Call to Order - Roll Call – Open Meetings Act
Mayor Zac Johns called the regular monthly meeting to order on Monday, November 13, 2023 at 6:00 p.m. In attendance were City Council Members Clint Adams, Kaye Bridgeford, Josh Dowding and Shane Pekny. Mindi Laaker identified the Open Meetings Act location that is available to the public.

Motion by Pekny, second by Bridgeford to approve the Consent Agenda. All voted in favor and the motion carried.
Special Designated Liquor License – 15312 S. Second St., Bennington Legion Hall 6-10 p.m. Friday, January 26 Bennington Public Schools Foundation, Blake Thompson
Motion by Bridgeford, second by Dowding to approve the liquor license as presented. All voted in favor and the motion carried.
Consideration of a Change of Zoning from a Transitional Agriculture District (TA) to a Flex Business District (C-4) for 35.3 acres located southwest of N. 156th Street and Pawnee Road and north of the Lockbox development Lots 1-13
City Engineer Julie Ogden and Jeff Stoll with E & A Consulting, Inc. presented the proposed Flex Business rezoning and development of 10 lots and 3 outlots. A traffic study is pending.
Johns opened a public hearing and comments were made regarding access road location and well protection.
Motion by Adams, second by Bridgeford to approve rezoning a Transitional Agriculture District to a Flex Business District for 10 lots and 3 outlots. All voted in favor and the motion carried.
Consideration of a Preliminary Plat for 35.3 acres located southwest of N. 156th Street and Pawnee Road and north of the Lockbox development Lots 1-13
Johns opened a public hearing and there were no comments.
Motion by Adams, second by Pekny to approve the Preliminary Plat subject to compliance with the requirements of the City Engineer and Douglas County Engineer comment letters. All voted in favor and the motion carried.
Ordinance No. 526 Approving 2024 Sewer Rate Increases
Ogden presented a five-year outlook of City of Omaha sewer increases at 2% annually.
Motion by Pekny, second by Adams to approve the first reading of Ordinance No. 526 AN ORDINANCE AMENDING SECTION 6-202 OF THE CITY OF BENNINGTON’S MUNICIPAL CODE AS ENACTED IN CITY OF BENNINGTON ORDINANCE NO. 512 REGARDING SANITARY SEWER USE RATES AND COLLECTIONS. All voted in favor and the motion carried.
Resolution No. 2023-13 Approval of the Governing Body to the Mayor to Authorize and Sign the Year-End Certification of the City Street Superintendent
Motion by Pekny, second by Bridgeford to approve Resolution 2023-14 as presented. All voted in favor and the motion carried.
Warehouse Street and Sewer Improvements
A. ME Collins Pay Application #6 totaling
$271,006.61
B. ME Collins Change Order #3 totaling
$63,237.01 including stamped and early strength concrete and light pole removal
Motion by Bridgeford, second by Adams to approve Items A-B listed above. All voted in favor and the motion carried.
Neumeyer Farm Park Update
The project committee has discussed hiring fundraising and project managers funded by project fundraising.
2008 Parks and Recreation Master Plan Update
City Manager John Bohrer, Douglas County Trail Plan Developer Kent Holm and City Engineer Julie Ogden presented the need for an updated City Park and Trail Plan. The City’s current plan dates back to 2008 and doesn’t lend itself to “shovel-ready” projects.
Frisbee Disc Golf Course
Derek Brechbill of the City Public Works Department presented a preliminary nine-hole disc golf course proposal for the Doug Nelson Youth Complex including layout, installation and costs.
Library, Police, Public Works, Office and Project Tracker Reports
All monthly reports are on file in the City Office.
Public Comments
A comment was made regarding the need for a sidewalk on the south side of Bennington Road.

Motion by Bridgeford, second by Dowding to adjourn the meeting at 7:25 p.m. All voted in favor and the motion carried.
