Notice is hereby given that the City Council of the City of Omaha met on July 26, 2022 and passed and approved the following ordinances:

ORDINANCE NO. 43018

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located west of 210th and Emmet Streets from AG-Agricultural District to R5 - Urban Family Residential District.                        

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 2-12, Capriana, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG – Agricultural District to R5 – Urban Family Residential District.

ORDINANCE NO. 43019

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located west of 210th and Emmet Streets from AG - Agricultural District to R6 - Low-Density Multiple-Family Residential District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that:  Lot 1, and Outlots A-D, inclusive, Capriana, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG - Agricultural District to R6 - Low-Density Multiple-Family Residential District.

ORDINANCE NO. 43020

AN ORDLNANCE to approve a PUD-Planned Unit Development Overlay District, located west of 210th and Emmet Streets, to approve the Development Plan, and to provide for an effective date.

Summary: In accordance with Sections 55-584 through 55-594 of the Omaha Municipal Code, a PUD-Planned Unit Development Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County, Nebraska: Lot 1, and Outlots A through D inclusive, Capriana, as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned to be included in and incorporated into the PUD-Planned Unit Redevelopment Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

AN ORDINANCE to amend the boundaries of the NCE-Neighborhood Conservation Overlay District, to incorporate into that district the property located northeast of 12th Street and Millwork Avenue; to approve an amendment to the Urban Design Element of the Master Plan for the City of Omaha to incorporate the NCE-Neighborhood Conservation and Enhancement District Plan for Makerhood into the Master Plan, and to provide for an effective date.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Woodsonia 3902 Dodge, LLC, a Nebraska limited. liability company, to implement the View on 39th Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3902 Dodge Street, which proposes for the new construction of a 136 unit, market rate multi-family structure and contemplates significant improvements adjacent to the redevelopment site as well as the intersections of Dodge Street at North 39th Street and the alleyway; the agreement authorizes the use of up to $3,689,156.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

AN ORDINANCE to approve a Master Customer Agreement, Equipment Purchase and Software License Agreement, Subscription Software Addendum, and the CAD Maintenance Agreement with Motorola Solutions, Inc., authorizing the acceptance and purchase of the PremierOne Mobile and Training Proposal for the Omaha Police Department (OPD) in the amount of $384,849.00; which payment will be deferred to Year 2023, and a ten-year Maintenance Warranty in the amount of $829,333.00 for a total of $1,214,182.00; the purchase of PremierOne will allow Douglas County 911 (DC911) to talk to MDCs (mobile data computers) in OPD cruisers; with the purchase of PremierOne to be financed through the Fiscal Year 2022 City Capital Improvement Fund 13112, Organization 131555, Account 42266 Information Technology Contracted Services, and with payment of PremierOne and the warranty, whi.ch will begin in Year 2023, to be made from the Omaha Police Department, General Fund 11111, Organization 113213 Information Technology, Account 42266 Information Technology Contracted; and to provide the effective date hereof.

AN ORDINANCE to approve the expenditure of Coronavirus State and Local Fiscal Recovery Funds for Premium Pay in an amount up to three thousand dollars ($3,000) for each regular full time City employee who is not an elected official which shall be paid at a rate of $10 per hour for in person work for the time period between July 24, 2022 and November 12, 2022 in an amount not to exceed nine million five hundred thousand dollars ($9,500,000); to authorize the Mayor to sign and the City Clerk to attest Memorandums of Understanding with each of the bargaining groups representing City employees; to approve the expenditure of Coronavirus State and Local Fiscal Recovery Funds for Premium Pay in an amount up to one thousand five hundred dollars ($1,500) for each part-time or seasonal employee which shall be paid at a rate of $10 per hour for in person work for the time period between July 24, 2022 and November 12, 2022 in an amount not to exceed one million five hundred thousand dollars ($1,500,000); and to provide the effective date hereof.

AIR QUALITY CONTROL

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Drake-Williams Steel to obtain a minor air emission construction permit for the structural steel fabrication facility at 1602 N. 11th Street, Omaha. The increased potential emissions, in tons per year, for this project will be: TSP 16.5, PM10 16.1, PM2.5 15.7, NOx 41.1, Chromium 2.36, Cobalt 1.59, Lead 0.28, Manganese 0.56, Nickel 1.98 and total HAPs 6.77.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from August 3, 2022 to September 3, 2022. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
