Notice is hereby given that the City Council of the City of Omaha met on October 3, 2023 and passed and approved the following ordinances:

 

ORDINANCE NO. 43541

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 214th and Grover Streets from GI-General Industrial District to DR-Development Reserve District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Outlot A, Trailridge Ranches, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from GI-General Industrial District to DR-Development Reserve District.

ORDINANCE NO. 43540

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property at 3301 Harney Street from R7-Medium-Density Multiple Family Residential District to TOD-2-MX-Transit Oriented Development District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 & 2, Block 4, Reeds 5th Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned R7-Medium-Density Multiple Family Residential District to TOD-2-MX-Transit Oriented Development District.

AN ORDINANCE to amend Sections 55-33, 55-68, 55-207, 55-227, 55-306, 55-324, 55-346, 55-364, 55-383, 55-404, 55-423, 55-444, 55-718, 55-829 and 55-890 of the Omaha Municipal Code regarding Assisted living permitted districts, Duplex residential lot width in R5/R6 zoning, correction of an error for maximum wall sign area in AG/DR zoning, and clarification to the Townhouse residential definition, Tree planting, and other applicable fees with an application; and to provide the effective date thereof.

AN ORDINANCE to authorize payment to the University of Nebraska Medical Center (UNMC) for professional services to perform DNA testing needed by the Omaha Police Department, for a period of up to five years from January 1, 2024 to December 31, 2028, involving the payment of money from appropriations of more than one (1) fiscal year in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended; to provide for the payment to the University of Nebraska Medical Center approximately $240,000.00 a year, for an estimated total of $1,200,000.00; and to provide the effective date hereof.

ORDINANCE NO. 43544

AN ORDINANCE (1) to approve an agreement between the City of Omaha and the Nebraska Medical Center in the amount of the amount of seven hundred and thirty-four thousand, two hundred and thirty-five dollars ($734,235); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2022 Community-Based Violence Intervention and Prevention Initiative Grant, Award #15PBJA-22-GG-04731-CVIP, awarded by the Office of Justice Programs; provide funding for two (2) violence intervention specialists, one (1) educator, one (1) social worker, fringe benefits, office supplies, and indirect costs as part of the Engaging Networks within the Community of Omaha to Maintain and Promote a Safe Society (ENCOMPASS) Omaha project; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

“Pursuant to Chapter 34, Article VI, Division 3 of the Omaha Municipal Code, you are hereby notified that:

 

It shall be the duty of the occupant, as well as the duty of the owner, of any lot or land or real estate in the city to clear all ice and snow from the sidewalks adjoining the said lot, land or real estate within 24 hours after the city has declared that snow removal operation on the city’s major streets are complete. The failure or refusal of any owner or occupant to fulfill this duty and to clear all ice and snow and other obstructions from the sidewalks has been declared unlawful and may be punishable pursuant to Omaha Municipal Code Sec. 1-10. It is also unlawful for any person to place snow or ice upon any street or alley right-of-way from private driveways, sidewalks, lots, or other private property.

 

Pursuant to Omaha Municipal Code Sec. 34-335 the City of Omaha has the authority to clear the sidewalks of the hazard created by snow and ice. The expense the City incurs for removing snow and ice accumulations upon sidewalks may be assessed against the adjoining property, at the following rates:

 

Amount of Snow in inches               Cost per Lineal (running) Foot of Sidewalk to remove*

Trace (or ice) to 5.99-inches                             $3.45 per Lineal Foot (includes 15% administrative fee)

6-inches to 11.99 inches                                  $11.50 per Lineal Foot (includes 15% administrative fee)

12.00-inches or greater                                      $8.63 per Lineal Foot (includes 15% administrative fee)

*Based on a maximum standard residential sidewalk width of 5 foot. If sidewalk is greater than

5 foot wide a multiplier will be added.

 

Additionally, if it has been determined that a property has been in violation of Chapter 34, Article VI, Division 3 within a previous 36 month period, an additional penalty of $150.00 will be assessed for a second violation and $300.00 will be assessed for a third and each subsequent violation. The City of Omaha Public Works Department thanks the City for their cooperation in clearing the sidewalks.”

The City Council of the City of Omaha will have a Pre-Council Meeting at 10:30 A.M. in the Jesse Lowe Conference Room, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business; and a regular Council Meeting at 2:00 P.M. on Tuesday, October 24, 2023, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska. This meeting will have video conference capability. Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened. PUBLIC HEARING NOTICES

 

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on October 24, 2023, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

An ordinance to approve a Streetscape Maintenance Agreement between the City of Omaha and Mutual of Omaha Insurance Company, concerning the allowable streetscape and landscape improvements in the right-of-way and the private maintenance and liability obligations thereof for the Project Beacon site, located at 215 S 15th Street; to authorize the execution of said Agreement.

An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Worthington 10, LLC, to implement the Nook Apartments Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 8th and Pine Streets, which proposes the  demolition of two existing single family dwellings and the construction of 250 new residential for-rent units in ten separate three story buildings; the agreement authorizes the use of up to $6,113,822.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.

An ordinance to approve an Agreement between the City of Omaha and the Millard Public Schools for the City to provide, through its assignment, five Associate School Resource Officers, at the City’s discretion, one Canine Associate School Resource Officer, or six Associate School Resource Officers if a Canine Officer is not available, and marked police cruisers, subject to the availability of such cruisers and the School District’s needs, to specifically designated locations, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property twenty-eight (28) hours(or less) per week while school is in session during the regular school year, and thirty (30) hours per week while school is in session during the regular school year for the Canine Associate SRO, from the first day of the semester of August, 2023 and ending at the close of the 2023 – 2024 school year.   The reimbursement payment from the Millard Public Schools to the City will be in the amount of $38.00 per hour for each officer; and $43.00 per hour for the canine officer; and $5.00 per day for the canine officer when school is not in session (summer break).

An ordinance to approve an Agreement between the City of Omaha and the Elkhorn Public Schools for the City to provide, through its assignment, one Associate School Resource Officer and a marked police cruiser, subject to the availability of such cruiser and Elkhorn’s needs, to the Elkhorn Public Schools at a specifically designated location, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property twenty (20) hours per week while school is in session during the regular school year, from the first day of the semester of August, 2023 and ending at the close of the 2023 – 2024 school year; reimbursement from the Elkhorn Public Schools to the City will be in the amount of $38.00 per hour for the officer, not to exceed $29,804.35.

An ordinance to approve the acceptance of and authorize disbursement over more than one fiscal year from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, FY 2023 Project Safe Neighborhoods Grant Program, Award #15PBJA-23-GG-02479-GUNP, in the amount of $117,847.00, during the project period extending from October 1, 2023 to September 30, 2026; to implement the five core elements of PSN – partnerships, strategic planning and research integration, training and technical assistance, and accountability, data analysis, and data-informed efforts – to address specific gun crime and gang violence problems within the target district; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.

An ordinance to accept and authorize disbursement over more than one fiscal year from FY 2023 Improving Criminal Justice Responses (ICJR) to Sexual Assault, Domestic Violence, Dating Violence, and Stalking Grant Program, Award # 1 SJOVW-23-GG- 02593-ICJR, from the United States Department of Justice, Office on Violence Against Women in amount of $575,000.00 with a project period of October 1, 2023 through September 30, 2026.; to enhance Omaha’s coordinated community response to domestic violence through the multi-agency Douglas County Community Response Team as detailed in the attached grant application; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter.

An ordinance to approve the acceptance of and authorize disbursement over more than one fiscal year from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, FY 2023 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #15PBJA-23-GG-03621-JAGX, in the amount of $454,638.00, during the project period extending from October 1, 2022 to September 30, 2026; to provide law enforcement programs, prevention and education programs, prosecution and court programs, corrections and community corrections programs, mental health programs and crisis intervention teams, and planning, evaluation and technology improvement programs; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.
