CITY OF OMAHA

Notice is hereby given that the City Council of the City of Omaha met on February 11, 2025 and passed and approved the following ordinances:

 

ORDINANCE NO. 44135

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located south of 193rd Street and HWS Cleveland Boulevard from AG-Agricultural District to MU- Mixed Use District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 13, Avenue One, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to MU-Mixed Use District.

ORDINANCE NO. 44136

AN ORDINANCE to approve a Major Amendment to a Mixed-Use District Development Agreement for AVENUE ONE, for the property located south of 193rd Street and South HWS Cleveland Boulevard, to allow for development of the site with a 15,000-square-foot medical office and approve a waiver to reduce required parking from 75 to 59 stalls (21.3 percent) on Lot 13.

AN ORDINANCE to approve a Jurisdictional Drainageway Maintenance Agreement between the City of Omaha and MRES Ravello Homes Holdings, LLC, a Nebraska limited liability company, concerning the allowable drainage and erosion control improvements within the jurisdictional drainageway and the private maintenance and liability obligations thereof for the Grove Ridge site at 192nd and Leavenworth Streets; to authorize the execution of said Agreement; and to provide an effective date thereof.

AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing Q Street and 122nd Street Retaining Wall Repair, project identified as OPW 54795; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof.

ORDINANCE NO. 44140

AN ORDINANCE to approve an Amendment to the Uptown District Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Uptown Properties, LLC, a Nebraska limited liability company which was approved by Ordinance No. 40805 on June 28, 2016; the amendment proposes to remove Site 7, which is part of Phase II from the Project Plan and reduces the original TIF loan from $3,099,288.00 to $2,248,788.00 in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project; and, this amendment will allow for the creation of the Mason Place Rows Tax Increment Financing Development Project Plan, and providing for an effective date.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Uptown Properties, LLC, a Nebraska limited liability company, to implement the Mason Place Rows Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located southwest of 33rd and Mason Streets which provides for a rowhome project with 15 new for sale units to be constructed; the agreement authorizes the use of up to $1,099,237.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on February 25, 2025, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

 

An ordinance declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing Pacific Street Bridge Washout Repair, project identified as OPW 54778; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements, providing that if said parcel cannot be obtained by negotiation, condemnation proceedings be undertaken and completed.

 

An ordinance to approve a Major Amendment to a Mixed Use District Development Agreement for Avenue One, for the property located at 185 South 188th Street, to allow for development of the site with a 612-unit multi-family residential development on Lot 1, Replat 2.

 

An ordinance to approve a Major Amendment to a Mixed Use District Development Agreement for Shadow View Village, for the property located northwest of HWS Cleveland Boulevard and West Center Road, to update the development plan for changes in building types, combining of Lots 1 and 2, changes to the building placement, and therefore the location of the pedestrian oriented open space areas.

 

An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and The Mensch Group, LLC, to implement the Rows at Barkalow’s Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 4209 and 4215 Ellison Avenue, which proposes the new construction of 14 affordable for sale rowhome residential units; the agreement authorizes the use of up to $859,437.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.

 

An ordinance (1) to approve the acceptance of and authorize disbursement over more than one fiscal year for an Agreement between the City of Omaha and the Board of Regents of the University of Nebraska, University of Nebraska at Omaha (UNO) in the amount of $88,777.00: and (2) to authorize funding for such Agreement from the City of Omaha’s FY 2024 Law Enforcement Mental Health and Wellness Act (LEMHWA) Grant Program, Award #15JCOPS-24-GG-01408-LEMH, awarded by the Office of Community Oriented Policing Services (COPS); provide funding for the UNO School of Criminology and Criminal Justice (SCCJ) to develop an updated wellness survey and evaluation grant program implementation activities for the Omaha Police Department; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.

 

An ordinance (1) to approve an agreement between the City of Omaha and University of Nebraska at Omaha (UNO) in the amount of $32,005.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2022 Project Safe Neighborhoods Grant Award #15PBJA-22-GG-00801-GUNP, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to work directly with the District of Nebraska, Project Safe Neighborhoods (PSN) Task Force and law enforcement agencies to prevent and interrupt gun and gang violence by adult probationers in the District of Nebraska Project Safe Neighborhoods (PSN) focus area; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account.

 

An ordinance (1) to approve an agreement between the City of Omaha and the Board of Regents of the University of Nebraska, University of Nebraska at Omaha in the amount of $268,174.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2024 Community-Based Violence Intervention and Prevention Initiative Grant Award #15PBJA-24-GG-03108-CVIP, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to lead implementation and outcome evaluations for the Engaging Networks within the Community of Omaha to Maintain and Promote a Safe Society (ENCOMPASS) Omaha project; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account.
