselves and other local communities have been parties to an Inter-Local Co-Operation Act Agreement concerning the operation and management of a 911 Emergency Communication System; and, WHEREAS, such Agreement together with any extensions previously approved expires at the end of 2019; and, WHEREAS, representatives of the City and County have negotiated a new Agreement which provides a unified County wide combined 911 System to be operated by Douglas County on behalf of all of its citizens with the advice of a County wide board of public communications advisors; and, WHEREAS, section 5.17 of the Home Rule Charter of the City of Omaha requires that any Agreement involving appropriations out of more than one year be approved by Ordinance. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it does hereby approve the attached Agreement pursuant to the Inter-Local Co-Operation Act, said Agreement being with Douglas County for the operation and management of a 911 Communication System throughout all incorporated and un-incorporated areas of Douglas County, the initial term of said Agreement being a period of five years from January 1, 2020 through December 31, 2024, with a possible second five year term as provided for in such Agreement. Such Agreement contemplates general management of the system will be by Douglas County with additional management by the board of public safety communication advisors also known as the 911 User’s Group. Section 2. The cost to be paid by the City of Omaha under such Agreement shall be paid from Fund No. 11111, Organization No. 119013. Section 3. That this Ordinance being administrative in character shall be in full force and take effect immediately upon its passage.

AN ORDINANCE to amend Section 23 -177 of the Omaha Municipal Code by changing the title of the class specification entitled Visitor Services Manager to Director of Visitor Services; by changing the title of the class specification entitled Assistant Visitor Services Manager to Visitor Services Manager; to repeal Section 23 -177 as heretofore existing; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. REQUEST FOR PROFESSIONAL SERVICES
The City of Omaha /Omaha Fire Department is requesting proposals for Architect / Engineering Design and Construction Administration Services for the construction of a new Omaha Fire Station #31. The new fire station will include a three-bay double deep apparatus floor, 10 bedrooms, restroom/locker room, kitchen, day room, office, exercise room and mechanical room.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Malnove Incorporated for a renewal to their air emission operating permit for the packaging materials manufacturing facility at 13434 “F” Street, Omaha. The potential emissions, in tons, for this project will be: PM10 0.2, PM2.5 0.2, NOx 21.4, VOC 73.1, CO 3.0, individual HAP 7.9, total HAPs 8.4 and CO2 equivalent 927.0.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from January 15, 2020 to February 15, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
