Bellevue City Council Proceedings

A meeting of the Mayor and Council of the City of Bellevue was called to order by Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m. on September 15, 2020.  Present were Council Members Bob Stinson, Paul Cook, Pat Shannon, Don Preister, Thomas Burns, and Kathy Welch. 

Notice of this meeting was given in advance thereof by publication in the Gretna Guide “Omaha Daily Record” and posted in two public places, the designated method for giving notice, and was given to the Mayor and all members of the City Council.  All proceedings hereafter were taken while the convened meeting was open to the public.  Mayor Hike announced that a copy of the Open Meetings Act is posted in the back of the City Council Chambers.

Arrow of Light, Cub Scout Pack 464, led in the Pledge of Allegiance.  Father Tom Jones, Church of the Holy Spirit (Episcopal), 1305 Thomas Drive, Bellevue, gave the invocation.

The following items of business were considered:

1.   Council approved the Agenda as presented. 

2.  After Councilman Burns removed item 8a, the consent agenda was approved which included:  Acknowledge receipt of August 19, 2020 Board of Adjustment Minutes; Acknowledge receipt of August 27, 2020 Planning Commission Minutes; Approval of the August 31, 2020 Board of Equalization Minutes; Approval of the September 1, 2020 City Council Minutes; Approval of September 15, 2020 Claims; Authorize staff to pay claims that pertain to the FYE 2020 Budget Year; Approval of the applications for waiver of hunting application; Approve the Mayor to sign Environmental Review Record (ERR) for CDBG-CV activities; Approve and authorize the Mayor to sign the extended contract to September 30, 2021, for Sgt. Joe Milos to be the State Drug Recognition Training Coordinator for the Nebraska Department of Transportation Highway Safety Office; Approve and authorize the Mayor to sign the CDBG Subrecipient Agreement with Habitat for Humanity of Sarpy County; Approve and execute the CDBG-CV Grant Agreement and Funding Approval in the amount of $202,742.00; and approve and the authorize the Mayor to sign the Quetel Corporation Technical Support Agreement for $2,174.00 with Quetel Co. 

3.  On a 5-1 vote, with Burns voting no, Council approved the Amended City Administrator contract and authorized the Mayor to sign the contract.

4. Following a public hearing, Council approved to recommend approval of application for John R. Fritz as the new Manager for Aldi Inc. (Kansas) dba “Aldi 40” at 2112 Cornhusker Road; and to recommend approval of application for Jennifer B. Miller as the new Manager at Kum & Go LLC dba “Kum & Go” at 13905 Williamsburg Drive.

5. Council moved to table Ord. No. 4003:  An Ordinance to amend the official zoning map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about Fort Crook Road and Fairview Road, more particularly described in Section 1 of the Ordinance and to provide an effective date, until October 20, 2020 per the applicant’s request.

6. Ord. No. 4006:  An ordinance to allow for statutory changes and revisions to be incorporated into several sections of the City Code which have been affected by or generated by legislative changes and to add or change legislative citations to provide for an effective date was read for the second time and opened for public hearing.  No one spoke in favor or opposition of this ordinance.  Third and final reading on this ordinance will be held October 6th.

7. The following ordinances were read for the first time:  Ord. No. 4007 - An ordinance to amend Section 6-117 of the Bellevue Municipal Code pertaining to the Regulation of Bees Violations- Revocations; Ord. No. 4008 - An ordinance to amend Sections 9-17 & 9-18 of the Bellevue Municipal Code pertaining to Elections; Ord. No. 4009 - An ordinance to amend Sections 15-194 of the Bellevue Municipal Code pertaining to Unlawful Acts - Sale or Rental; Ord. No. 4010 - An ordinance to repeal Section 20-5 of the Bellevue Municipal Code Pertaining to Swearing, Cursing, Etc.; Ord. No. 4011: Request to rezone Lot 1 Riverview Heights Replat IV, being a replat of Lot 1 Riverview Heights Replat III, and Lot 6 Riverview Heights Replat, from RE and RS-120 to RE for the purpose of an existing single-family residence; and small subdivision plat Lot 1 Riverview Heights Replat IV.  Applicants: Tom and Mary Hansen.  General Location:  513 Ridge Road; and Ord. No. 4012 - Request to rezone Lots 1 and 2, Southroads Technology Park, from BG-PCO to BGH, for the purpose of further commercial development.  Applicant:  Deep Well dba Southroads Technology Park.  General location:  1001 Fort Crook Rd N.  Second reading and public hearing will be held on October 6th.

8. Council approved Res. No. 2020-36 Amendment to Master Fee Schedule as amended, to remove Haworth Park Fees from the MSF.

9. Council approved the following items: approval and authorization for the Mayor to sign the Agreement between the City of Bellevue and MMC Mechanical Contractors, Inc. for the replacement of the boiler at 1500 Wall Street, not to exceed $29,996.00; and Approval & authorization for the Mayor to sign a permanent sanitary sewer easement between Sherwood Properties, located in part of Lots 1 and 2, Hidden Hills 2nd Addition.

10.  Administrative Reports: The monthly report for September will be attached to the October 6th meeting.  Mr. Mark Elbert provided an update on COVID-19 and Phase IV.

11.  There being no further business to come before the Council at this time, on motion duly made and seconded, at 6:37 p.m. the meeting adjourned.
