Notice is hereby given that the City Council of the City of Omaha met on May 19, 2020 and passed and approved the following ordinances:

 

ORDINANCE NO. 42223

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 140 l Jones Street from OS-Downtown Service District to CBD-Central Business District (property is located within an ACI-l-Areas of Civic Importance Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section l. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots l and 2, Block 196, City Lots, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from OS-Downtown Service District to CBD-Central Business District (property is located within an ACI-l-Areas of Civic Importance Overlay District).; and Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42224

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing ce11ain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 806 North 49th Street from R4(35)-Single-Family Residential District (High-Density) to R4-Single-Family Residential District (High-Density). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: The East 56 feet of Lots 9 and 10, Block 23 Ca11hage Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4(35)-Single-Family Residential District (High-Density) to R4-Single-Family Residential District (High-Density); and Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42225

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 3171-3175 Leavenworth Street from GI-General Industrial District to CC-Community Commercial District (property is located within and ACI-1-Areas of Civic Importance Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: The west 50 of the east 400 feet of Lot 16, Bartletts Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from GI-General Industrial District to CC-Community Commercial District (property is located within and ACI-1-Areas of Civic Importance Overlay District); and Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42221

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property southeast of Blair High and Rainwood Roads from MU-Mixed Use District to GI-General Industrial District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 through 6 and Outlot A, Rainwood Pointe, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from MU-Mixed Use District to GI-General Industrial District. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42222

AN ORDINANCE to amend the boundaries of the IG-Industrial Gateway Overlay District, to incorporate into that district the property located southeast of Blair High and Rainwood Roads; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. In accordance with Sections 55-664 through 55-670 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1 through 6 and Outlot A, Rainwood Pointe, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is incorporated into the IG-Industrial Gateway Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 18 and 19, Block 114, Dundee Place, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska is hereby rezoned from R4(35) Single-Family Residential District (High Density) and R7-Medium-Density Multiple-Family Residential District to R7-Medium-Density Multiple-Family Residential District. ORDINANCE NO. 42227

AN ORDINANCE to approve a PUR-Planned Unit Redevelopment Overlay District in a R7-Medium-Density Multiple-Family Residential District located at 4912 and 4914 Davenport Street, to approve the Development Plan, and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County. Nebraska: Lots 18 and 19, Block 114, Dundee Place, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska.

Section 2. The proposed Development Plan has been reviewed and evaluated pursuant to, and meets each of the site plan criteria set forth in Section 55-885 of the Omaha Municipal Code. Section 3. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42228

AN ORDINANCE to approve an Amendment to the Future Land Use Element of the Master Plan for the City of Omaha, to change the future land use map from Low Density Residential to High Density Residential for property located at 4906, 4908, 4910, 4912 and 4914 Davenport Street; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Section 7 .05 of the Charter of the City of Omaha allows for the City Council to adopt amendments to the City’s Master Plan as deemed necessary and appropriate upon recommendation by the Planning Board. Section 2. The Planning Board, at their January 8, 2020 public hearing, recommend approval of the proposed amendment to the Future Land Use Element of the City’s Master Plan to change the future land use map from Low Density Residential to High Density Residential for property located at 4906, 4908, 4910, 4912 and 4914 Davenport Street, as provided for on Exhibit “A” attached hereto and made a part of this reference. Section 3. The said proposed amendment to the City’s Master Plan, as set forth in the attached Exhibit “A”, is hereby approved. Section 4. That this ordinance shall be in full force and effective fifteen (15) days form the date of its passage.

ORDINANCE NO. 42216

AN ORDINANCE to approve a redevelopment agreement between the City of Omaha, Nebraska and the Omaha Performing Arts Society for the construction of a music venue on the block between Capital Avenue and Dodge Street and 11th Street and 12th Street; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given for execution of a redevelopment agreement between the City of Omaha, Nebraska and the Omaha Performing Arts Society involving the construction of a music venue. Section 2. The Mayor of the City of Omaha is authorized to execute, and the City Clerk to attest on behalf of the City of Omaha, the redevelopment agreement between the City of Omaha and the Omaha Performing Arts Society entered into between the City of Omaha and Municipal Corporation, and the Omaha Performing Arts Society, which is attached hereto and marked as Exhibit I and by this reference may in part hereof as of said forth herein. Section 3. Funding will be from the issuance of tax-exempt redevelopment bonds, Fund 13112 Org 117117. Section 4. This Ordinance, being not of a legislative character, shall be in full force and take effect immediately upon passage under and by virtue of the authority granted by section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

ORDINANCE NO. 42229

AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary identified as OPW 53726; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of the 177th & Manderson Sanitary Sewer, project identified as OPW 53726. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha required to be given the owners or other persons having any interest in and to any of the above described real estate may be given by either the Public Works Department or the Law Department of the City of Omaha. The Public Works Department will be responsible for recording of all deeds, easements or other acquisition documents resulting from the exercise of the authority granted under this Ordinance in the Register of Deeds Office in the appropriate county. Section 3. That this Ordinance shall take effect and be in force fifteen (15) days from and after its passage.

REQUEST FOR PROFESSIONAL

ENGINEERING SERVICES

The City of Omaha Public Works Department is seeking proposals for professional engineering services necessary for the preliminary design and preparation of final design plans and specifications for the separation of sewers located with the City of Omaha.  The projects are Papillion Creek North 212 Sewer Separation (OPW 51685), and Cole Creek CSO 204 Phase 4 (OPW 53820), as identified in the CSO Long-Term Control Plan.  Bidding assistance and construction services may be added by a future contract amendment with the selected Consultant or Consultants.

Interested firms may request a detailed scope of work by emailing their requests to ae.selection@cityofomaha.org  or by writing to the Public Works Department, Attention:  Sylvia, 1819 Farnam Street, Omaha, NE 68183 prior to June 10, 2020.

AIR QUALITY CONTROL

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of UNMC to modify and consolidate minor air emission construction permits for the hospital at 4315 Emile Street, Omaha. The potential emissions, in tons, for this project will be: PM 0.1, PM10 0.1, PM2.5 0.1, SOx 0.1, NOx 21.2, VOC 0.4, CO 1.1 and CO2 equivalent 2,098.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from May 27, 2020 to June 27, 2020. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
