Notice is hereby given that the City Council of the City of Omaha met on September 10, 2024 and passed and approved the following ordinances:

 

ORDINANCE NO. 43943

AN ORDINANCE to rescind the ACI - Areas of Civic Importance Overlay District for property located at 3030 Sprague Street, and to provide for an effective date.

Summary: In accordance with Sections 55-609 through 55-617 of the Omaha Municipal Code, the ACI - Areas of Civic Importance Overlay District is hereby rescinded, for the following described land in Douglas County, Nebraska: Lots 1 & 2, Boyd’s Addition Replat 5, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska.

ORDINANCE NO. 43944

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 9402 Pacific Street from R1-Single-Family Residential District (Large Lot) to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-8 and Outlot A, Pacific Court, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from R1-Single-Family Residential District (Large Lot) to R4-Single-Family Residential District (High-Density).

ORDINANCE NO. 43945

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 193rd Street and HWS Cleveland Boulevard from AG-Agricultural District to MU- Mixed Use District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 12, Avenue One, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to MU- Mixed Use District.

AN ORDINANCE to accept the bid of MEC Corp. (Military Environmental & Construction Corp.) in the annual amount of $65,500.00, involving appropriations of more than one year as provided in Section 5.17 of the Home Rule Charter, of the City of Omaha, 1956, as amended; for the provision of gun range cleaning at the Omaha Police Department indoor gun range and test fire room for a period of three years; with two additional one-year options held by the City at the same price, to authorize the Finance Department to make payments from a specified account to MEC Corp. for the cost of gun range cleaning services in accordance with the specifications; and to provide an effective date hereof.

AN ORDINANCE to approve a Master Services and Purchasing Agreement with Axon Enterprise, Inc. a Delaware Corporation, approving the purchase of 203 new Axon Fleet systems, including implementation, replacement, training, and support for those systems and the existing 22 Axon Fleet systems for a period of ten years and a subscription to Evidence.com for the storage and management of content in the fleet system for ten years for a total cost of $5,915,502.64; approving the purchase to replace and install 625 Axon Body camera and Taser 10 systems, including implementation, replacement, training and support for a period of ten years, as well as interview room cameras and the Fususcore system which includes a subscription to Evidence.com for the storage and management of content in the systems for ten years for a total cost of $21,659,818.58; with payment to be made from the Omaha Police Department General Fund 11111, Organization 113213 Information Technology/Mobile IT Unit, Account 42266 Information Technology Contracted in the amount of $9,717,074.28; and from the Omaha Police Department General Fund 11111, Organization 113171 Training Academy, Account 46617 Safety Equipment in the amount of $17,858,246.94; and to provide the effective date hereof.

ORDINANCE NO. 43955

AN ORDINANCE to approve an Interlocal Cooperation Agreement between the City of Omaha and the Board of Regents of the University of Nebraska, by and on behalf of its administrative unit, the University of Nebraska Medical Center; to define the rights and obligations of both the City and UNMC with regard to development of the University of Nebraska Medical Center’s Midtown Medical Center Bikeway, which will be constructed along Emile and Jones Streets, between Saddle Creek Road and 39th Street, and along 39th Street from Jones Street to Marcy Street, and through the UNMC campus, to include construction of pedestrian overpasses over Leavenworth Street and Saddle Creek Road, commit the City of Omaha to administer the project with respect to planning, contracting for, acquiring, insuring, and all other aspects of the Bikeway Project, and obligate the parties to secure federal funding through the Department of Transportation, Federal Highway Administration Transportation Alternatives Program Grant Committee; and provide for an effective date.

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on October 1, 2024, at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183. The purpose of these hearings is to consider approval of:

AIR QUALITY CONTROL

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Metropolitan Utilities District for a renewal of their air emission operating permit for the LNG Plant and Liquid Propane Storage Facility at 11710 Fort Street, Omaha. The potential emissions at this facility, in tons, will be: PM10 6.6, PM2.5 6.6, SOx 0.5, NOx 55.1, VOC 5.7, CO 42.8, Ammonia 0.4, Acrolein 0.1, Formaldehyde 0.4, Hexane 1.6, Total HAP 2.0 and CO2 equivalent 102,749.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from September 18, 2024 to October 18, 2024. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
