Notice is hereby given that the City Council of the City of Omaha met on November 7, 2023 and passed and approved the following ordinances:

 

ORDINANCE NO. 43581

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 12656 Weir Street from R6-Low Density Multiple Family Residential District to R7-Medium Density Multiple Family Residential District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1, THE OAKS REPLAT THREE, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R6-Low Density Multiple Family Residential District to R7-Medium Density Multiple Family Residential District

ORDINANCE NO. 43582

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone prope1ty located southwest of 204th Street and Blue Sage Parkway from AG-Agricultural District to DR-Development Reserve District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: OUTLOTS A - D, AERIE AT BLUE SAGE, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG - Agricultural District to DR - Development Reserve District.

ORDINANCE NO. 43583

ORDINANCE NO. 43584

AN ORDINANCE to amend the boundaries of the NCE-Neighborhood Conservation Overlay District, to incorporate into that district the property located southwest of 204th Street and Blue Sage Parkway; to approve an amendment to the Urban Design Element of the Master Plan for the City of Omaha to incorporate the NCE-Neighborhood Conservation and Enhancement District Plan for Aerie at Blue Sage into the Master Plan, and to provide for an effective date.

Summary: The purpose of adopting this NCE district is to protect the area from incompatible development and to eliminate barriers posed by current zoning, which may prohibit compatible development. In accordance with Sections 55-601 through 55-608.1 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: LOTS l & 2, AERIE AT BLUE SAGE, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned to be included in and incorporated into the NCE district of the Neighborhood Conservation Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

ORDINANCE NO. 43585

AN ORDINANCE authorizing the issuance of a purchase order to KONE, Inc. in the estimated annual amount of $35,720.00, for Elevator Maintenance Service to be utilized by the Facilities Management Division, to be effective for a period of 12 months and is extendable for four (4) one-year periods at the City’s sole discretion; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

AN ORDINANCE to approve a Streetscape Maintenance Agreement between the City of Omaha and Menard, Inc., a Wisconsin corporation, concerning the allowable streetscape and landscape improvements in the right-of-way and the private maintenance and liability obligations thereof for the site at 20540 Cumberland Drive; to authorize the execution of said Agreement; and to provide an effective date thereof.

AN ORDINANCE to amend Section 23 -177 of the Omaha Municipal Code concerning employment classifications by adding the employment classification entitled Fleet Maintenance Master Technician with an hourly pay range of $31.00 to $37.67; to repeal Section 23 -177 as heretofore existing; and to provide the effective date hereof.

AN ORDINANCE to amend Section 23-177 of the Omaha Municipal Code by changing the title of the employment classification known as Automotive Mechanic to Fleet Maintenance Technician and changing the hourly pay range of the renamed classification from a range of $25.33 to $31.27 to a range of $25.98 to $32.79; to repeal Section 23-177 as heretofore existing; and to provide the effective date hereof.

ORDINANCE NO. 43589

AN ORDINANCE to approve an amendment to the Collective Bargaining Agreement between the City of Omaha and the Omaha City Employees, Local 251, American Federation of State, County and Municipal Employees, AFL-CIO; to amend Article 20, Section 6 of the Collective Bargaining Agreements which addresses ASE Certification Pay by replacing the language in the current Agreement with the attached revised version; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with the provisions of the Collective Bargaining Agreement shall not be applicable to those employees in the Bargaining Unit described in Article 1, Section 1, of said Collective Bargaining Agreement; to provide authorization for the Mayor to execute and the City Clerk to attest her signature; and to provide the effective date hereof.

ORDINANCE NO. 43590

AN ORDINANCE approving an Agreement by and between the City of Omaha, a Municipal Corporation and Douglas County, Nebraska, and Premier Biotech, LLC, 723 Kasota Ave. SE, Minneapolis, Minnesota 55414-2842, for drug and alcohol testing of City employees and prospective employees as required by the Department of Transportation and all other employees and prospective employees under the City of Omaha Alcohol and Drug Policy and Procedures and Collective Bargaining Agreements; which Agreement involves the payment of money from appropriations of more than one (1) year as provided in Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended for a period from August 1, 2023 through July 31, 2024; to provide funds from the Human Resources Department Fund 11111, Organization No. 105011; and to provide an effective date hereof.

ORDINANCE NO. 43591

AN ORDINANCE to approve an Agreement between the City of Omaha and Omaha Public Schools for the City to provide, through its assignment, up to ten (10) Associate School Resource Officers and marked police cruisers, subject to the availability of such cruisers and the School District’s needs, to specifically designated locations, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work within the District with each Associate School Resource Officer working no more than 28 hours per week while school is in session during the regular school year, from the first day of the semester of August, 2023 and ending on July 31, 2024; reimbursement from the Omaha Public Schools to the City will be in the amount of $38.00 per hour for each officer for the 2023 - 2024 school year; and to provide an effective date hereof.

AN ORDINANCE in accordance with Section 5.10 of the Home Rule Charter of the City of Omaha, 1956, as amended, to transfer $9,555,824 in unencumbered appropriations in the 2024 Budget of the City of Omaha from the Wage Adjustment account to the City Police Department; and to fix the effective date hereof to be immediately upon passage in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

AN ORDINANCE to approve a Professional Services Agreement involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter with First National Bank of Omaha, to provide Banking services for the City of Omaha for a period of five years from November 15, 2023 until November 15, 2028, with two one-year options to renew at the sole discretion of the City of Omaha; and to provide for the effective date hereof.
