Notice is hereby given that the City Council of the City of Omaha met on May 6, 2025 and passed and approved the following ordinances:
ORDINANCE NO. 44258
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 2415 Florence Boulevard from R4-Single-Family Residential District (High-Density) to R5-Urban Family Residential District.
Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 9 & 10, Block 4, Lake Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4-Single-Family Residential District (High-Density) to R5-Urban Family Residential District.

ORDINANCE NO. 44263
AN ORDINANCE approving a Professional Services Agreement with Jacobs Project Management Co.to provide professional construction management services on OPW 54503, being the Papio WRRF Phase 1 Secondary Treatment Design project; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Gilbatrar, LLC, a Nebraska limited liability company, to implement the 29th & Jackson Townhomes Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located southwest of 29th and Jackson Streets which proposes the new construction of six market rate rental town homes on a vacant parcel; the agreement authorizes the use of up to $200,445.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

AN ORDINANCE to approve a Master Agreement between the City of Omaha and DeMarche Associates, Inc. (hereinafter “DeMarche”) to provide financial advisory, investment, and similar services to the City of Omaha with either party being able to terminate the Agreement upon providing written notice to the other; the Agreement contemplates an annual fee of $37,500.00 for the initial scope of services which is payable in quarterly installments of $9,375.00 with such funds to be paid from the General Fund 11111, Org: 119014, Account: 42239; and to provide for the effective date hereof.

SPECIAL ORDINANCE NO. 10382
A Special Ordinance to approve the Omaha Downtown Improvement District Association (ODIDA) 2025-2026 Budget and Workplan and levying a special tax and assessment on all lots and pieces of real estate within Business Improvement District No. 6874 in the City of Omaha in the amount of $724,781.76; such assessment shall cover the costs anticipated by the Business Improvement District for March 2024 to February 2025 and contemplated by Ordinance No. 37504 which was approved by the City Council of the City of Omaha on October 3, 2006, and reauthorized by Ordinance No. 38957 approved on March 8, 2011 and amended by Ordinance No. 41463 approved on April 26, 2018; and to provide an effective date therein.

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on May 20, 2025, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:
An ordinance to approve an Agreement between the City of Omaha and Sampson Construction Co., Inc. for construction of the Millwork Parking Garage – OPW 54828 with a Guaranteed Maximum Price (GMP) of $26,000,000.00 dollars; authorizing the Mayor to sign and the City Clerk to attest the Agreement; funding for the agreement will come from Fund 21136 Org 116226 (Parking Construction).
An ordinance levying a special tax and assessment on all lots and pieces of real estate within Road Maintenance District (RMD) 2023-01, in the City of Omaha, to cover the cost of constructing and improving Hickory Street, from South 90th Street to South 91st Avenue, by asphalt overlay.
An ordinance to approve a Wastewater Service Agreement between the City of Omaha and the City of Papillion, Nebraska, to replace an Agreement approved by City Council Resolution No. 997 on August 12, 2014.
An ordinance to approve a Major Amendment to a Mixed Use District Development Agreement for Pepperwood Village, for the property located at 505 North 155th Plaza, to allow for development of the site with a free-standing fast-food use.
An ordinance to approve an Amendment to Special Pay 401(a) Plan and Health Reimbursement Arrangement (“HRA”) for covered employees that is available to employees covered by the Collective Bargaining Agreement with the Omaha Professional Firefighters Local 385 to replace the existing matrix with a revised matrix; to provide authorization for the Mayor to execute and the City Clerk to attest her signature; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with the provisions of the Collective Bargaining Agreement shall not be applicable to those employees in the Bargaining Unit described in Article 1, Section 1, of said Collective Bargaining Agreement.
An ordinance to approve exercising up to four one-year extensions, at the same cost to the City of Omaha, in agreements between the City of Omaha and Vixen LLC, TMC Complete Construction, Inc., OHMS-NE-LLC, and B.J.’s Fleet Wash, LLC, respectively; the agreements were for a one-year term and were approved on April 30, 2024 by Ordinance No. 43819; the agreements were the result of bids to provide homeless encampment cleanup, on an as-needed basis, over the duration of the agreements, with the agreements being for a period of one year with up to four one-year extensions at the sole discretion of the City; to authorize the Mayor of the City of Omaha to execute any further agreements that may be necessary to implement such extensions; for such sums to be paid from the General Fund 11111, Organization 101011, Account 42239.
An ordinance (1) to approve an agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of 160,000.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2024 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #15PBJA-24-GG-05332-JAGX, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide law enforcement programs, prevention and education programs, prosecution and court programs, corrections and community corrections programs, mental health programs and crisis intervention teams, and planning, evaluation and technology improvement programs; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.

AIR QUALITY CONTROL
PUBLIC NOTICE
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Dorsey Funeral Home to obtain a minor air emission construction permit for a cremation unit at 6302 Maple Street, Omaha. The potential emissions, in tons, for this project will be: PM 0.8, PM10 0.8, PM2.5 0.8, SOx 1.8, NOx 2.1, VOC 0.1, CO 0.1 and HCl 0.4.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from May 14, 2025 to June 14, 2025. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
