Bellevue City Council Proceedings

A meeting of the Mayor & Council of the City of Bellevue was called to order by Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m. on October 20, 2020. Present were Council Members Bob Stinson, Paul Cook, Pat Shannon, Don Preister, Thomas Burns, & Kathy Welch. Absent: None.
Notice of this meeting was given in advance thereof by publication in the Gretna Guide “Omaha Daily Record” & posted in two public places, the designated method for giving notice, & was given to the Mayor & all members of the City Council. All proceedings hereafter were taken while the convened meeting was open to the public. Mayor Hike announced that a copy of the Open Meetings Act is posted in the back of the City Council Chambers.
Mayor Hike led the Pledge of Allegiance. Pastor David Lydick, Midlands Bible Baptist Church, 2407 Chandler Road E., Bellevue, gave the invocation.
The following items of business were considered:
1. Council approved the Agenda as amended, by moving Item #16c to after Item #10 and then to move Items #14b and #14b.1 to follow Item #16c after Item #10.
2. Council approved the consent agenda which included: Acknowledge Receipt of September 23, 2020 Board of Adjustment Minutes, Acknowledge Receipt of September 24, 2020 Planning Commission Minutes; Acknowledge Receipt of June 9, 2020, July 14, 2020, August 11, 2020, and September 8, 2020 Tree Board Minutes, Approval of October 6, 2020 City Council Minutes; Approval of the Claims; & Request approval of the applications for waiver of hunting applications.
3. Following discussion, Council approved the recommendation for the creation of a Sidewalk Construction & Maintenance Task Force.
4. Council approved the renewal of the City Employee insurance plans and premiums for their respective, for qualified employees and retirees.
5. Public hearing was held on the request for approval of the Southwoods Manager, LLC Redevelopment Plan for Lots 9 through 11, South Woods. Applicant: Southwoods Manager, LLC. General Location: Nebraska Drive and Childs Road West and Res. No. 2020-42: Approving & authorizing the Mayor to sign agreement with Southwoods Manager LLC to implement the Redevelopment Plan. Ms. Debra Duff, Mr. Scott Corriveau, Mrs. Amy Corriveau, Mrs. Carmen Gun, and Mr. Brandon Gun spoke in objection, presenting their concerns to the Council. No one else in the audience came forth to speak in support of or in opposition to the application. Mayor Hike closed the public hearing. Council moved to table until the November 3rd meeting.
6. Following the third & final reading, Council approved Ord. No. 4007- An ordinance to amend Section 6-117 of the Bellevue Municipal Code pertaining to the Regulation of Bees Violations- Revocations; Ord. No. 4008 - An ordinance to amend Sections 9-17 & 9-18 of the Bellevue Municipal Code pertaining to Elections; Ord. No. 4009 - An ordinance to amend Sections 15-194 of the Bellevue Municipal Code pertaining to Unlawful Acts - Sale or Rental; & Ord. No. 4010 - An ordinance to repeal Section 20-5 of the Bellevue Municipal Code Pertaining to Swearing, Cursing, Etc.
7. Ord. No. 4012 - Request to rezone Lots 1 & 2, Southroads Technology Park, from BG-PCO to BGH, for the purpose of further commercial development, was read for the third & final time. Following discussion, motion to approve failed on a 0 – 6 vote.
8. The following ordinances were read for the second time & opened for public hearing: Ord. No. 4013 - Request to rezone Lots 122 through 124, Belle Lago South, being a platting of a tract of land located in part of the Southwest ¼ of the Northwest ¼ of Section 8, T13N, R13E of the 6th P.M., Sarpy County, Nebraska from AG to RG-50-PS, for the purpose of single-family Residential Development and to approve a preliminary plat for Lots 122 through 124, Belle Lago South. Applicant: HC Belle Lago, LLC. General Location: Looking Glass Dr. & South 45th Street. No one spoke in favor or opposition of this ordinance.
Ord. No. 4015 - Request to rezone Lot 1, South Woods Replat 4, being a replat of Lots 9 through 11, South Woods, from RG-8 & RG-8-PS to RG-8-PS for the purpose of multi-family residential development and to approve a small subdivision plat for Lot 1, South Woods Replat 4. Applicant: APOGEE Professional Services. General Location: Childs Rd. & Nebraska Dr. Mrs. Amy Corriveau and Ms. Debra Duff spoke again in opposition with more questions and concerns.
Ord. No. 4014 – Request to rezone Lots 2 & 2A, Kennedy Town Center Replat Seven, being a replat of Lot 2, Kennedy Town Center Replat Four, from RG-20- PS to BG-PCO & RG-20-PS for the purpose of a commercial & multi-family residential development and to approve a small subdivision plat for Lots 2 and 2A, Kennedy Town Center Replat 7. Applicant: Carlson Consulting Engineers, Inc. General Location: 25th St. & West Chandler Rd. Ms. Barb Lamoine and Mr. Daniel Dube gave their concerns and spoke in opposition of the ordinance.
Ord. No. 4016: An ordinance to amend Sections 18-106 to 18-112 of the Bellevue Municipal Code pertaining to reserved spaces for handicapped persons. No one spoke in favor or opposition of this ordinance. Councilman Shannon proposed an amendment for the Council to be included in Ordinance No. 4016 and will be included with the third reading.
9. Council moved to table Ord. No. 4003: An Ordinance to amend the official zoning map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about Fort Crook Road and Fairview Road, more particularly described in Section 1 of the Ordinance and to provide an effective date, until December 1, 2020 per the applicant’s request.
The third and final readings of these Ordinances will be November 3rd.
10. The following ordinance was read for the first time: Ord. No. 4019: An ordinance to amend Section 6-22 of the Bellevue Municipal Code pertaining to restraint – dogs. The second reading and public hearing will be held on November 3rd.
11. Following public hearing, Council approved a Conditional Use Permit for Lot 2, One Cornhusker Place, to allow for automobile sales for Tuffy Tire and Auto Service.
12. Council approved the following items: Approval of contract with Dude Solution, Inc. for the implementation of the SmartGov software application of the following development services processes: Building Permitting, Inspections, Min. Housing Enforcement, Contracting Licensing, and Financial Connectors, in an amount not to exceed $ 68,042.90; and approval of the purchase of a 2020 Pierce Impel Ascendant 107’ aerial unit from McQueen Emergency, in an amount not to exceed, $1,074,183.00.
13. Council adjourned into Closed Session at 9:21 p.m., for the protection of the public interest. The subject matter to be discussed was Real Estate Purchases. The following individuals were included in closed session: Mayor Rusty Hike, Jim Ristow, Bob Stinson, Paul Cook, Pat Shannon, Don Preister, Thomas Burns, Kathy Welch, Bree Robbins, Tahnee King, Rich Severson, Mark Elbert, and Colm Breathnach. At 9:52 p.m., Council came out of Closed Session and re-convened into Open Session.
14. Council unanimously approved and authorized the Mayor to sign the Lease/Purchase Agreement for the leasing and subsequent purchasing of certain properties in Bellevue Sports Complex for the purpose of establishing and maintaining a six-field athletic complex.
15. Administrative Reports: The monthly report for October will be attached to the November 3rd meeting.
16. There being no further business to come before the Council at this time, on motion duly made & seconded, at 9:58 p.m. the meeting adjourned.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Bellevue.
REQUEST FOR RELEASE OF FUNDS
On or after November 17, 2020, the City of Bellevue will submit a request to the U.S. Department of Housing & Urban Development (HUD) for the release of CDBG program funds under Title I of the Housing and Community Development Act of 1974, as amended, in the amount of $344,629.00 to implement the following projects: Administration, Housing, Economic Development and Public Service. The following projects identified in the City of Bellevue FY 2020 Action Plan are exempt from 24 CFR 58.34 Subpart D: ENCAP Food Delivery Program, $56,298; BJSA Sports Participation Assistance Program, $8,000; Program Administration, $50,000. The following projects are not exempt from 24 CFR Part 58.34 Subpart D – Environmental Review Process, therefore, a public notice is required.

- Habitat for Humanity of Sarpy County Housing Rehabilitation – project includes rehabilitation of single-family housing unit for the development of affordable housing, $38,000.00
- All-Brite Parking Rehabilitation – project includes sidewalk and parking rehabilitation at the building located at 601 West Mission Ave, $7,358.00
- BVFD Facility Upgrade Project – project includes façade improvement for exterior doors and windows for the building at 2108 Franklin Street, $19,439.00
- FBC Parking Improvement – project includes the rehabilitation of the parking lot for the building at 112 East 23rd Street, $8,548.00
- MRH First City Tavern and Grill – proposed project includes assistance for façade improvements including window replacement, canvas tenting, and railings, at the building located at 2210 Franklin Street, $45,000.00
- Marathon Commercial Business Rehabilitation – the project includes improvements and rehabilitation to meet food safety requirements for the building at 901 Fort Crook Road N, $100,000.00
- Willabees Building Improvement Project – the project includes façade improvement including sidewalks and windows for the building located at 2268 Franklin Street, $ 12,000.00
FINDING OF NO SIGNIFICANT
IMPACT
The City of Bellevue has determined that the projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Bellevue, CDBG Office, located at 1500 Wall Street, Bellevue, NE 68005 and may be examined or copied weekdays 8:00 a.m. to 4:30 p.m. The ERR is also available on the website, https://www.onecpd.info/environmental-review/environmental-review-records
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Bellevue, Office of the Mayor, 1500 Wall Street, Bellevue, NE 68005. All comments received by November 17, 2020, will be considered by the City of Bellevue prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Bellevue certifies to HUD that, Don Preister in his capacity as City of Bellevue City Council President, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Bellevue to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City of Bellevue’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Bellevue; (b) the City of Bellevue has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at: U.S. Department of Housing and Urban Development, Omaha Field Office, Edward Zorinsky Federal Building, 1616 Capitol Avenue, Suite 329, Omaha, Nebraska 68102-4908. Potential objectors should contact HUD to verify the actual last day of the objection period.
