Court Taking Comments on Proposed Best Practices for Guardianships
The Nebraska Supreme Court Commission on Children in the Courts has proposed codifying the standards of best practice for guardianship in the juvenile court.
The committee is proposing six new rules about establishing, maintaining and terminating a guardianship in juvenile court after a child has been adjudicated according to Neb. Rev. Stat. 43-247(3)(a), which describes the jurisdiction of juvenile court.
The goal of the standards is to ensure consistency in the processes involved in guardianship and to protect the best interest of the minor child.
If adopted, the rules would be codified as Neb. Ct. R. 4-501 through 4-506.
The sections of the rules would include an introduction, process to establish guardianship, training, review hearings and reports, termination of guardianship, and disruption of guardianship.
