Mayor Zac Johns called the regular monthly meeting to order at 6:00 p.m. on Monday, December 9, 2024. In attendance were City Council Members Clint Adams, Kaye Bridgeford and Shane Pekny. Council Member Josh Dowding was absent. City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.

Mayor Clint Adams called the regular monthly meeting to order at 6:05 p.m. on Monday, December 9, 2024. In attendance were City Council Members Kaye Bridgeford, Rob Hamilton and Shane Pekny. Council Member Josh Dowding was absent. City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.
Report of Election Results
City Attorney Jeff Miller reported the Official Results from the Douglas County Election Commissioner for the November 5, 2024 General Election. Clint Adams was elected as Mayor. Rob Hamilton was elected in City Council Ward 2, and there were no filings for City Council Ward 1 so the incumbent, Josh Dowding, continues in that office until a successor is appointed and qualified.

Consideration of Text Amendments including Definitions to add Commercial Office Flex in a Highway Commercial District as a Conditional Use, add Commercial Office Flex as a Permitted Use in the Flex Business and Light Industrial Districts and add Appropriate Parking Requirements for Commercial Office Flex in the Commercial Parking Use Table and add Commercial Office Flex Performance Standards
City Engineer Julie Ogden and Property Owner Geoff McGregor presented the proposed text amendment for Business-Commercial Flex development to be included in the Highway Commercial (C-1), Flex Business (C-4) and Light Industrial (I-1) Districts, plus performance standards and parking.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Bridgeford to approve the amendments as presented. All voted in favor and the motion carried.
Consideration of a Conditional Use Permit for Mixed Use Development including Multi-Family Residential in a Downtown Commercial District located on South Second Street east of Earl & Gray, west of JDUB’s Hangout
City Engineer Julie Ogden and Applicant Josh Hannum presented the 4-story building including levels for parking, commercial, apartment/multi-family residential facilities, and a fourth-floor business and patio.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Bridgeford to approve the Conditional Use Permit as presented subject to compliance with the City Engineer’s letter requirements. All voted in favor and the motion carried.
Consideration of a Change of Zoning from Transitional Agriculture (TA) to Medium Density Residential District (R-3) for 69 acres located in the vicinity northeast of 168th Street and Military Road and west of 156th Street for Lots 239 to 373 and Outlots I to N in the Morgan Ridge Development
Consideration of a Revised Preliminary Plat and Final Plat for 69 acres located in the vicinity northeast of 168th Street and Military Road and west of 156th Street for Lots 239 to 373 and Outlots I to N in the Morgan Ridge Development
City Engineer Julie Ogden presented information including topics of concern raised at the Commission’s October 30, 2024 meeting, involving a waiver of curve design standards, a waiver of mid-block sidewalk requirements, and school lot site and street parking and traffic considerations.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Bridgeford to approve the zoning change and preliminary and final plat including Curve 11 meeting minimum design standards and a mid-block sidewalk between 157th and 158th Streets. All voted in favor and the motion carried.
Ordinance No. 536 Amending the City of Bennington’s Zoning Regulations regarding a Business-Commercial Flex Use Definition, including as a Conditional Use in the C-1 Highway Commercial Zoning District, including as a Permitted Use in the C-4 Flex Business and I-1 Light Industrial Zoning Districts, and Adding Parking Requirements and Performance Standards
Motion by Bridgeford, second by Pekny to introduce and waive three readings of Ordinance No. 536 AN ORDINANCE AMENDING THE CITY OF BENNINGTON’S ZONING REGULATIONS SECTIONS 2.03.80A,5.10.03(T),5.13.02(DD), 5.14.05(M), 7.02, AND 7.19 REGARDING A BUSINESS-COMMERCIAL FLEX USE DEFINITION, INCLUDING AS A CONDITIONAL USE IN THE C-1 HIGHWAY COMMERCIAL ZONING DISTRICT, INCLUDING AS A PERMITTED USE IN THE C-4 FLEX BUSINESS ZONING DISTRICT AND THE I-1 LIGHT INDUSTRIAL ZONING DISTRICT, AND ADDING PARKING REQUIREMENTS AND PERFORMANCE STANDARDS. All voted in favor and the motion carried.

There will be a project update and pay-out in January.
Steps will be taken to create a Request for Proposals for an Engineer for Environmental and Design Standards for the Phase II: US HUD Community Project Funding Grant.

Resignation and Notice of Vacation in Elected Office of Bennington City Council Ward 1
City Attorney Jeff Miller presented the process for filling the Ward 1 Council Member position.
Nebraska Department of Transportation 2025 Agreement Renewal Highway 36 Snow Removal Totaling $3,546.40
Motion by Bridgeford, second by Pekny to approve the 2024 Certificate of Compliance. All voted in favor and the motion carried.

Nebraska Department of Transportation Grants were received for a new Police Radar Unit and three new Preliminary Breath Tests.

Motion by Pekny, second by Bridgeford to approve an Agreement with Joe Patterson for Recruitment Services to Hire a City Administrator. All voted in favor and the motion carried.
