Call to Order - Roll Call – Open Meetings Act
Mayor Zac Johns called the regular monthly meeting to order on Monday, September 9, 2024 at 6:00 p.m. In attendance were City Council Members Clint Adams and Shane Pekny. Council Members Kaye Bridgeford and Josh Dowding were absent. Pursuant to Neb. Rev. Stat. 17-105 Mayor Johns constitutes a Member of the Council for the purposes of establishing a quorum. City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.
2024-2025 Budget Hearing, Budget Summary & Tax Request
Creative Planning, BerganKDV Accountant Tim Lens presented an overview of the budget. The property tax rate for the fiscal year 2024-2025 will be set at $0.582934 calculated at $.384083 for the General Fund and $.198851 for the Bond Fund. The 2024-2025 property tax request will be set at $1,097,852 for the General Fund and $511,700 for the Bond Fund, for a total of $1,609,552.
Johns opened a public hearing and there were no comments.

2024-2025 Budget Resolution 2024-05 Setting Final Tax Request
Motion by Adams, second by Pekny to approve Budget Resolution No. 2024-05 setting the property tax rate for fiscal year 2024-2025 at $0.582934. All voted in favor and the motion carried.
Resolution 2024-08 Calling Series 2018 General Obligation Sewer Bonds totaling $450,000 for Payment
Motion by Adams, second by Pekny to approve Resolution No. 2024-08. All voted in favor and the motion carried.
Resolution 2024-09 Calling Series 2023 Street Improvement Bond Anticipation Notes totaling $600,000 for Payment
Motion by Adams, second by Pekny to approve Resolution No. 2024-09. All voted in favor and the motion carried.
Ordinance No. 532 Authorizing the Issuance of General Obligation Various Purpose Bonds Series 2024 not to exceed $1,050,000 for Paving, Sewer and Related Improvements in Certain Improvement Districts of the City
Motion by Pekny, second by Adams to introduce and waive three readings of Ordinance No.532 AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION VARIOUS PURPOSE BONDS, SERIES 2024, OF THE CITY OF BENNINGTON, NEBRASKA, IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED ONE MILLION FIFTY THOUSAND DOLLARS ($1,050,000) TO PAY THE COST OF CONSTRUCTING PAVING, SEWER, AND RELATED IMPROVEMENTS IN CERTAIN IMPROVEMENT DISTRICTS OF THE CITY; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR A SINKING FUND AND FOR THE LEVY AND COLLECTION OF TAXES TO PAY SAID BONDS; PROVIDING FOR THE SALE OF THE BONDS; AUTHORIZING THE DELIVERY OF THE BONDS TO THE PURCHASER; PROVIDING FOR THE DISPOSTION OF THE BOND PROCEEDS AND ORDERING THE ORDINANCE PUBLISHED IN PAMPHLET FORM. All voted in favor and the motion carried.
Motion by Pekny, second by Adams to approve and adopt Ordinance No. 532. All voted in favor and the motion carried.
Consideration of a Conditional Use Permit for a Dance Studio in an I-1 Light Industrial Zoning District located at 15311 Warehouse Street
City Engineer Julie Ogden explained the application for a dance studio as a conditional use and the consideration of parking and green space.
Johns opened a public hearing and there were no comments.
Motion by Pekny, second by Adams to approve the conditional use permit as presented, subject to compliance with the City Engineer’s comment letter requirements. All voted in favor and the motion carried.
Consideration of a Conditional Use Permit for a Wall Mural in a C-3 Downtown Commercial District located at 132 South Stark Street
City Engineer Julie Ogden explained the addition of a wall mural as a conditional use and the consideration of maintenance.
Johns opened a public hearing and there were no comments.
Motion by Adams, second by Pekny to approve the conditional use permit as presented, subject to compliance with the City Engineer’s comment letter requirements. All voted in favor and the motion carried.
Special Designated Liquor License – Founder’s Day, Saturday September 28, 2024

C. Nate’s Stumble Inn, Nieman – 4 p.m. to 12 a.m.
Motion by Adams, second by Pekny to approve the Special Designated Liquor License Applications. All voted in favor and the motion carried.
Review and Approval of 2024-2025 One & Six Year Street Plan
Street Superintendent Julie Ogden explained the proposed Street Plan.
Johns opened a public hearing and there were no comments.
Motion by Adams, second by Pekny to approve Resolution No. 2024-07 and Adopt the One and Six Year Street Plan. All voted in favor and the motion carried.
Neumeyer Farm Park
Reseeding has been completed and pavement markings are to be determined.
Motion by Pekny, second by Adams to approve Blade Master’s Pay Application #6 totaling $95,474.88. The check will be released when work is completed. All voted in favor and the motion carried.
Phase II: The City anticipates the arrival of the US HUD Community Project Funding Grant Welcome Packet.
Motion by Pekny, second by Adams to table the Agreement for Design of Tennis-Pickleball Court Project. All voted in favor and the motion carried.
2024 Street Patching Project
Street sealing remains to be done.
Motion by Adams, second by Pekny to approve Navarro Lawn & Landscape Invoice #1 totaling $89,767.89. All voted in favor and the motion carried.
Resolution No. 2024-06 Nebraska Recreational Trail Program Grant with a 20% Local Match Commitment for Suburban Fire Department and Valasek Trail Easements
Motion by Pekny, second by Adams to approve the grant application for easements for the Heritage Trail Project. All voted in favor and the motion carried.

All monthly reports are on file in the City Office.
Public Comments
Comments were made regarding care of the Molley and Stark Streets Island, an American Legion event and fence work done in Prairie Hollow.
